Outlined a 3 prong test: 1) reliable - dog never been trained off/on residual odor. look at Gerus he was right/wrong at the home, the car, we don't know but he was not reliable when he didn't alert on the remains on Suburban Ave.

two cars still isn't enough - in a photo line up isn't enough
there is not one single training in vehicle line up that was presented to court

HHBP - asking ramos(?)
JB in Ramos a lineup of 5 knives, 5 shirts, had the dog if the scent on the murder weapon and the scent of this specific item

Ramos reversed the decision because they found this type of evidence different than the other type . . . .
 
Ooooooh....Baez found his word of the day calendar. Today's word must be "extrapolate". I don't think they recommend that you use your word of the day in every sentence, do they?
 
dog wasn't allowed to go where the body was found...they were searching for other bones that were missing....

A simple thanks was not enough. I am so glad you posted this because I don't remember hearing this and was so confused.
 
Watching the defense work their magic is like watching my children try to build a sky scrapper with tinker toys...they have such high hopes but they are attempting to do the impossible and eventually all their hard work crumbles to the ground.

That's not what he said. I believe he said the dog didn't alert at the remains site.


He was trying to prove that the dog handler took the dog only to one site and hadn't compared it with another site.
In so doing, he said, the dog handler took the dog to the site where they KNEW the remains were.
Heard it clear as a bell.
I was walking on my treadmill and about fell off when he said that.
Must relisten when we post tapes.
 
JB: Knows Ramos decision was reversed, but not terribly sure why. Goes to table to look. CJBP says, Just go ahead, I... and trails off.
 
I hate to say it, but I am kind of with the DT on this motion. The dog hit on the backyard where no body was found and did not hit on the area where the body was found. On one hand we argue the remains smelled strong to a human nose but a dog could not pick up the scent? Even after all the water, I still find this interesting.

I don't think the dog's hit on the backyard will have any bearing on the jury finding KC guilty. This was only relevant before little Caylee's body was found to prove she was deceased. We already know she is dead, so I don't get why the testimony of the dog is needed. MOO

IIRC, Forgey testified he was asked to take the dog to the remains site in an attempt to locate more remains. He was given specific areas to search, which did NOT include where remains had already been found. He said the dog attempted several times to get over to the sites remains had been found and alert, and he had to keep him on point.

Shockingly, Baez miss-stepped; the dogs were never taken where the body was found. No need, since the remains were factually there. They were looking for bones. IIRC, the dog tried to drag the handler to where the body was previously found, but the handler kept him on task.

The officer tried over and over to state it....he did state it (of course this is the one that jb doesn't want anyone to believe.....however, I do....:innocent:)

So JB finds any case with a similar term used in their arguments....thus it relates to this case and bolsters his argument. UNREAL
