Crikey I read these cases in Criminal Procedure but I've forgotten their significance.

But I remember this:

Did the private party act for the law enforcement or more to further their own ends?

If the private party has a legitimate, independent motivation for participating in the challenged conduct, it does not produce vicarious liability of law enforcement.

Law enforcement could not and did not manipulate any member of the anthony family into doing something that they already wanted to do. Every member of the family testified that regardless of what LE did in this case, that they were going to go get answers from KC.

ICA's own words tell that she did not think she was in custody till July 16th, when she was F'ing arrested on a whim.

Therefore, if ACCORDING TO HER she was arrested on a whim on the 16th it would seem clear that she cannot then argue that she was confused about being in custody or arrested prior to that?
