He may have known about the choking fetish but it's doubtful the police would have told him about the contents of the electronics as if that had ever come out by accident the jury would have been tainted. IMO

I imagine MR"s mother found out at the same time the rest of us did just how sick, perverted and evil her son really is.

It would be interesting to see if she speaks after the verdict and if she still supports her son. I hope she offers her condolences to Rodney and Tara. MOO!

That doesn't make it okay, though. If you read carefully the articles that discuss Heeney's decision, this is about the internet and computers, not cars and houses, as in the case you mentioned upthread. Heeney based his decision on something that was working its way through the courts after MR was arrested and after the search warrants had been acted upon. The issue is: why did Heeney hold the Rafferty warrants up to a law that wasn't even in place at the time of his arrest/search.

PLEASE PLEASE tell me the jury is observant enough to notice a shift in mood and feeling from the members of the public in that room with them now that they all know the truth about MR.

Interesting how I view TLM's interview now. Especially after seeing Rafferty's. Very sharp contrast. How idiotic he looks still today pandering to the Jurors with his nods and scowls. Especially to us and soon the Jurors. I guess thats all he's got to beg for his life with.

Well, I've just jumped to the end of this thread after browsing the previous one and skipping through the Rafferty interrogation videos. Judging from what was told to him during that interrogation, such as "maybe other people involved" etc., there's lots of ammunition for a defence. All it would have taken is one wrong guess by LE and he's feel they had nothing and could clam up and ride it out.

Just following the AM980.ca ‏ @AM980_Court tweets and was the jury wanted to see McClintic's May 24th interview with Jim Smyth again. I feel so sorry for them having to reach a verdict with the censored evidence they have. If they had all the evidence, they'd have had a verdict yesterday.

He can't if it's not guilty. If it's a mistrial then he will be.

He can be tried again if the verdict is not guilty ... it's all a matter of arguing that the judge erred somewhere in his rulings. I don't think that will be difficult since one of the rulings was based on a law that had not been passed at the time of the event ... speciically, the requirement for a separate search warrant for the laptop that was in the car (which was covered under a search warrant for the car).

IMO

While I think it was a mistake, I suspect he was trying to prevent a situation where the defense could appeal based on the warrants.
