2010.12.03 Agreement: No Death Penalty, Life In Prison For Elisa Baker

  • #101
They had a fast track to get that done (priority was given) they have to have all that back by now. The only thing I can think of is the person they want arrested they don't have enough and waiting for them to make that one mistake. Perhaps the release of the DA deal will make the other perps sweat now and make a mistake.

They have some of it back, they said what a month or more for the rest of it? anyone have a link handy?

It has been 17 days since they found the remains in the double hole in the woods. I would say they have most of the evidence back. Enough to make an arrest.

IIRC, isn't there a service memorial at a funeral home soon for Zahra???????
Was this leaked to scare someone???

"Those unnamed sources told WSOC-TV that Gaither may be trying to have the agreement thrown out and has asked the attorney general’s office to get involved.

The agreement reportedly allows for the DA’s office to charge Baker with second-degree murder and Baker could plead not guilty to the charges.

Second-degree murder is a class B2 felony and punishable by prison time ranging from seven years and 10 months to 32 years and eight months."

MOO, but I am going to hold out on flipping out (I have already done that today for several other reasons, I think I'm at my max).
There have been NO charges yet on ANYONE. There are so many variables here, and again, NO CHARGES, so just because say, this could be true, it doesn't mean she won't be in for life. Murder, 1st or 2nd will NOT be the only charges handed out, I am certain of that. I will not tell anyone else what to do, but for me personally, I'm going to take a deep breath and work on that thing I have to find, called patience.

Ok, don't anyone faint or anything, but let's just suppose, that maybe she is the one that is only guilty to a degree. I mean even those of us who think AB is involved have thought EB was the ring leader...what if it's the other way around and hence the deal???

Gonna think about that one, teh...

I think this is a safe bet for prosecutors. I dont think she has a snowball's chance in hell of being released once she is convicted.

I can see her being self absorbed enough to think she will get out as soon as possible.

Not this time.

If I was one of the perps or AB, I would be very scared if EB got a dal to talk and turn me in!!!

not to mention she'll be in the general public and you know how people love to hate EB.

Well... That's weird because in my head I was hearing calm down and be patient.Thant was after I flipped out. Thank You.

Outraged. Disgusted. I could go on and on. I just hope that any deception on EB's part voids this deal. I still feel confident that there are lab results to come. This is a very complicated case and I would imagine the testing of all the evidence is very complicated too. So I am very impatient but still confident that the people involved are going to grow old and live the remainder of their miserable lives in prison.

Although she would not confirm the agreement, Dubs did explain why she chose to continue to represent Elisa Baker even though she will not be paid by the state to do so, following the Wednesday termination of her status of provisional counsel by the Office of the Capitol Defender. Dubs was terminated as counsel because Baker has yet to be charged with murder.

“Elisa Baker is cooperating with law enforcement. I have been a part of that cooperation and it is ongoing,” Dubs said. “It would be unethical and unfair of me to stop representing her because the Office of the Capital Defender has decided to end my provisional appointment.”

No wonder she agreed to stay on the case its now a win win situation for LD...PUBLICITY

Sarx,
If you find patience - will you let me know where it is? I have been looking all over for that elusive quality and it just seems to keep escaping me. (sorry ot)
