I'll bet paragraph 5 of the judges order is what the problem is for JB. Just a guess on my part. That and I feel this link deserves repeating.

Especially the PAID IN ADVANCE part

See also paragraph 2 and 6 about Casey and The Defense to pay costs of TM's Deposition and a representative to safegaurd the requirments of this Order

You got it!! The Defense didn't even pay to pick up the tip/lead CD's after creating such a fuss about them.

I agree that they were given the original 32 records. They have reason to suspect there are more. The Judge has yet to rule on that motion. The latest motion was just to enhance the other motion.

The Lady from New Jersey is a prime example of why someone needs to look at all these records. Jb offered for a 3rd party assigned by the Judge to look at them.

I am sure he has been offered an open invitation to come to his office and look at the original 32. I doubt Nm is offereing for him to look at all the records. He has invited the Prosecution to look at the records. Something is up or these motions would not be coming about. Some people call it a fishing expedition, some call it an investigation. They are the same in my opinion.
...and I'm calling it redundant...and a waste of taxpayers' money.

Unless a searcher buried something that was date/time stamped in the exact area where Caylee was found...what's the point?

It simply amazes me that the defense are not the only ones that are having a difficult time in understanding the judge's ruling on this matter. It has been shown many times on this thread already that this issue has been completely covered by the judge and yet we still have a select few that want to argue the point. Reminds me of the defense and how they can not be bothered to look at the information out there.

You know I kind of forgot about that. Did JB ever pay that bill? Wasn't it nearly 1000 dollars? Hmm wonder what kind of trouble JB could potential be in for not paying an outstanding bill to the courts (if it's not been paid)?

It is over!!! Halleluja!

The judge is going to be none too amused with the defense when they come in and admit
A) They have not scheduled a depo with Mr. Miller and
B) They have yet to go to Nejame's office to inspect the records
and the defense is going to be served a lesson when the judge rules on the discovery order time line. It would be funny, if it weren't wasting so very much of the good people of Florida's tax dollars with this nonsense. Shame on them! Sanctions!

Bold 1:
I believe the Judge will appoint a third party special master to look at all the records. If that person sees a document that is related to the case, they will turn that over to the Judge and the Judge will turn it over to both sides. If they do find a new witness that did search the area and did not see the body, then the defense will use that to make their claim that the body was not there. The defense may find away to thank all the other searchers for a noble effort.

Bold 2:
I do not believe Tes is the authority on searchers. All witnesses are equally important. They may find other searchers like Kw who searched that area. Also, police should have searched the area. They will be deposed.

As far as the experts go, their opinions are of 4 to 6 months or 3 to 6 months give or take. So in my opinion, it is an estimation. I have not seen cross examination of these experts. That is off topic so I appologize. Everything else is just my opinion.

The hamster on the wheel analogy simply reminded me of the Defense. They jump on and run like crazy, spinning like a top. They then fly off the wheel, take some time to recover and, get right back on again with the same thing!

Some folks never learn from experience. And this will all ultimately help KC how?

RR0004: NTS may be getting the requests JB has made to the court confused. JB asked that a third party be appointed for DC's deposition. You're absolutely correct. Why would the court waste time with a third party when the records are available to JB?

Thanks...now this should be noted as FACT!

FACT: The State has ordered JB the right to view all records.

I'm still a firm believer in the truth winning. There will be those (including the defense) who will still not accept the "truth" and whose sole purpose will be to distort it, twist it, and at every turn attempt to discredit it...but the truth is the truth. JMHO

That's life :banghead: you get to rewrite history with creative new speculative spin when:

1. People are busy and thus have short-term memory,

2. People do not have the time or inclination to research or do homework, to fact check.

That's the beauty of WS -- that members work so hard to research and sleuth to get to the truth of the matter, as facts rather than opinion. It is refreshing. :dance: It may take many posts but we get there! We need to refresh to replace opinion with supported facts and promote that.

I don't know...but hey JB I still remember that motion the State filed...I haven't forgotten that there is some new info out there.

IMO...and based on a little bit of my own experience with motions...they're often just attention-getting devices....time consuming, revenue producing (for lawyers who actually do get paid)...but ultimately useless devices.

Well I guess this situation is settled. Now I guess we wait to see how JS will rule on this motion since the defense obviously didn't follow the ruling of the first motion.
