2010.12.03 Agreement: No Death Penalty, Life In Prison For Elisa Baker

BBM

I've been wondering for quite some time if perhaps AB doesn't have anything to spill.

I noticed EB's failed poly questions revolve around "Do you know who.......(did such and such).......?"

I'd love to see poly results for a more direct question "Did ADAM.......(do such and such).......?"

:waitasec:

If he was totally innocent, and being that he is a key player, intimate with what was going on in the house, some of EBs comings and goings, etc.... it seems to me he would have accidentally provided some evidence.

From what we have seen he was absolutely perfect as far as going with them to search scenes where nothing was found. Nothing.

When my mother in law was killed and the house was released I found undeveloped film and address book they hadn't taken in the search and pulled it in case it was helpful to them. If he was innocent I just think there would be something he was offering up, other than "I was clueless".

His hit ratio on uninvolved scenes is just too high to me, but I think he is guilty as sin and was at a minimum the one who dismember her body in that bathtub. Might have been EBs idea, but I think he did the labor. And that is the best I can come up with if I give him the benefit of the doubt. You don't dismember the body of you child if you aren't part of the reason she is dead. You just don't. You call the police, you kill your wife in a blind rage, you shoot yourself in grief, you are baker acted, anything other than what we have seen.

maybe it was during the search of the house I don't remember but I did hear a plain clothes detective state that she wasn't cooperating. An older thin man.

You know, I'm not even clear enough on dates to have an idea of when she might have struck the deal and began cooperating. I need to do some homework, I think.

Now I think we have the answer for Atty Dubs being taken off the case yesterday - there was never going to be a death penalty after she showed LE where body parts and crime evidence was! (wasn't back in late October?)

And for a death penalty specialist this is already a win, she can already say she negotiated a deal that kept her client from being killed. The chick who is helping Casey Anthony does the same thing in her stats, many of her "wins" are in jail convicted of murder, just not on death row.

I only read the first few posts and I'm sick to my stomach and that's about all I can say about this thread.

I remember the interview, but I thought it was when Adam was out with them and they were going through the mulch piles and taking apart the wood chipper (the initial time we heard about she might have been disposed of in a heinous way). My recollection was that they said the father was at the scene but was not being what they would describe as cooperative.

I'm not following you, Wenwe.

sorry - I will try to be more clear since my neuron's stretched and didn't get back in the same wrinkles (i fear).

I think what WBTV is saying is that the deal for no DP and no LWOP was made to have EB give up info on where Zahra's remains were; we are now some 5 weeks since that deal would have been made and the DNA should be coming back - as the remains were found 17 days ago. Maybe the Atty Gen. is now asking to take this deal off of the table - they have determined that EB lied on some portion of her confession. She was videotaped some 2 weeks ago as well - maybe they caught her in a lie since then.

But this is where things get ugly, if the deal was no DP or life sentence for her remains, and her being a cooperative witness, she has fulfilled that. They have her remains. She is more than happy to say that Adam was the monster involved.

If they wanted the deal to be contingent on a successful indictment of Adam that needed to be said up front. She admits to being involved in dumping body pieces all over the county and cleaning the house. Her DNA and fingerprints will be everywhere.

They may have cut themselves a cruddy deal but they can't change it now because they don't have a murder indictment in hand.

I really wish we could read the agreement.

OMG this is just preposterous!!!! I can hardly believe my eyes. No DP and no life???? What about justice for our little angel??????? I am just plain astounded. I put so much faith in the justice system in this case and am truly saddened now. And unlike some others I really did expect the DP for the torturers of this child.

Exactly! What, are they going to slap her on the wrist and send her on her way??

This case is unbelievable...

I hate realying on this "source's" interpretation of the deal. Who knows if its second or even third hand information? Who is this source? Not even a "close to the investigation" source?

huhnff

I think there is a deal, who knows what the deal actually says? The whole of it? IMO any DA that would take Life and DP off the table without even knowing the role the suspect played without some sort of "out" in the deal, hasn't watched nearly enough law and order.

I wonder how much experience he has with capital cases.

From what I am understanding everyone has the right to plead the fifth. To help someone disregard that plea the incrimination is removed. Therefore the person is more willing to share detailed information.

  • #193
Probably true - we can't make any sound conclusions as to what the deal was but what we can conclude is the deal is such that the DA blew it big time. Otherwise he wouldn't be trying to get the State's Attorney General to rescind it. Thats all I need to know about this deal - he messed up big time for whatever reason.

Wonder if the DA could ultimately face Obstruction of Justice charges? :banghead:

Dunno but maybe he ought to go listen to Pat Benatar's Hell is for Children so he can figure out what his real goal in this case should be. He has sure missed the boat IMO.

Do they have ALL the remains? This may be the sticky point JMO

I fully believe it was Adam that was out there with EB throwing her parts about the county. Nothing has made him want justice for her yet, I wouldn't hold my breathe on that changing.

Keep in mind the entire time he was "helping" them search, they found absolutely zero. Seems like being a key player and living in the house he might have accidently stumbled across something that helped the case.

Seems he had a perfect batting record on going to places that were uninvolved with the actual crime.

But couldn't that happen.... if he actually didn't KNOW where to look ?

The timing of this leak has me perplexed. The GJ meets on Monday. Adam doesn't have an appointed attorney in Catawba County. Will Adam now go directly to LE and tell how EB murdered Zahra?

As for LD no wonder she left a possible trial on the table (instead of a guilty plea for no DP/Life), she will now be seen all over the world in a trial that will be talked about for years to come.

Ok, don't anyone faint or anything, but let's just suppose, that maybe she is the one that is only guilty to a degree. I mean even those of us who think AB is involved have thought EB was the ring leader...what if it's the other way around and hence the deal???

teh ... I actually considered this for a brief, tiny moment.
Then I reminded myself that history repeats itself.
EB has a history of abuse toward children.
AB does not from all accounts that I've heard /seen.
That speaks HUGE volumes.

Also, AY (in the questions thread) stated that EB was violent and abusive toward him. Patterns like that don't change easily.

I'm not so sure he has. If we take away everything that EB gave up in this case, I'm not sure there even WOULD be a case. She helped them find the mattress, lead them to the gel liner, bone, and remains at Dudley Shoals. She's the one who coughed up the dismemberment info, and directed LE to the drain traps in bathroom and kitchen. Remove those key piece of evidence, and I don't know where the investigation would be right now. Of course, I say that knowing only the facts presented to me, I have no idea what evidence LE has that I'm not privvy to.

I hope that the alleged deal was contingent upon EB cooperating fully; answering all questions truthfully. Given what EB loosely refers to as the truth it should be pretty easy for the DA to say TFB.
