..dec.15--"ok fine, here's Dr.Bock's report".-----dated September 28/2010.

..he must have a colour-coded chart on his fridge to keep track of all of his non stop lies..

JB lives in alternate reality, fin his mind the State only had about 20 experts, reality 38, how many authored reports about half, in reality all but 1!

I think Mr. Ashton was very generous in his Response to the court's order saying that JB was "erroneous".

I have never seen his demeanor to be this way. I sure hope he shows up to hear what the judge thinks of this request for sanctions.
How could Cheney sit there and quietly go along with this? HOW?

For the Want of a Hammer the War was Lost...

This Motion makes me wonder if ICA is getting any 'adequate' Defense.

Wars have been lost by in-experienced General's who while they had expert Leaders (Lieutenants)... they were all led blindly to their slaughter.

JB seems guilty of being distracted, focused on collecting as many tools and things for his bag as he can. IMO he has not taken the time to think about how he is going to use these tools, in what sequence, what the strategy is, the big picture.

It is like a jigsaw puzzle and he has many great pieces (experts) that he can leverage (or not) but he doesn't know what fits best, where, when and, how. He doesn't get the big picture ... yet ... of what he has and how to use it effectively.

A veteran attorney could use these experts effectively and, at a minimum, give the SA a run for their money. I think JB is basically going to tip his toolbag out as the trial progresses and just hope that something in there is going to auto-magically create some reasonable doubt. Voila! Never thought of that.

It is scary how JB toys with little pieces of the case, such as ICA's privacy or media notoriety ... little things he can grasp but ... in the grand scheme of things -- he has a bunch of tools that are in a state of chaos and they badly need organizing based on importance, priority, sequence, desired goals, expected outcome, etc.

JB has an ever increasing bag of tools and stuff that he is collecting, he is an avid collector but ... For the want of a Hammer this case is lost before he even gets started.

Baez said, he's not trying to hide anything but he surely is.

His Honor is awesome...he asked when the murder indictment took place. October 2008...Mr. Baez when did you file your discovery motion...I didn't hear his answer, (he got awfully low after his huge waste of a speech..)Then Baez has the audacity to say, he doesn't know what the states experts will testify to....Is he serious. He's got pages and pages of discovery, over 24.000 and he had the gall to say he doesn't know what the state will do!

Baez is really asking to be recused from this case. He truly doesn't have any idea how a DP case is handled...such an embarassment to the the fine attorneys who work their butts to the ground. He's sitting back like he's some debonair gigilo...He's getting on His Honors last nerve...I'm glad JPB ruled as he did for instead of telling Baez off, he just ruled on the motion...LMAO I love me some JBP and JA...I can't wait to see them in true action, in front of a jury.

ICA didn't look so good, not well rested at all. She's got huge black rings under her eyes and I do hope it's nightmares from Caylee that's keeping her up...her hair shouldn't be worn down like that. It makes her look haggity...JMHO

"I'm not going to defend Nilton Diaz," defense lawyer Jose A. Baez promised jurors during opening statements in Diaz's trial. "I'm going to prosecute Samaris Bobe Silva."

Defense lawyers Baez and Jonathan Kasen said they intend to attack the state's case by assailing detective Dan Conlee for zeroing in too quickly on Diaz, by criticizing the work of a medical examiner and by accusing the young mother. They pointed an accusing finger Tuesday at the slain toddler's mother, saying she had treated the 2-year-old like "an animal."


In his closing remarks, Diaz's lawyer, Jose Baez, attacked prosecutors, sheriff's Detective Dan Conlee, the state's medical experts and the child's mother, suggesting they all distorted the truth in their pursuit of Diaz, the lone suspect in the toddler's death.

A jury of eight women and four men deliberated more than seven hours before deciding Nilton Diaz, 30, was guilty of manslaughter and child abuse. Diaz, who had been charged with first-degree murder and aggravated child abuse, seemed stunned by the verdict. He looked to his lawyer for an explanation.


Defense lawyer Jose Baez asked Circuit Judge Mark Nacke to set aside the verdicts, arguing they were based on undependable, controversial and conflicting medical evidence. Baez said the prosecution's case was filled with reasonable doubts.

"We all know something happened to this child, but we still don't know what," Baez said. "What it basically boils down to is pure speculation."

"This simply can't stand," Baez said. He argued the jury's verdicts were inconsistent. Baez said child abuse is an intentional act, while manslaughter is a death resulting from an unintentional act. He said an appeal would raise that issue.

Nacke refused to overturn the verdicts.


In documents seeking a new trial and other post-conviction relief, Diaz says he lost his freedom because of Baez's trial performance, strategy and failure to disclose evidence to prosecutors, a tactical decision that prevented jurors from viewing a defense video. Diaz said “…Mr. Baez wanted to surprise the prosecution, and the surprise blew up in the defense’s face.”

Baez, was not allowed to show jurors computer animation that depicted Silva injuring the child, accused the state's medical experts of "recklessly giving opinions." The defense has portrayed Silva as a lying child abuser and a bad mother.

The video, created by a biomechanical expert, would have shown the jury how the toddler's skull fracture could have been an accident, according to new court filings.


Nilton Diaz, filed a motion for a new trial, claiming he was convicted due to the “defectiveness” of his defense attorney, Jose Baez.

Baez called it a common post-conviction strategy that often cites defense mistakes to win a new trial.

Yup I'm just not seeing anything new in JB's Bag-O-Tricks. First he threw everyone under the bus (LE, ME, mom, junk science). Then he tried to pull a rabbit out of his ear - with a surprise! He wanted the jury to watch a cartoon, of how the child's injury / death could have happened if her mom had been home when she was injured - a ploy that failed - later he blamed the jury citing reasonable doubts (or Judge) for conflicting verdicts. Last he pretty much said everyone blames their attorney when they lose!

Thank goodness HHJSS made the decision for ICA that she was going to see her boy in action - no chance of crying foul after the fact!

Logical, I'll bet your correct. Baez has not read one page of all the discovery handed to him. He is so disingenious with that little video TWA posted. I couldn't believe he was saying those things. It really makes him appear so unintelligent and has no clue what's going on, almost like he's winging it..outrageous, I can't wait for this hearing on the sanctions...I'll bet this will be a doozie...JMHO

I just want to smack that smirk right off his face, he's disgusting...AI'm truly appalled at how he's handling this case...but ICA is happy with him, it's her life, not mine...JMHO
