2010.02.09 New motion filed by defense TES search records

  • #121
My son used to have a hamster named Robert...I know....weird name for a hamster right???? Anyway......that thing would run circles in the wheel day in / day out.... I feel at times like we're in a giant hamster wheel. KWIM?????

I have to laugh as your description is very visual. I was in the pet store the other day and while standing in line waiting to pay for my dog food I watched 3 hamsters in a wheel. Two were holding on for dear life while the third kept running round and round and round right over the other's at a high rate of speed. Sort of reminds you of this thread. LOL

With all due respect this is not an SA matter. This is a matter of the volunteers right to protection which MN is attempting to keep from the defense because defense has shown no logical reason for having the information. But, MN is not telling defense they can not look at them, they are saying you can not have their private information, cell phone numbers, home addresses. All defense has to do is go on Good Morning American and ask for anyone who has been on Suburban Drive from June 16th through December 11th to please come forward, they are looking for information. If they don't want to do that, they are looking for another victum. But we all know that the evidence shows Caylee was placed there in the very spot around the time of her death in June.

Another theory why JB wants all of the volunteer records. How many volunteers were there? A thousand? Just a guess. So if you have someone calling from the defense offices and asking you very personal, invasive questions over the phone you will probably be upset. Correct? Now these same people may have 20/30 friends/co-workers that they speak with personally and they relay this information to their friends, etc. "You know the defense called me and they went on and on and on about blah, blah, blah and really upset me." What impact will that have on a jury pool? Do the math, it is a lot of people. JMO
I was one of the volunteers with Tim Miller helping to search for sweet Caylee. At first I was so upset because bozo wanted the info. about all the volunteers. After thinking it over for the past few months I say give it to bozo. I would love to have the chance to tell bozo how all the the volunteers was doing the best to find a baby that we knew was dead and the sorry az mother , bozo and the grandmother was trying to stop Tim Millers search. I wish we were allowed to take pictures that day but was told we could not. Let the courts and bozo see first hand how it was impossible to cover every inch even tho we tried. Let them see the swamps and snakes and bugs and old people out in the swamps looking for Caylee. Let all the searchers takethe stand and tell them how hard it was, what we saw, what we could not get to, and the tears that most of all the seachers had when we could not find her and the search was called all. Go Ahead bozo call us to court!

Wow!! Thank you. Thank you. THANK YOU!!! God sees you. We all love and respect and appreciate all of you that searched and prayed and cried for this baby. You are a hero!

This was months ago!!! Why are they trying to go around, under, across.... the judge's ruling? This judge has the patience of a kindergarten teacher, or better yet....Mother Theresa. http://www.youtube.com/watch?v=fj2O5sZj_uU

listen to this BS about a conflict of interest....then Brad shakes his head NO! Later in the hearing Mr. Nejame stands up and informs the judge for the record, that is wholly untrue that there is a conflict, indeed he has a waiver of conflict of interest singed by both Mr. and Mrs. Anthony!!! BAAM!!http://www.youtube.com/watch?v=k7LsKP77ycw
my favorite part: Mr. Nejame , out of sympathy for mom and pop allowed Brad to review the documents before even he saw them (with the stipulation that nothing would be copied...hint...hint Mr. Baez that detail matters!). Brad reviewed them at length and found even less than 32 searches to have been in the relevant area. Woo Hoo!! http://www.youtube.com/watch?v=E5IrzGBLLjg That is a good one too, Andrea says they (defense) have learned that not everyone at TES stayed in the areas they were assigned to, some wandered off, wanting to be near the Anthony home.
Exactly! So how can Mr. Miller possibly be responsible for what folks go do on their own? What in the world?!
http://www.youtube.com/watch?v=tYXZ_GSPyk0 http://www.youtube.com/watch?v=_qH93vT4nmA Here Tony's lawyer argues relevancy , materiality.... "To quote the case law...they are NOT allowed to go on a a fishing expedition", he explains.

I'll say.

OK...my blood is boiling right now....first off, to quote the "seasoned defense lawyer who is respected by her peers" (referring to AL, as stated in a prior post)......"this is a witch hunt"....she's right...thats what THIS is....the defense motions to get ALL of TES records, is just that!!

First off, the defense has compared the publics opinion of KC to Sam Shepard, Osama bin Laden, probably others I've forgotten, NOW, it's a "witch hunt". It's everything else BUT a "real" defense of their client.

By asking for TES records and getting names of those searchers in the area where the body was found, IMO, was a pretty good deal for the defense. BUT....they went thru ALL of those people, and came up with 1 or 2 who said the body wasn't there when they searched. Boom...finished business...isn't what the defense was trying to prove by getting those records??? No body....no KC involvement.

NOW...they want ALL the records...what for???? IMO, and IIRC, MANY searches were done by the airport. The premise of a good majority of the searches was using the "ping" data from KC's phone to find "possible" locations of where little Caylee's body was. Searchers, who were a pretty long way away from the remains site, NEED to be looked at in the defense's eyes.

There were a good number of other people searching everywhere and anywhere to find this girl that so many strangers fell in love with. LE was called out on a few occasions because these people smelled something that wasn't "right"....or found bones....or clothes...or cleaning supplies. Were THESE people thoroughly researched??? Did the defense do their THOROUGH job in "representing their client" by researching ALL the other "private" searchers....why the need for TES records??? Because it's, perhaps, "easier" for the less than stellar defense to try to pin, Lord knows what, on one of the TES searchers...hmmm, sounds like "witch hunt" to ME....why just TES??? Because everything is tied up in a perfect package with a nice bow so they don't have to do any EXTRA work to do yet ANOTHER pathetic attempt to defend their client. IMO...defense of a client is one thing, but dragging innocent people into their "witch hunt" is just disgusting and pathetic. Isn't it a BIGGER long shot that a murderer would be out on searches for the body of their murder victim??? ESPECIALLY that far a distance from the site the remains were found - the TES searchers remaining in the records where off elsewhere - IF, in fact, the defense is looking at the premise that a murderer goes back to the "scene of the crime". This motion AGAIN only AFTER being less than successful with their "body wasn't there" theory.

So, WHERE, pray tell, is this "other" info gonna come into play??? Why get ALL the records?? So the defense can pour over ALL the searchers past transgressions??? If, God forbid, one of them happened to shoplift a roll of duct tape when they were a teen, is THAT gonna make them a "suspect"...just like the defense has done to RK??? An act of using duct tape during something that "may" or "may not" have happened YEARS ago...as told by an angry ex wife....who "may" or "may not" have been blowing things out of proportion...or remembering things as they weren't?? IIRC, in the interviews, she couldn't even remember what YEAR she was married to RK!!! AND, questioning RK's reason for going to the location of the remains is constantly blamed on yet ANOTHER illegal premise of getting info from his GF who works at the jail. Does the "psychic" who supposedly "led" DC to that area have an "inside source" at the jail, as well?? How did SHE know that info?? PLEASE don't even TRY to tell me it was her supposed "talent".

So, I want to make sure in my mind I'm gettin' this straight.....the defense asked for, and got records of searchers in the area of where the remains were found....NOW, they need the rest of the records to pour thru to find info about ALL the other other searchers....to formulate yet ANOTHER bogus "reasonable doubt defense" scheme using yet ANOTHER innocent scapegoat to bring their past transgressions into the public light AND ruin yet another life. And why????? All for the "supposed" defense of a KNOWN pathological liar....a self centered b*tch....and thief.

Geesh....babble, babble, babble....sorry everyone!!

catnron, Thank you. Ok I'm off to my corner to cry some more.......

I am so frustrated for this baby! I am so frustrated with my brother's murderer. We NEED closure!

  • #128
Actually, to me, all this does is run up a big RED FLAG. Defense: "We really don't know who could have killed Caylee and put her body there, other than her own mother of course. But clearly our job is to pin this on someone else." JMO

Is speculation really that bad? I mean, how are we suppose to get to the bottom of something if we can't share our speculations and opinions? I will gladly put all my speculation and opinion post in the rumor thread if everyone else will. I mean that is what I do. I speculate. I am speculating that this motion has something to do with the other motion. IMO

Okay NTS - I'm with you on this one - let's speculate about this motion and what is going on.

But first, let's take a giant step back and view this case over the past year and a half. Over and over again, we've consistently seen one set of behaviors happen. There is negative news from the SA regarding Casey's "innocence" which is bad news for the defense team. And within a day or so, the defense reacts by showing up on national networks, or pulls a new "rumor suspect" out of their b*** ..er..hat, the SA steps with a punch straight to the defense's gut, and we move on to the next step.

Right now, we have a situation where the defense has failed to prove that Caylee's body was place in the location it was found in after Casey was incarcerated, as per Todd M. who is apparently on his knees re his legal standing. We have the defense also missing a court deadline regarding their witness list. Those two items are fact, not IMO.

And we have a motion in the court asking for a private meeting with the judge excluding the defense, requesting time before releasing this information to the defense. And a rumor mill on overdrive. (yippee!)

So what, based on prior behavior will happen now? National television appearances? Nope - no one is interested because they have nothing new to say. Local TV appearances? Nope - Ms Lyons in her wisdom has pulled the plug on Baez's face time. Well they have got to come up with something - let's whine some more about all the searchers. The defense team received the details of the 32 searchers MN showed to the media. They've had that for several months. They've had the ability to go to MN's office to view the rest but hey! these are very busy busy people - no time to do that, and besides the interns could do it if they had the total number of names themselves.

IS THIS A BIG DEAL IMO? Back to my original comment on this thread.

MR. BAEZ - MY RESPONSE IS - YAWN........zzzzzz

MN's office delivered the records of the 32 searchers to the defense last year. The rest are in MN's office with an open invite for the defense to go through them all.
MN is cool and smooth.
JB is a noisemaker - does he really just want all those records released to the public? stall stall stall

This is a motion with new information. Sound familiar? The new information is that Mn said he was protecting the volunteers of Tes, but his actions were to show the press documents with names.

New information, new material. This is why I wondered if the Sa motion the other day had anything to do with Tes turning over material to LE. Now that this motion has been filed, I am starting to believe that the defense is sure of this. The SA is hiding something and the defense is trying to get to it. These two motions are too close in time to ignore. IMO

Nope...no NEW INFORMATION...nothing new here. :other_beatingA_Dead
Baez is still trying to get his hands on ALL THE RECORDS TES has.
A Fishing Expedition.:twocents:

The Defense's arguement is that Caylee's remains were not on Suburban drive during the TES searches of that area. So they only need to see the records for the search of that specific area and do not need ALL the records.

Judge S had already ruled :gavel: Baez can have the information on the 32 searchers that searched the area where Caylee's remains were found.

  • #132
What I gather from the news update in todays update thread.....MN showed the records of the 32 previously identified searchers to the media. JB and team mistakenly (WHAT?) thought it was "other" searchers' records....and beat it to the courthouse to grasp at yet another straw. Are they seriously that inept? MN says he delivered the same records to JB last year.

  • #133
And why, pray tell, can't someone from JB's team sit in a conference room with one of MN's paralegals and go through the records. Could it be that defense feels someone would be watching their every move? And why can't JB start with the group leaders and interview them. Wouldn't they know who was doing what that day? I would think group leaders would have had to account for people at the end of the day to make sure everyone returned safely. More smoke and mirrors if you ask me. JMO

The prosecution and the Anthonys’ family attorney, Brad Conway, has seen the documents.

http://www.cfnews13.com/News/Local/...eads_to_new_motion_in_casey_anthony_case.html

I wonder if RH was right about it being a new witness. IMO

BBM
Last week, NeJame told News 13 the Defense has an open invitation to come to his office and review all the Texas EquuSearch files as well.

http://www.cfnews13.com/News/Local/...eads_to_new_motion_in_casey_anthony_case.html

"The disclosure by Mr. NeJame of these records, including volunteer names and phone numbers, seriously undercuts the argument made by TES against giving them to Miss Anthony," the motion states.

But the defense already has the documents.
NeJame said his office personally delivered those documents to the defense last year.

In August 2009, the judge ordered the group to hand over details on 32 people who had searched in the area where Caylee's remains were eventually found."

  • #135
Yeah, that part I don't get. The defense has claimed in a prior motion that JJ and the lady from New Jersey were Tes voluteers that searched that area and Tes did not give them those records. So, I am not sure what is going on. I think they feel that Tes is withholding information, hence the motion. Otherwise, why would they keep bringing this motion up?

I think its new that Mn has now contradicted himself about claiming to protect volunteers in the light of the fact that he showed documents to the press. That is the new part.

The Sa putting in a motion to talk to the Judge without the Defense present is my reasoning for thinking that they are trying to keep something secret. All my opinion and all speculation.

I want to know the whole truth for Caylee. I understand that volunteers need protection and I applaud Mn for protecting them. But if it is related to the case, then the court needs to know about it. IMO

The lady from New Jersey stated she went on her own to the Suburban site.

The Judge did rule for the defense originally and allowed for the defense to look at 32 records. Since then, the defense is showing that there are other records related to the case. (jj and the lady from New Jersey). Can anyone think why the Judge wouldn't rule to allow the defense to look at any other records that are related to the case?

BBM

Not LOOK AT but have handed over to them...which they have.
The lady from New Jersery SEARCHED on HER OWN..

Records of the searchers where the body was later found were made available for inspecting in order for the defense to determine if any of their info related to those parties. Records of searchers who were never near that area were deemed outside the scope of discovery. Have we seen a motion by JB asking for all independant parties that searched on their own to be ordered to present themselves for scrutiny?????

[snip]

Respectfully snipped.

:clap::clap::clap::clap:

Completely agree. It is far more pertinent for the Defense to investigate those that were not a part of TES and there were many searching in and around Suburban than go on a fishing expedition inside TES.

What's the point? The point is, it is easier for the Defense to do that than investigate all of those other independent individuals. IMO.

Smokescreen.

  • #140
32 + JJ + Lady from New Jersey = 34 2 records that Tes did not turn over to the defense. Could there be more? fair question in my opinion. Moo I am sure the Judge will do the right thing. Sooner or later, Jb is going to get these records. IMO
