Exactly! why do Florida tax payers have to pay for all of her travel just because Inmate Anthony is not using a local penalty phase attorney? Why should they have to pay for this attorney to travel and lodging during the penalty phase of trial???

I'm not understanding the need for this attorney anyway. Cheney Mason is death penalty qualified. I thought that was why he was brought on to begin with. I guess he just wanted to jump on the fame and fortune (to come) bandwagon.

IMO, all this case is doing is setting a standard for any, and all, indigent defendents in the State of Florida. Are they all going to be allowed a "dream team"? This could get very expensive, very fast. When is the judge going to say enough is enough?!

In the motion I took interest in this specific comment...

7. "Counsel cannot at this time estimate the number of days required to select a jury, try the case, and conduct a penalty phase if necessary."

Didn't HHJP deny funds for jury consult?????

Additionally.......did the previous Mitigation Expert not already travel to Ft. Myers and Chicago?????

Perhaps this is a jury consultant in mitigation's clothing.

IIRC, he did deny funds for a jury consultant. He said that Mr. Mason had selected many juries and could do the job just fine.

I think you may be right. The Mitigation Expert had traveled quite extensively and completed a large number of hours work.

Doesn't the defense already have a PI who's already completed this???

I was going to start a thread on this exact topic.

I thought for sure HHJP had already decided on the P.I expenses.
Also, didn't Andrea Lyons have a mitigation specialist that Baez fought for tooth and nail at a hearing, claiming she had already spent countless hours with Casey and her relatives. He argued that there had been too much work done to simply let this new mitigation specialist go.

Now they are asking for MORE taxpayer money to do the same job?
Does Baez assume HHJP has a bad memory?

Will JB think he can start from scratch again and keep the hamster wheel spinning? I hope Judge perry and the JAC tell him Enough Already!

I believe the left hand hasn't been very honest and forthcoming with the right hand.

I also believe that Ms. Finnell is in for a rude awakening.

I am starting to wonder if some 'under the table' business is
happening. Charging for services that were never performed
and then divvied up. moo I just wouldn't put anything past a man
who refused to pay child support but got a new car instead! jmo

And relatively soon, HHJP said all filed motions to be heard in 15 days, I don't know if it means business or calendar days, but it should be very soon as to comply with the already ordered deadlines!

Wouldn't the new law prevent that from happening, since she joined this case pro bono and has now filed a notice of appearance?

That's something I had forgotten all about, but if there is any tiny
loophole in that law I'll bet JB could manage to find it and slink
through.
I wish we knew what was going to happen to all of the work J Barrett
has supposedly done.

A criminal act, a complete mental breakdown, ummm emergency long term medical condition, going on a drug/drinking bender. :biggrin:

J Barrett was still visiting ICA as recent as August. I wonder if AF will try and paint GA in a bad light and if that's her focus. Where Barrett may have been working on other types of mitigation. I just don't know, just speculating.
 
Finell was one of the attorneys who helped free Brenton Butler. Of course, he was later convicted of several felonies in my home state. Lovely woman indeed.

Thank you! I watched the hearing but I don't remember hearing JB talk about J Barrett. At least he won't be going backwards like I originally thought. So the new Attorney began working with Barrett even before she filed her NOA with the court?

Sept 14, 2010 it was announced that Atty Finnell was joining the defense team.
Finnell visited Inmate Anthony in jail on Sept 13, 2010.
Finnell filed her Notice of Appearance Oct 1, 2010.

I went back and listened to the Hearing, at the end of Part 2 of the Hearing videos, at the (24:22 min mark). I may be wrong about Jeanene B??

The Judge mentioned the mitigation "investigator" (not "specialist"). So, I'm not sure if that means Jeanene B., the mitigation specialist who has done some mitigation work/investigating already? Or if it means the defense private investigator, Mort S., who has done some mitigation investigating/interviewing of witnesses?

Right before they discussed the DNA testing and the Eikelenblooms and their Lab - the Judge brought up the new attorney - Finnell and the mitigation investigator.

Thanks ThinkTank! I got the impression the mitigation investigator they were referring to during the hearing was Jeanenne B. as well. She was still visiting KC as of this past August according to the jail visitation log.

I was under the impression that Baez was referring to the "team" of J. Barrett and her investigator Mort since they often visited KC together?

Perhaps I've just misunderstood what was going on. HHJP had just been talking about the new death penalty expert on board, so I assumed they were talking about her and the mitigation expert already on board working hand in hand, not with the investigator.

Baez's statements are so disjointed it's difficult for me to follow along with what he is saying or not saying. Thx.

Ann Finnell first visited ICA on Sept. 13th for 1 hour and 15 minutes along with JB. So I'm assuming this is when she officially came "on board." You're right, it could only be a couple of weeks that she could have been working closely with the mitigation specialist, Jeanene Barrett. Not sure how "closely" you can work with someone that's in another state, but I guess between computers and telephones it could be as close as really being there.
