2011.05.18 Jury Selection Day Nine

I can't see how this is the fault of the defense. They never set a time limit on jury selection. His Honor did. How did he not see this coming? It is not required for the DT to submit to a prearranged time limit. They are allowed to do everything they have done. They are not the only ones taking so long to questions each juror. This has been an agonizingly slow process. How could it have been any other way?
Sorry, not pro DT, but this is on the judge, imo.

I tend to agree with you. In DP cases, it does take longer. ie, It took 6 weeks to seat a jury for the Peterson case. In the OJ trial (LWOP) it took 8 weeks.

To try to wrap this up in what - a week or so, seems dang near impossible.

And since we have yet to reach 12, let alone any alternates -- I say it's not going to happen.

Then again, maybe I'm just being grumpy ;)

I don't think of it so much of Baez getting his way but ICA & that's what makes me FURIOUS! Especially looking at her SMUG face right now! :banghead:

eta..it's just more of the same..her way, her way, her way! She better find out when this trial is OVER it's the end of that BS!

In 1 word - YES. That is unless they can get through the remaining 15 jurors (mind you 1 is very ill and has been out since last week). Baez can use all his strikes then elect to use a Batson challenge - which in short, would result in dismissing all the jurors and will result in a new (and delayed) trial.

Just gotta love the DT - NOT.

MOO

Mel

Baez only has 1 strike left.. The State has 4. The Baston Challenge is if Baez thinks the state is dismissing a minority. (which is why 1319). That wouldn't get rid of the whole jury.

I'm still hopeful this can be done by tomorrow.

shhhhhh don't tell.jpg

If they accept this juror, the Judge will bring in the other 11 and swear them in. However, the Defense might use their last strike, or perhaps the State using one of their strikes. It's just not over yet!

Defense still keeping Bolin out of the courtroom, guess "that" sort of media attention was too hot for them.

I hope the state decides to keep this PJ so we can move on...The PJ will understand all the circumstances and he will realize that Caylee deserves justice. Justice for Caylee! Justice for Caylee there, I said it...hope I don't get sued by CA/GA.

My guess is HHJP would not take them into Miami, maybe the panhandle?

Also, what an insult to infer that hispanics would be more tolerant of ICA's charges. My aunt and uncle married Cuban-Americans - the way their spouses and their families love on my little cousins is incredible!

This sure has been a lloooonnnggg 5 minutes.

IIRC, His Honor said before this ever started, way back when, that they would have a jury picked in a week, if not, they would be headed back to Orange County to do it.
What happened to that plan?

I agree. He needs to threaten to send it back to Orange County again. Let see how good of a jury Baez will find there. This is beyond ridiculous!

Dont forget we need 8 alternates. Might as well go through thebother 15 then let the dt strike 1 and the state strike 4. That would give us 21. 12 jurors and 9 alternates. Assume the defense and state gets 1 strike each for alternates. We would have the number. Plus DT can't use that as a appeal issue.

Post of the day!!!!! Great!!!!

Ok - just watched that FOX segment. Judge Napolitano - they were talking about the social media - not reporters. Talking about "ulterior motives" and jurors posting to facebook and other sites their opinions and that just can't be done.

Saying that possibly all high profile cases will now result in jurors be sequestered just to be safe that they aren't using the social media or leaking things they've heard or seen in the courtroom. Brought up the "book deal" guy. He said its not against the law to do that AFTER the trial BUT it shouldn't be your agenda to get on the jury.

Don't all juries have alternates chosen? I'm not too familiar with these things, so please excuse my ignorance! I'd have thought that would be exceptionally desirable given this particular case. :waitasec:

Not every case has alternates chosen but a case like this is a must. The length of time and due to the media attention etc... the amount of alternates is up to the judge.

I doubt they could get a jury anywhere in FL now - the publicity has increased by at least 100% since jury selection started.
:(

Did they forget about the PJ and leave him waiting in the hallway?

Can the Florida Supreme court come in and take this over if DT keeps stalling and spending more tax dollars???

My only hope is that since Your Honour has friends in high places, he can pull some strings to keep this courtroom for another week.

Pray, pray, pray!

Mel

Wasn't this a 5 minute recess? Seems a lot longer to me.

On IS, the lawyers agree that it is not the defense's problem that the court room may not be available and that is not a reason for the selection to speed up...

(I have to agree...)
