I can't believe the DT will be this niaieve to the situation.

They must know that as soon as they use up their strikes the prosecution has carte blanche to start, effectively, making up the jury.

If they have any sense (and at least AF has selected DP juries before and CM should have also) then they will know to stop striking before they have used them all up and they have a reasonably favourable jury pool to themselves (at which point the SA may start using their strikes).

I suppose however, if this jury selection method hasn't been used before (i.e. JP seeking to swear the jury as soon as 12 have been found to force the parties hands to to use a PE) then they might not be wise to this. However, AF should have enough sense

Good points but I'm afraid they will just ask HHJP for more strikes and he will give them to them.

I just think alot of people feel like the one guy ,serial lillers ,sex sadists.. the worst of the worst arem the ones that should go up for death.

On a scale of public outrage Casey makes people mad,but her being in jail forever seems to hold most people over. Where as most people feel Joesph Duncan needs to die. And no amount of time in prison makes that feeling less intence. IMO.

Is it me or does this PJ sound like she is getting irritated by AF's questions? Just the way she is saying "yes".

  • #286
hey you guys... I just remembered something... this is what HHJP said would happen (he said it last week) that we would get so many and than replace them one by one as they are struck...

so expect to see more strikes imhoo...

((((they better get real though if they want enough alternates))))

I wouldn't wish sickness on anyone; however, this cold has given AF the ability to summarize "social history."

I have a hard time believing that she could put someone ICA's age to death...being that she has 2 sons her age. I just dont see it.

My own opinion is that KC won't get the DP,I do think it's going to be hard for people to sentence to death a young white female, just my opinion,I will be OK with LWOP.Just don't want to see her convicted of any lesser charges and be free someday. As I said before I think the DT is looking for a "Mary Winkler" jury. They are going to try to make them feel sorry for poor Casey, yes she did it but it wasn't really her fault.Don't think it will fly, praying not anyway.

the judge also said if they cannot get a jury here he'll just move back to Orlando to find jurors

That's my hope too. I'm hoping that she's a follower, and will follow the lead of her fellow jurors who. Hopefully one of the other women jurors will befriend her.

I hope so too. Although I'm afraid that since she indicated she has no friends that it was because her lack of friends was of her own choosing. Which might mean she won't be swayed by anyone.

I just keep telling myself that even if this jury hangs the State WILL retry Casey. It just might take 10 years to get her convicted.

If I understand correctly, the jury will provide a recommendation to CJBP as to penalty, but he can depart from that recommendation if he sees fit. So they could vote 7-5 for LWOP and he could impose death anyway.

I remember in the Scott Peterson case that the jury could recommend death and that the judge made the final decision BUT if the jury decided LWOP that the judge could not impose a death sentence.

Is it different in Florida?
