2010.12.03 Agreement: No Death Penalty, Life In Prison For Elisa Baker

  • #221
If that's the case, then how come we don't have a murder charge yet, even WITH the info EB supplied?

Once they file the charges the defense could take a gamble and invoke their right to a speedy trial and rush them to trial. This is a heavy case to be start the clock before you are ready to. If the defense thinks they are ready to go you will see delays like in the Casey Anthony case, but if they file quickly and defense thinks they don't have their experts and their labs back, they will ask for a speedy trial. Someone will correct but I think that is like 120 days to opening statements. Maybe a little longer on a murder charge, but it is quick.

The timing of this leak has me perplexed. The GJ meets on Monday. Adam doesn't have an appointed attorney in Catawba County. Will Adam now go directly to LE and tell how EB murdered Zahra?

As for LD no wonder she left a possible trial on the table (instead of a guilty plea for no DP/Life), she will now be seen all over the world in a trial that will be talked about for years to come.

Killian is doing the same thing - he says is still representing AB - let me see if I can get the article for you on that - came out today. Will add it here.

Here is the link to Killian continuing to rep AB:

http://charlotte.news14.com/content...neys-stick-with-bakers-after-nc-pulls-payment

Attorney Mark Killian told The Associated Press on Friday that he'll continue to provide Adam Baker counsel when it comes to legal issues surrounding daughter Zahra's death. Killian also has represented Baker on unrelated charges.

Killian says it doesn't matter if he is not paid.

Then who pointed LE to the real location on Dudley Shoals 2 weeks after EB is supposedly cooperating ? I assume nothing - bad word you know the saying.

According to the search warrants and motions yeah the gel liner was found on Christie Road and identified by EB. My point is if she pointed out a dumpster and the prosthetic wasn't found, either in the dumpster or at the landfill, was she even telling the truth to begin with ? If LE doesn't have it and can't find it, seems to me there is no proof she can provide to demonstrate truthfulness about that. But we know LE has it, they got the serial number off of it and checked it against records from Australia. The question remains where was it found and does its location match with her claim. Dunno

She is aware of where to point out on Christie Road but not on Dudley Shoals?

Actually, I don't know the first thing about prosthetic legs or gel liners. I have no idea whether serial numbers are printed on both.

It's possible LE does have the prosthetic leg itself (and by that I mean the titanium part and socket), but I don't see mention of that anywhere, apart from media claiming the prosthetic leg itself was found at Christie, which apparently was just the gel liner.

LE were not the ones to recover this particular item, Dubs was.

Where was this reported please? I have been away for awhile, and missed it. TYIA.

I was agreeing with you; I think it may have been a glove because I thought I'd read in one of the warrants that LE seized three latex gloves.

The SW I'm looking at just says 'latex glove'. No number and no plural. :waitasec:

Am I looking in the wrong place?

A tool - yeah a Knife and a sheath were taken from the residence by LE. There was also the report of a tool being found by LE on Indian Grave Road but no further mention of it.

I must have missed this do you have a link or atleast an idea where I can look. TIA

Agreed. But the point I was trying to make, and not making very well I'm afraid, is that I don't believe LE would have had enough evidence to make a strong case without the info EB provided. Even WITH the info she has provided, I don't know how strong their case might be. Of course, I only have the info provided to me. I have no idea what other evidence LE may have, so I'm certainly speculating.

Does anyone know exactly when and where Zahras prost. leg was found?

http://www2.hickoryrecord.com/news/...n-filing-baker-shows-her-help-case-ar-540284/

Telling law enforcement of three search sites on Oct. 25; at each search site, Elisa said what should be found at each site;

-Shortly after Elisa mentioned the Christie Road site. investigators found part of the prosthetic leg Zahra wore.Elisa said it was the gel liner/

-One of the other sites Elisa directed them to was Dudley Shoals Road site;

-On Oct. 26, the mattress Elisa told law enforcement about was found at the landfill in Caldwell County. Elisa confirmed the description of the mattress, and directed law enforcement to the site of the specific dumpster where it was thrown out;

-Also on Oct. 26, Elisa told law enforcement where other items of evidence could be located at the house.

The beginning part of the motion also states that on Oct. 22, Elisa talked to her attorneys and investigator, about the circumstances about the disappearance and/or death of Zahra.

During the late evening and early morning hours of Oct. 22 and Oct. 23, "the defense team verified that certain information provided by Ms. Baker was reliable. As part of that verification, the defense team located and collected a significant item of evidence."

The following day, on Oct. 24, law enforcement was told that Zahra was dead, and "her body had been dismembered and that it would be recovered at different sites. The piece of evidence collected by the defense was turned over to law enforcement."

On Oct. 25 Elisa helped investigators with the search, since the locations were remote. The media spotted her that day at the Dudley Shoals Road location, in an SUV.

According to the motion "the only credible evidence released to the public by law enforcement related to this case is evidence that was collected after Elisa Baker told law enforcement where to look and what to look for. Law enforcement has been able to locate evidence at landfills, the Baker home and locations throughout Caldwell County and Catawba County only because of Elisa Baker's cooperation and disclosures."

Elisa is currently in jail for the felony obstruction of justice charge under a $65,000 bond, rather than the $1 to $10,000 that is the typical range.

Thank you all, got it!

Thx CG, ok so the leg was found after whatever Dubs brought in on the 22nd or 23rd.
Was it the bone that was found before the leg?
Whatever the item is I believe it ties AB in.

The knife and sheath are also on the list of items recovered in group 3 of the warrants.

If I understand correctly. I may not mind you. The only thing that the DA could possibly want to with drawl this is his own mistake of thinking one person is the main character and an implication that it is another.

A (1) significant item(1) of evidence?
ONE, 1, item brought in by Dubs?????
