2011.01.06 Baez Slapped with Formal Sanction

OR ..... Clearly I don't work in the criminal law area but this sometimes happens in civil cases. Could Mason be trying to get an appealable issue NOW and file a Motion to Stay pending the outcome of the appeal? And in the interim allows the case to come to a standstill until the issue can be resolved by the higher Court.

Now bear in mind I'm not sure that this can be accomplished or even allowed in the criminal arena. But if this is allowed this might be Mason's angle.

WESH was the first News station to report it last night, I heard it on the 5 o'clock news but according to their website they had it posted at 4:55pm

I might be nitpicking here, but does anyone think it the height of arrogance that in the motion for reconsideration, their first attempt to deliver this was to email it? Wasn't that method of official court correspondence, ie pleadings, etc., ruled as a no no?
 
Would anyone like to guess what HHJP's offical response to this motion will be?

That's freaking ridiculous!!! I hope he at least bifurcated the case?? I hope your friend didn't have to stay legally married to the person for the duration of 5 years until it was finalized!

Ohhhhhhh............that's not good at all.........

Whatever they are doing, and as mixed up and confusing, and just plain stupid as it looks to all of us, the main objective is to stall this thing out for as long as they can.

Casey just may end up being the longest held accused in the Orange County jail before this is over after all.

The stuff they pull is pretty amazing ~ Ya have to give em that. Just when a person thinks that they can't go any lower, they limbo a little more, lie some more and race to the court house or their friendly news media outlet to get there just in the knick of time before closing. {Of course, they missed that "one deadline"}

If we think we have seen the worst of the worst, the abosute outragous of the outragous, I have a feeling that it will continue.
We have only just begun to see what this band of Merry Fools can wreck havoc on and too.

I know that Judge Perry is an outstanding man and above board and fair. I think that this crew are just pushing, pushing, pushing to find that button that will finally send Perry over the edge.
As much as I would LOVE to see Judge Perry turn around and slap Mason in his wallet as well.......I'm going to pray for the man to remain calm.

Perry remaining calm will scare this team more than anything I think.
Revenge, if needed, is best served cold.

5 years???? Sounds more like a "job security" position. Would not have liked to have seen that attorney bill. jmo

I don't know, JSR. I don't even know what that means, so I would never have thought to ask him that. But I do know he was/is very unhappy. He still, to this day, has to carry a hefty life insurance policy with her as the sole beneficiary. Nope, he is not one of CM's satisfied customers. (But, then, my friend could very well have been quite a difficult customer, too!)

A bifurcated divorce case means that the actual divorce can take place as normal under the rules of that state but issues such as property and child custody are handled latter. Basically a person can become legally divorced without having to wait until all the property and custody issues to be resolved.

Added: bifurcations can be in many areas of law. I had a case that was bifurcated but it was in regards to a jury and a bench trial. Some of the claims were tried by a jury and some by the bench. It was a very odd case. And that particular case also lasted over 5 years and it actually got to trial by 6 years. It was a maddening case.

I'm not sure Florida does bifurcations. It would be interesting to find out though. I know that is done regularly in CA (especially when there are a lot of assets to divide). We don't here in AL, at least not the last time I worked a domestic case, because we sure needed it. However, considering Boca Raton and other affluent areas, this may be an option.

EU, was your friend forced to stay legally married for 5 yrs?
