yes i did with marinade dave-- you see what happened to him. hes a good guy- i never knew how he would be such a big part of this.

Baez has a bad habit of not being specific and talking in general almost as if he hopes to luck in to something to help him. Which he needs alot of right now.

Great... now he is blaming prosecution for not doing his job for him


I don't think specific is in Baez vocabulary.......

defense motion for benchnotes. Judge asks which ones specifically have you requested.

Defense lists several they are still lacking.

JA says which individuals do they want them from, all expert benchnotes have been provided.

JB names a couple people who are listed as expert witnesses whose benchnotes or CVs have not been provided to defense yet.

JA says this is the first specific request they've heard from defense, they were not asked before

Judge asks defense which ones they still need.

Defense lists several expert witnesses.

JA says they will provide these documents.

Defense says they have not received the Sherriff's dept crime lab procedure documents and Oak Ridge..... JA says the Sheriff's Dept one is not a crime laboratory. JA says the Oak Ridge one is also not a crime laboratory, regarding ASCLD (?) certification issue.

JA says the FDLE lab did not run any laboratory tests on any of the discovery.

Baez requesting all notes/benchnotes/draft reports from all experts.

JA saying Baez needs to be specific out of the 5000+ pages of the documents which reports the defense wants. JA says as far as he knows all the laboratories have provided everything they want to provide, if there are other documents the defense wants they need to direct this to the legal counsel of those laboratories in the states where they are located.

Baez saying this has been an ongoing issue, they want all the full documentation from all the expert witnesses, all correspondence, pictures and copies of all files, photos, benchnotes, everything in possession of the experts.

The judge asking if there are any experts from the OCSD who will be testifying.

Ashton says the only two listed as experts are two computer forensics experts. To his knowedge at this time their entire report which is very extensive, their entire harddrive was copied..... says Baez's request is too generalized and there are many things that are not discoverable

Mr Baez says he accepts Mr Ashtons representation that there is nothing discoverable.

Ashton says he objects, that he did not say there wasn't any discoverable material there but that the defense's generalized request may include items which are not discoverable

Judge Perry explaining that JB needs to be specific AND that there are rules about whether JB is entitled to rough drafts and notes.

Rules are very specific about what they are required to give you.

Linda K. Baden is behind the bench note and phone call memorialization issues. She specializes in looking for loopholes via benchnotes etc......
