Prosecutors at times chuckle to themselves during Baez questioning of witness. At one point Ashton shakes his head "no" during a question.

Ahh the witness just said he presented this to the state and defense in March of 2011..

Jose was told about this.

"So your objection is not a 403 it is a 6th amendment right to . . . " - HHJP

Nice, judge helping JB figure out what exactly he is objecting for.

Good gracious....here we go with the bumbling, grumbling pathetic objections of Jose Baez. Can't he even "act" like he learned something about cross-examination while he was in law school??!! I will need 3 Advils shortly.

I really hope that he will NEVER take on another case of this magnitude again in his career.

He should stick to getting drug dealers and users reduced sentences cause we know he has a bunch still in jail "refering" new inmates to his practice.

That's not even his argument. He said he didn't have the chance to use his own expert (did he not know he needed a hair expert because the photos were black and white?). In other words, he wasn't prepared.

Maybe but that is not how I took what he just said.

How can one have had photos looked at by an expert when he never got photo until this morning.

This seems unfair to the SA. JB objects for little or no reason, then HHJP helps him figure out why he is objecting?? If JB doesn't have a specific argument for his objection why is he making one?

She's been held in jail for three years and is the Defendant in a capital murder case. Being in this position, she's considered a potential danger to herself and others. I've never seen any other Defendant have such freedom to handle computer cords, swap chairs, linger after Court is dismissed to socialize, etc., and I've watched many a trial. Can you imagine Jeffrey Dahmer or Charles Manson being given such leeway? And with that, I'm off my soapbox. It's all just my own opinion anyway. :)

Has any lawyer commented on here about what is allowed and not allowed as far as what she can do at the defense table?

JB: Did you expose the children's hairs to the same conditions that you exposed the ones that showed apparent decomposition?
SS: Yes.
JB: Including water?
SS: Um, I'll have to check and see... (checks report)
JB: Please do.
SS: No. The children were used in the, one child was used in the first 4 locations. My last 4 location studies that I did, that was all adults. Immersed in water, buried in potting soil, one of the studies in a wooded area and one of the studies on a lawn in a grassy area.
JB: And none of these subjects, all 15 of them, their hairs were never exposed to any type of trash or garbage?
SS: No. Not that I'm aware of.
JB: No further questions.

From my point of view, the state has already driven that fact home to the jury.

At least, I don't have a doubt after seeing all the evidence presented so far. Maybe the jury needs to be beat over the head with this hair evidence...I dunno.

IMHO, it is a prudent prosecution team that presents, demonstrates and explains evidence at much as possible. Like "explain this to me like I'm a first grader" thing. They must assume that at least some jury members will need repetition and basic education/information. :twocents:

it is ten am! I cannot believe how much time has been spent on this.. and all over sharing evidence...

holy night!

JMO, of course, but there has to be NO SYMPATHY at this point for the defense team not being prepared. They've had these photos since March? In color? SIT DOWN, MR. BAEZ.

OMG...let's get this show on the road people! Geez!

Maybe but that is not how I took what he just said.

How can one have had photos looked at by and expert when he never got photo until this morning.

Apparently Ms Sims went in person to view the pics at least a month ago, so I can't see how they didn't see them until this morning.

Maybe it's an fbi snafu.
