I am fully aware that Cooper is dead. That doesn't change the fact that the jury has to decide if they believe the police that this was not an accident. When the defense points out all the mistakes police made, it could raise reasonable doubt that the police made the correct conclusions.

The jury is not being asked to determine whether or not the police reached the correct conclusion. The jury is tasked with deciding if the State has proven beyond a reasonable doubt the charges levied against Ross.

Lawyers return to court and defense argues that the viewing has harmed their case. Defense attorney Maddox Kilgore says jurors leaned into the car and looked around, which is inconsistent with what Harris did that day. "So what we're left with is exactly what I warned about months ago ... We're in a situation now where jurors have been given free rein to substitute their vantage point, their view point for the evidence, for what Mr. Harris could or could not see from his height, from his view point," Kilgore said. "It allows them to substitute what they could or could not see for what Mr. Harris could or could not see."

No visible reactions or emotions from jurors. They walked around it 4 times then stood, moved around the #RossHarris SUV

Defense calls the jury view of the car "disastrous." "It was a disaster," Kilgore says. "An absolute disaster." Kilgore again asks for a mistrial.

Prosecution says the car is the murder weapon for the entire case. The jurors were allowed to examine the evidence, Prosecutor Chuck Boring says.

Judge Mary Staley denies the request for a mistrial.
 
I'm behind due to traveling, tried to catch up last night but WS was down :( Watched some of the trail on YouTube. Did the jury actually go and see the car with car seat?
 
Judge Staley says an argument can be made that the jurors were too limited in viewing the vehicle; an argument can be made that jurors should have been allowed to get in the vehicle.

If only the front door was open, of course jurors wanted to look in and see the car seat. Probably thought they were supposed to do that, considering it's the crime scene.

If defense was so concerned about shorter jurors substituting their own vantage point for Ross', they should've asked jurors to sit in the driver's seat instead of looking in... but doubtful defense wanted that. :)

Yes, this morning. Defense came in and wanted a mistrial. Judge denied. So we are ready to move forward.

The time to complain about that would have been yesterday when they discussed the viewing for today or BEFORE the jurors were brought out to view the car---not after. The Judge was at the scene so they could have voiced their concerns beforehand. Too late now.

Absolutely not. We have seen him in action on video. If they are smart they will keep him in his seat.

I agree but if I were on the jury the only person I would want to hear from at this point is Coopers dad
