I think this JP is VERY smart, VERY fair, and his rulings seem to reflect he wants this trial squeaky clean and obvious that justice is served.

What I'll never understand here is why the defense does not look at what the state most probably sees as "aggravating" factors, + scientific findings, crime scene photos, in other words what they will most likely present as evidence and attack or disprove that, rather than trying to change the Florida law, run to court with frivolous motions, fuss around with the TES issue, (have the SA do their work for them). . . I can't tell if they really do not know where to start here or are just plain lazy ?

This gender bias is total BS. KC isn't suffering from discrimination. Anyone who pre meditatively murders a child, covers her face with duct tape, and tosses her in the bushes would also be "discriminated against" and given a possibility of the DP. What a giant slap in the face for women's rights!

I got the impression that whatever they discussed at the sidebar was not going to be allowed to factor into this motion, considering what AL said when they got back to their seats. Did anyone else get that impression. It seemed like the judge decided not to allow it - because AL said something to the effect of 'we will go with what we said previously'.

It has to do with money, and you can see the defense is extremely nervous whenever money is mention - like JB popping up out of his seat when Ashton started to talk about the in camera session way back when. What money issue could still be outstanding - unless it is something to do with that ABC guy who is always around?

I posted wayyyy back in this thread, but I think the point was -

the SA took the DP off the table and then put it back on 5 mos. later. In re. the money, I believe the defense is contending that had they known this was going to be a DP case, they would have spent their money differently. :innocent:

Not positive, but pretty sure that was their contention.

In Session just showed KC crying again...it did start when they mentioned Caylee being happy and healthy.....talking heads mention it could play well for the defense if she gets emotional at trial.....

I wouldn't rule out remorse to be leaking into her heart by now.....Caylee would have started kindergarden this year wouldn't she?

I agree that JP does seem to like AL. I work with a lot of big ego, very powerful men. One thing I have learned is they often LOVE to have their ego stroked. AL does a great job of doing that. The other attorneys could learn something from her. This is why I think CM will clash with JP. Both like to be in charge.

IMO it was the comment about Caylee being "happy and healthy" that triggered the crying. She works at digging around her eyes when it starts which contributes to MORE tears. She milks it for whatever she can get out of it. I also think Baez is visibly unable to focus on anything else but KC when she is crying.

I think the referance to Caylee having been a "happy and healthy" child, is thr trigger in that CASEY turns that remark to herself.

SHE at one time was "happy and healthy" until these meanies interrupted her "happy and healthy" life that she thought she had going.

There are never any tears when Caylee has ever been talked about, aside of the time when JA spoke of the duct tape and got real dramatic.
And, those were tears of anger, not sadness or horror of how her daughter was found, IMO.

A better way for the State to do this would be to copy and paste the posts of ALL the 'bloggers' who managed to figure it out and send it on to the defense :)

That would be funny, but I am sure it would not be allowed!

How many times did AL reference bloggers today? She can read bloggers post but no time to figure out her to defend KC?

She is reading the wrong blogs then in my opinion. KC's defense is clear. Admit you did it and try to plea. :truce:

May I ask why JP is shown such respect by the defense but they couldn't seem to show it to Judge Strickland?
What is the difference between the 2?

I thought Jeff Ashton was wonderful; very passionate and well spoken.
I didn't like the judge giving him a little dressing down and I don't feel that the judge is very well spoken at all considering his position of power.
He should say his words more clearly.
Maybe i'm just pizzed at him for scolding Ashton. How dare he!

I got the impression that the judge liked Ms. Lyon.

JP commands and demands respect. This isn't a slam against JS as I think he was exceptionally fair; even bent over backwards to be fair to the defense, IMO. He's just a little less... uh, formal than JP. Maybe the defense saw that as a weakness and used it to attempt to run roughshod over him? They know that won't work with JP.

Someone asked earlier in the thread and it may have been answered (I've missed several pages today) if the judge could overrule the jury's DP verdict. Could have changed, but my very first CourtTV/InSession trial was Justin Barber from Florida court, found guilty and given the DP by the jury, then later the judge overruled and gave IIRC LWOP.

If that is what the defense is saying, it has no legal bearing on the case. That is just defense mismanaging funds to their own detriment. Too bad, so sad. JB quoted a price, got whatever he got from KC, end of story. He knew this was going to be some sort of murder trial. He should have had KC ask for indigent funding as soon as DP was on the table. Just my thoughts on that issue.

I bet KC was administered a large dose of xanax this morning and a Placidyl last night (making her sleepy and hung over) to help KC be emotional and appear remorseful today.

My off topic comment here....she had nightmares/sweats over CAylee...I don't recall tears at all. Please lets not derail this thread.

Yes and in addition it was after weeks of partying --- and not a word about her missing(yeah right--she knew dead) daughter. KC said the nightmares were about she and TL breaking up and him going back to NY if IRC.

I forgot there was another hearing today and was off doing practical things :biglaugh:

and I am only on page 11 of getting caught up plus read media reports and video showing KC in tears

so far, where is defense going with the "scantily clad bias" crap? I dont think the state or me or anyone else gives a flying (censored) at a rolling doughnut what KC was ever wearing, it's about taping her baby's face and throwing her out like trash, right?

and she coulda done those things and then wore a nun's habit afterwards rather than a blue dress and I still would not think highly of her. so what's this bias junk?

second, from the tears video, looked to me she started crying after the happy caylee comment, when it was back to bias. I'll watch it again.

When AL said for the umpteenth time that the defense had no idea what 'new facts' the State was talking about when they re introduced the death penalty - I yelled "The duct tape for one" at the computer monitor - anyone else have that same reaction?

Yep! The fact Caylee was found duct-taped, triple-bagged and tossed in a swamp like trash should give AL an idea.

Yep. I was like..."HELLLOOOO...she was found with tape on her face!" I did the same thing when AL was saying "The medical examination says Homicide with unknown means" I was like "Healthy kids don't just die with tape on their face?"

I believe they can indeed overrule but rarely do so.
