2011.01.06 Baez Slapped with Formal Sanction

I admit that was my first thought.

Then, I thought that was a bit too arrogant & crazy even for him. So, I tried to give him the benefit of the doubt (don't ask me why..:loser:) and assume he was in essence saying, "I might be willing to give you an interview if you agree to print a 'Casey/defense friendly' favorable story."


I'm not saying I really believe that... :innocent:

If this was a lone incident I might be more inclined to give him the benefit of the doubt. But there just seem to be so many of these. We still don't know who brokered the ABC deals, but we have never heard a lawyers name mentioned in association with them that wasn't JB. And he should have been specifically ethically barred from doing so. At what point is someone going to say enough is enough and kick over this anthill that all parties involved know is there? I know noone wants to impede KC's right to a fair trial and competent representation of her choosing or at least approval. But if you see a problem or a serious ethical violation or pattern of behavior in one of the lawyers, isn't it better for the case, the defendant and the court to get it in the open and cleared before the trial formally starts, rather than after when it becomes an appellate issue?

As far as it being too arrogant and crazy even for him. I love you Beach, but I think that you may be looking at it through the filter of having alot of experience with normal everyday legal professionals. You inately know how they will act because that is how they are trained to act, conditioned to act. What things they do do and what things they don't do. Little things like "you don't ignore specific orders from the judge." "if you will miss a deadline you contact the judge". "deadlines, court dates and legal proceedings are not optional at your whim". I am more and more not sure that JB is operating within that realm. He is much like his client. KC as a sociopath is able to lie so constantly and so effectively because she simply cuts through those mental filters of behavior that every other person is conditioned as a member of society to have. That thought of "why would she lie about that" keeps coming up over and over. She exists outside of the normal structure of behavior. That is what a sociopath is. And it's scary how effective she can be at it. (just note on these forums how often stories that are only ultimately attributable to her and her alone, take on a life of their own until they start assumed to be fact. LP has much the same gift of tall tales.) In the case of JB more and more I think he is some sort of legal sociopath. he lacks the structure of behavior that any normal lawyer has. And more and more he seems to do this rather willfully ad deliberately. The normal rules of ethics and behavior simply do not apply to him.

You make an excellent point because I truly do not understand JB. I don't say it out loud here, but there are many times lately that I, professionally speaking, find myself pulling for him to get it right for once. I know AZ has said she has seen worse than JB. Personally, I haven't....thank God.

I guess I just cannot fathom anyone putting the time, effort and money to get through law school...then spend years cleaning up your record so that the bar would license you to practice....only to commit career suicide. And that is exactly what this is - career suicide.

Your explanation after the part I bolded is the only thing that makes any sense.

While a "game changer" it was not unexpected. Judge Perry referenced his willingness to take control throughout a number of hearings. He gave ample notice. He followed through.

His subtlety is worthy of recognition. Nobody can come back and argue that they were not given notice / warning / a heads up. That goes for KC as well IMO.
 
What the heck was he talking about with the reporter? That was kinda nutty...what can you do for my client?! Are you kidding me?

Can you believe, he even called the reporter back!? "He hung up the phone, called back minutes later and said that conversation was off the record. Told that the conversation was not, Baez responded by saying, "You're lying and being unethical."

Really JB? Really? What exactly did the reporter lie about and how was he unethical in calling you to ask for a statement? You were so close in telling him, "I don't have to answer any questions." Just two little words; "No! Comment!" Maybe you should practice saying this in the mirror, before it's too late - although in all honesty I don't think it will help.

JB has been the brunt of many jokes, starting around day 32 - but it stopped being funny back in 2008 - his behavior and the way he reacted to events early on, just seemed "off", for instance (during the Diaz trial) keeping the judge and court waiting for over an hour - without apology the day ICA bonded out, or his constant demands for special privileges; like asking permission to take ICA out alone, while she was confined to the house or JB's office (not to mention the many hours she spent at his office while out on bond), his inappropriate comments to the press about HHJSS and his infantile behavior during these long pre-trial hearings. The list goes on and on.

I think we expect (in general) a higher level of ethics and morals from any officer of the courts, maybe even more so from defense attorneys - considering the nature of their work. Certainly we expect a significant difference between their ethics and those of their client who is charged with murdering her baby! And yet time and time again, JB has failed to impress, even a little.

I find it interesting that JB even chose law as his career, since early on he showed a complete lack of respect for and an unwillingness to abide by, the same laws he has pledged to uphold. IMO he sees himself as being above the rules of society, let alone the law.

He probably stomped his feet good, once he was out of view, after being sanctioned last week and I think we can count on his fine going unpaid until the absolute last minute. Regardless, we can be sure he will claim he was treated unfairly because of A, B, C, (pick any number of unfair reasons)...

Yes, the first time would have been in July 2008. Multiple times since.

For almost as long as the Casey Anthony murder case has been a part of the public awareness, there have been murmurs about her attorney José Baez's handling of the case. The latest but most vivid example to support this lingering suspicion came nearly one week ago when Chief Judge Belvin Perry struck Baez with a sanction for a "willful" violation of his court order to share expert-witness discovery with prosecutors. Anthony, 24, is scheduled to go to trial in May for first-degree murder in the 2008 death of her 2-year-old daughter, Caylee Marie. She faces the death penalty if convicted.
