LA Atty asking for rule of sequestration for LA . . .Defense has not deposed LA . . State has deposed LA . .

HHBP did the defense opt not to take his depo? Did the defense question him @ time of SA depo? Purpose of rule of sequestration to prevent coloring of proposed witness testimony . . .Mr. Lippman said even though the DT said they didn't depose LA . . they had opportunity to do so during SA depo . . .

CM is up . . .purpose of rule ...color testimony . . . presumption that legislature knows what they are writing when they write legislation . . .not defined . . .not a case that allows Uncle of victim to be Next of Kin . . .at some point it has to stop . . .what if LA had married MP already . . would it extend to her as well? All 26 witnesses appeared inthis case so far including the tow truck driver . . .ask court not to extend LA rule of sequestration . . .CM feels CA & GA should have not been in the courtroom, called and recalled .. CM doesnt' care about their rights he cares about KC rights . ..

HHBP: LA depo was taken 7.30.2009 . ...Baez was there, Baez conducted cross-exam @ pg. 376 .....not that long....(HHBP reading the depo)....JB : has kc ever told you she killed Caylee/died accident/murdered ....answers No....LA was trying to find her during this period of time and his use of the computer re: chloroform searches...
what would be colored if he were in the courtroom?

Lipman: words "next of kin" who take property of the heirs...brother

HHBP...no evidence to suggest LA testimony would be colored ....LA will be excused from rule of sequestration.
also reviewed GA testimony to GJ...nothing indicate any thing different....
