How is a Mitigation Evaluation Conducted?

A mitigation evaluation/investigation is essentially researching the past. It is a collected history of the individual’s life, beginning from birth through early childhood, continuing through school days and adolescence. The mitigation evaluation traces significant factors that may have affected the individual’s physical, social, emotional, and/or psychological development. There must be inquiry into the client’s childhood, upbringing, education, relationships, friendships, formative and traumatic experiences, personal psychology, and present feelings. The importance of this investigation, and the thoroughness and care with which it is conducted, cannot be overemphasized.

The purpose of collecting all of this information for the mitigation evaluation is to help powerful players within the criminal justice system (prosecutors/judges/juries/probation officers) to see the accused individual as an actual person with a unique family life, social history, and to make them look beyond the police report/charging document and understand the factors that have influenced how this individual arrived in their current predicament.
 
She may not have been if it wasn't for the miraculous camera, palm print and hairs on the baseboard.

Ok, washing the camera in bleach to remove blood and DNA and taking the memory card with her makes the most sense to me.

So why she left the card behind is the real mystery to me now. lol
Because she had deleted the pictures already so why worry? If she was going to take the card with her there would have been no reason to delete them. She definitely thought that the pics were gone - no way would she have left the accidental shots of him being murdered there if she had thought otherwise.

Thanks for posting this info. I have raised my eyebrows more than a few times at her behavior and appearance, trying really really hard not to judge. The seeming impropriety of her tweeting, handling artwork, unprofessional (IMO) actions in court have left me wondering how often she has crossed the line (IMO) in the past. Or is CMJA an anomaly. Is risking your career and reputation for CMJA worth it or is she doing it so she can write a book? SMH.
 
I was at work today and it just happened that one of my passengers was a director at the New Mexico women's prison (random much?). Anyways, she has been there for a long time and even teaches classes to the girls. She has bonds with a lot of the inmates and confirmed that indeed the inmates have a good time. There are lots of programs for them to get involved in and said that once they accept the fact that they are in prison for life they adapt quite well and create families in jail which replace their outside families. They eat together, go to church together, have "parties" and clebrate holidays with their "families". It's a good time for them, including the lifers with no chance of parole. She mentioned that most of them were "gay for the stay" which made me laugh because I had just watched the 20/20 in which an inmate talked of that.

She also told me that many years ago she realized that she had so many stories to tell of her time there that she should create a "sitcom". She joked that OITNB stole her idea for a show and that it very much depicts a lot of what goes on there. When I asked about how Jodi would fare with LWOP as opposed to the DP she said very well, and that she would likely be extremely popular especially given her ability to manipulate. There is a hierarchy in which Jodi would likely climb the ladder to queen bee in a relatively short time.

This is straight from the horses mouth, so now I am quite sure that LWOP would make her very happy.
 
Because she had deleted the pictures already so why worry? If she was going to take the card with her there would have been no reason to delete them. She definitely thought that the pics were gone - no way would she have left the accidental shots of him being murdered there if she had thought otherwise.

Ok, I'll buy that. She obviously took the steps to open the door and take the memory card out of the camera so dropping the card in the washer with bleach does sound like she thought the card would be ruined. If she thought any deleted pics could be recovered from the card I'm sure she would have just taken it with her. Ok, now I'm satisfied. :)

I think prisoners are good at convincing themselves that they're happy with their current situation. (Although some probably had worse lives outside). I'm sure Jodi will adapt. Inside with general population and if she was on death row. She's been locked up for 23/24 since her verdict yet she still found ways to tweet, meet with documentary makers, sell her art etc. She'll continue to do that on deathrow.

She'll continue to pretend to be a happy survivor for as long as she lives (which either be on DP or not). She will. It's up to us to forget about her after the verdict.

Let her be her Queen Bee in prison. Or be infamous on DP.

She'll never have children. She'll never travel. She'll never have choices and be free. She can smile all through her stay in prison. The rest of us will keep enjoying the world as free citizens.
 
Forgiveness, is a gift to yourself. It frees you from the past, past experiences, and past relationships. It allows you to live in the present time. When you forgive yourself and forgive other, you are indeed free.

I hope someday your opinion changes and you can be free.

To me, this is getting personal and disrespectful, because someone else's feelings are being judged. And the person being lectured at is being told to consider that the way they feel is unhealthy. This perspective is way out of bounds, in my opinion.

I empathize with you, LinasK, and the hardships you have been through. Your understanding of yourself and what is important to you is admirable.

i agree but the thought of her having to live with angela simpson softens that blow for me.

i really can't see how they couldn't come to the DP decision...is there a worse crime that they could give it for? if they can't give it to her personally i don't think they should have been selected for a DP jury. jmo

I didn't miss that twisted statement by her. I've always thought it was a sick private joke, the richer for telling it to Flores during that initial interrogation.

She couldn't imagine why Travis hated that picture? Maybe something to do with the fact she had a weapon in her hand, and was threatening to kill him. Her comment that she thought it a great photo needs no explanation.

Exactly. There's a minute and ten seconds between that pic and the next (showing his butt and legs as he's seated in the shower)
And yes she likes to act like she knows Travis...his likes and dislikes etc. and uses it to embellish her stories

I think she will be popular because some sick wackos will send her money probably on a regular basis for a while. The killer can then buy snacks for her new friends.

If she has a lot of prison money she could buy some friends (and enemies that will resent her) and become popular. But I'm hoping she get sued and that it is indeed possible to limit her prison money as well.

True. But she has managed to have friends in jail. Perhaps this is the reason she has replaced her tithe to the Temple with using 10% of her weekly commissary to give to less fortunate inmates as she claimed in an interview :jail:
