2010.09.14 New Defense Attorney, Ann E. Finnell, Introduced

Baez already has ONE death qualified attorney. Why does he need another? And WHY would Florida pay for TWO DEATH PENALTY lawyers? Florida residents, stand up and fight this. And why would ANY reputable attorney join this (imo) joke-of-a-dream-team. It certainly won't help their image. If it would, I think lawyers would be swarming to be on this team.

I wonder if having more than 1 DP qualified lawyer on this case has to do with Baez's qualifications (or lack thereof) to try a DP case in Florida, or Due Process or Ineffective Counsel issues?

Has Baez met the statutory standards to try a DP case if Florida? To act in any capacity once Casey's murder trial starts?

Gotta love Dr. Lennamon's newest post on his blog!

"Personally, I don't know Ann Finnell but I've heard lots of great things about her -- she's known to be a fighter, a true believer, and a very good death penalty attorney. As the first death-qualified attorney on the Casey Anthony case, I do know a bit about the representation that Ms. Finnell has just undertaken, however.

And, as I did before with Professor Andrea Lyon, I wish my colleague Ann Finnell all the best in this important work. "

Up here in Canada Ms. Finnell, we call this "FAIR WARNING". :croc:

I agree
It seems, from his experience with this case, he may have unpleasant opinions on Baez and Casey but is being very diplomatic in his statement towards the new DP lawyers, as the come on board...
:waitasec: How many DP qualified lawyers have come and gone on this case?

Bump...

Given the new motion requesting a budget for mitigation work.......does anyone else this as an attempt to extend the deadline for listing penalty phase witnesses?????

Ummmmmmmm Judge Perry asked if she was aware of deadlines....JB said yep. Wonder where they are going with that.

Additionally...didn't Mort, Jeanene Barrett and a few others handle that?????

At the budget hearing, Baez said that Barrett had completed just under 400 hours of work, and needed another just-under-400 hours to finish the job. That's ~about~ $18,000 - $19,000 (depending on when the hours were billed). Now Finnell needs *another* Mit Sp????

Baloney.

I hope Judge Perry calls this Oscar Mayer and denies the motion.

Finnell is not court-appointed. Why would she be entitled to travel expenses? :furious:

Exactly! why do Florida tax payers have to pay for all of her travel just because Inmate Anthony is not using a local penalty phase attorney? Why should they have to pay for this attorney to travel and lodging during the penalty phase of trial???

Simple answer: they shouldn't.

Pro bono means pro bono.

Not: Pro bono means pro bono except if you're an attorney for Casey Anthony.

In the motion I took interest in this specific comment...

7. "Counsel cannot at this time estimate the number of days required to select a jury, try the case, and conduct a penalty phase if necessary."

Didn't HHJP deny funds for jury consult?????

Additionally.......did the previous Mitigation Expert not already travel to Ft. Myers and Chicago?????

Perhaps this is a jury consultant in mitigation's clothing.

Finnell is saying she wants to use the same mitigation specialist (Jeanene B) (whom JB said is working closely with Finnell already), and needs 100 more hours. I believe Jeanene already visited the family in Ohio - I remember reading that in one of Cindy's letters to Inmate Anthony.

And regarding the P.I..... Judge P. already told the Defense to use LOCAL P.I.s and use P.I.s who are local to the area where the witnesses live who need to be interviewed if they are not in Florida.

I thought the Mitigation lady was from Chicago - hence her big travel bill to and from Orlando, etc. ????

Finnell is essentially asking for travel expenses for herself. JAC says "No travel for pro bono attorneys."

I hope Judge Perry remembers that.

Something I am not clear on, mainly because I have never had to be concerned about a 3rd party (in this case, JAC) approving expenses -

Where is the line drawn when it comes to the number of attorneys, mitigation specialists, etc.??? The more you add on, obviously the more expensive it becomes. Even if the attorneys work pro bono, there are still costs involved in re. travel, transcriptions, copies, etc... It adds up. I'm not familar with these JAC guidelines

IIRC, Judge Perry clarified the hours Barrett worked in mitigation and I do recall there was some work left to be done. (I am assuming the "work left to be done" was the estimate of Ms. Barrett.) So, who draws the line and when? I guess there will be a hearing and JAC will chime in. I dunno, but the spending has to stop somewhere.

Thanks. Phew! She was excused by ICA just in time!

Wasn't AL using (borrowing?) her DePaul budget to cover her expenses and also student resources ... so it was also about an element of funds misuse, i.e., funds intended to help local cases not out of State high-profile notorious ones?

[She also used this case as a platform to promote her book, although I don't think she sold many copies.]

Yep. She always does the right thing, huh? I'll be glad to not have to suffer through her contrived, bizarre arguments and witnesses though. I have no clue how a person can squander that much money from a law center on an out of state case, use the case for book promotion, and still be a member of the Bar.

"Copies" is covered by Baez's allowance.

JAC stated that they do not pay expenses for pro bono attorneys if they are not the solo lead attorney.

If she can't afford to pay her own travel, I would suggest that she quit taking pro bono cases that involve so much travel. She's only tipping her hand that she's in it for the fame and fortune.

Can I just pipe up and say that what she's asking for appears to be rubbish, but this the most nicely worded motion I've seen come out of the Defense camp.

There don't appear to be any snide or underhanded comments, I haven't seen any spelling mistakes and she appears to speak in whole sentences. Well done! But rubbish of course.

Is this the attorney with the overactive imagination - talking about people stalking her because they didn't like her testimony, and claimed she hadn't had a tv in 30 years because she couldn't figure out how to work it, but gets her news from the internet? So many absurdities.

No, this isn't her (she?).

That was Dorothy Clay Sims, an Ocala attorney who specializes in cross-examining medical experts.

BBM Which Andrea Lyon mentions in her motion to withdraw.

Very funny!

I love the word HOWEVER, tacked on to the end of that sentence.

Thanks for finding this. I hope you don't mind, I found the link to the blog and posted it elsewhere, giving you credit of course.
