I think HHJP really sent a message to Baez and Co. at the end of the hearing!
His Honor was addressing all counsel, but it was obviously meant for Baez.

"I would not want to be caught violating the rules."


Classic. I love HHJP. I have faith he will not let JB get away with any shenanigans!

Seems the judge was smirking at the states complaint....just brushed it off and said follow the rules. So...how does the state get discovery from JB? :waitasec:

Good Lord..just how many "moments" does Baez need for a status hearing that was scheduled and should have been prepared for!

What the heck are those color charts for? Doesn't seem to be working for him..wait I shouldn't blame the colored charts they are probably done well...it Baez that is having difficulty sorting through them.

Nobody told him the point of adding a colour to prioritize, is so you can sort by them.

Wow, another shambling performance by the defense is finally over, their obvious stall tactics were shot down by the judge with the often reiterated , "you have got until October 31st" If I were JB I think I'd start doing some work. For such a large team they have done very little to defend their client, unless you count the "zomg someone else did it honest judge!!" defense.

He's kidding right??? 23K is nothing. I have one very small case that currently has 70k.

Give me a break JB.

JB was saying that he had to review 23K docs on EACH WITNESS....not in total.

I am so sick and tired of Baez always dropping hints that somehow the FBI and LE labs are anything but unbiased, bound by scientific ethics, etc., etc. This is NOT a conspiracy theory against your client!!! You have the right to question/depose any of the lab experts....but not to run off to a foreign country for a little "evidentiary hanky panky" out of the sight of other court officers or mediators! I just do not trust this defense.

Amen!! The whole Anthony Circus has been trying to "plant doubt" by hoping everyone will have this unfounded and ridiculous "distrust" for law enforcement. Get real, suga' dumpin' isn't that special..no one has thought of creating a conspiracy theory against her, what would anyone stand to gain?

I had the most incredulous look on my face when he said that. There is NO WAY they have to go through 23,000 docs on EACH witness before deposing them. What a crock of a sorry excuse. :loser:

They might have to go through that many documents. Even if they do with that many attys at their disposal and with many years of experience between them all 23k worth of documents shouldn't take long. 23k in litigation is a small sum. Truly.

In a single production I've sent out 40k worth of documents (and it was just a single production) that needed to be gone through and labeled for confidentiality designations etc. If done in an organized manner it can be accomplished. But you can't be lazy about it. And JB and co. are lazy. They don't want to work hard. I hope Honorable Perry makes sure they DO work hard.

IMO JB has already gotten away with a boatload, now it's just the matter of getting caught. Hopefully soon.

Gee, would that be the script that ICA was given by the non-existant Zenaida?

I think we should take bets as to how many interviews Baez still has undone by Halloween. How appropriate is it to have Halloween as the final date? More treats for the prosecution, and lots of tricks by the defense to extend.

Thanks Scamperoo, I didn't hear that statement and could not figure out what the Oct. 31st date was about.

Hard to miss that big 'ol elephant in the courtroom today. It was wearing a flashing sign that read: "Dear Jose, we all know that you've whizzed away two full years doing nothing but self-aggrandizing stuff rather than the hard work of preparing your case".

JB says it was attached to a motion. LDB says based on witness statements, they know there are other taped statements out there from lay witnesses, it appears they are in possession of items that they have not turned over.

If JB tries anything sneaky, like bringing certain evidence into the trial that the State is not aware of there will be a huge rumbling sound coming from Judge Perry. JB needs to be careful. imo

Hearing the motion now.

JB motion says it all, the disagreement is about the country test will be located in. Denver Lab to be established in the next 30 days if the state will not allow evidence to foreign country.

Really, they are going to set up a new lab in the US within 30 days ..and Baez expects the Judge to take his word on that? sure, sure LOL

He doesn't want the evidence to go to a certified lab because most of them in the area are affiliated with law enforcement. So?

Must be the Funky Business that goes on, just like at the Orange County Jail.
Is he hinting at BIAS? tsk tsk...

Brief summary of the hearing:

Deadline for the defense to depose the state's expert witnesses extended from Sept. 30, 2010 to November 19, 2010.

Deadline for depositions of all LE personnel remains Oct. 31, 2010.

Deadline for depositions of all other witnesses remains Oct. 31, 2010. (including Amy H. who now works on a cruise ship and is only available on Saturdays in Miami, heh)

Defense motion to allow the canvas bag and pair of shorts found with the remains to be sent to a lab in the Netherlands to be tested for touch DNA was heard. Judge Perry will not allow the evidence to be sent outside of this country but is inclined to allow the defense to use whatever lab it chooses in the U.S. Will rule later in the week after verifying if there any requirements regarding lab certification.

Judge reminds all to follow the rules of discovery, if they feel someone is breaking the rules file a complaint.

Is that it? Please add or correct if needed.
