I don't see why Gray would think the families would be told a (secret) GJ was being convened. Don't really have a strong opinion about whether the DA should be interviewing families...I'm sure LE did that early on for fact-gathering. They likely won't be witnesses at the criminal trial... Could be witnesses when the DP was applied, not that I think it ever will be (for a variety of reasons.) Hmm.

Not to mention both Gray and his client have given media interviews even after the gag order (most recently S. Goncalves two weeks ago). I'm really confused about why Gray is confused. He doesn't seem confused to me. I'm starting to agree with those who said many threads ago he's just trying to make a name for himself and he's using a grieving family to do so.

According to live tweets (link posted immediately above) - Gray appears to be Grandstanding. The judge made a lovely apology regarding getting the victims' names wrong at the arraignment. Good judge is Judge John Judge. Moo

And, look I don't have to be right here, but if we can't find a way to work together the family, the system, attorneys, etc. The focus gets shifted completely and the murderer could walk away. Honestly they need a sit down immediately all parties involved no cameras not in court, make nice.

That's what I was worrying over before.Imo Mr Gray is a liability. It's extremely worrisome to me.Moo

At the Latah County Courthouse ahead of two pivotal hearings: One will focus on loosening the gag order that’s limited information regarding the Moscow murders. The other will determine whether TV cameras will be allowed in the courtroom.

Everyone is seated in the courtroom. Kohberger has arrived, dressed in a suit - a starkly different look from his orange jumpsuit during his previous appearance. We are underway.

"The loss to your children is devestating and horrific. There's no dispute about that," said Judge Michael Judge ahead of the arguments. He's now apologizing for mispronounciating some of the victims' names during the previous hearing.

Shannon Gray, the attorney representing the Goncalves family, is now presenting his arguments.

Gray is arguing that the amended non-dissemination order is overreaching, as it limits the attorneys for any interested party, as well as the attorneys representing victims families.

Judge said that his understanding is that the victim's family has never been restricted in any way. That they have been allowed to say whatever they want.

"You've been on the media, you've had interviews. How do you feel you've been restrained in any way with this order?" asked Judge

Gray says he has never seen a poorer line of communication in 22 years than that of the prosecution and the Goncalves family.

"Would you feel more comfortable if there was a more concrete description of what people can say and what they can't say?" "I don't think you have the authority for that, you honor," said Gray. "I absolutely have the authority to do that.”

Gray's argument is mostly centered around how he and the victims' families are not parties to the case, and therefore should have the right to speak freely about this case. He's also criticized the prosecution for not sharing any of the facts of this case with the family.

Kohberger remains expressionless as the back and forth exchange continues.

Gray has stepped down. Bill Thompson is up.

Mr. Gray has made representations to the court that are, at best, misleading." said prosecutor Bill Thompson in his opening line.

"For him to say we have provided no information is simply not true." Thompson claims that police have tried mulitple times to interview the family, but Gray has not permitted it.

The State contends that the gag order is an appropriate measure and preserves the right to a fair and impartial trial. They are asking to keep this non-dissemination order in place.

Kohberger's defense team is now up.

"Given the vast amount of media coverage in this case, no matter what anyone says or does, it will be twisted into an attack on my client.”

Gray is now back up at the stand, responding to the prosecution.

"Nothing precluded the prosecution from contacting my clients well before I started representing them.”

Gray says he has asked the prosecution if they'd like to interview the family on multiple occasions and they never heard back.

The Judge will not issue a decision today. He will issue a written decision at a later time. In the meantime, the non-dissemination order remains in place. Court is adjourned.

Here at the Latah County Courthouse waiting for the Goncalves family att. Shanon Gray to begin his arguments to amend / clarify the gag order in the #BryanKohberger case. Remember, we have another hearing later today about the gag order at 1:30pm (pacific time)

OK, interesting. #BryanKohberger is not wearing his usual jail-issued orange jumpsuit in court today. He is in a suit jacket, dress pants and what looks to be a blue tie.
Judge Judge just apologized for stumbling over Kaylee and Xana's name at the arraignment. "I was up all night, really ill. Probably food poisoning… Also some emotion and nerves as I read those names. I'm sorry.”

Judge says to the families, "The loss of your children is devastating and horrific." Goncalves' family attorney said he appreciates Judge's apology.
Judge also says that he saw no explanation of what standing silent during a plea means in the media. "That is Mr. Kohberger's right," Judge said. “That is not unusual, but reading the media it seemed somewhat mysterious.”

Gray is up arguing the gag order. Gray says he disagreed with everything the magistrate judge said about the gag order the first time. “I took that as I should tell my clients to be quiet.”

Gray says the Goncalves family had no idea a grand jury was even being convened (they figured it out) and that the family has never been interviewed by the prosecution.
“I have not seen a poorer line of communication in my 22 years than with the prosecution and the Goncalves family," Gray said. Judge:This is potentially a death penalty case. There hasn't been notice but that is potential.The families would certainly be witnesses in that process

Ok, this is getting tense. Gray said he doesn't think the judge has the authority for certain things Gray should be able to say. "I do have the authority," Judge said. "In fact I KNOW I have the authority.”

Gray says he just can't see the families being potential witnesses in the case if they're not even being spoken to by the prosecution.

"They're throwing stuff in the air that is not even justified... Not enough to regulate my free speech," Gray said. "I understand your position," Judge said. "Good." Gray replies. He sits down.

Latah Co Prosecutor Bill Thompson: “Mr. Gray has made representation that are simply misleading… The media is here.. I don't want the public to come away with the impression that impropriety has occurred… We have answered the questions we can."
Thompson said that from the very beginning investigators have attempted to interview the Goncalves family, "And Mr. Gray has not permitted it.”

Prosecution contends the family would likely be witnesses in any sentencing, especially a death penalty sentencing. Which gives me kind of an indication that they may file, but who knows.

P: “The alternative.. Sequestering the jury or changing venue aren't going to mitigate the impact of statements made in the case." “Gray's statements that he isn't bound… illustrate why the order is necessary in this matter…. We would ask the court uphold the amended order”

Lots coming out of this hearing. The defense said the reason people stand silent, aka #BryanKohberger, is because they can avoid any possible claims the defense can't challenge anything with the grand jury indictment.

Anyways, the defense said the safest thing to do is for everyone to not speak to media. "We don’t (inaudible) someone that's trying to whip the media into a frenzy and send this case to the firing squad or whatever,” the defense said.

#NOW: Judge will not issue a decision on the motion today. He will issue a written decision at a later date. He will try to get his decision out as soon as possible. Order still remains in place. We adjourn. Will be back at 1:30.

@hancock_sheriff and @IndStatePolice were unrelated to any @FBI surveillance. And the two state police dept's weren't aware of BOLOs for white Elantras.

Now: the attorney for the Goncalves family, Shanon Gray, is arguing his motion to amend or clarify the gag order the magistrate judge put in place in January.. NOTE: there appears to be no family in the courtroom. Steve Goncalves told me his family would watch remotely today…

“The prosecution has never interviewed the goncalves family..How in the world could they be witnesses in this case” Gray raises his voice in response to the judge saying that attorneys representing witneses can be limited to some degree with a gag order..

Judge- How do you feel you’ve been restrained in this order? Gray- I think you’re not seeing the issue. The gag order is overly broad…

Gray:I’m absolutely blown away the prosecution doesn’t agree with me..I have not seen a poorer line of communication in my 22 yrs of practicing. I think it stems from us being initially critical of the investigation. From that point on ..we are the enemy. That’s how we feel.

Prosecutor Bill Thompson's body language reflects the unhappiness in these statements...slightly nods his head in disagreement..

Prosecutor Bill Thompson rises and sternly states that Mr. Gray has made misrepresentations…I need to correct for the media..

Investigators have attempted to interview his clients and Mr. Gray has not permitted it... Gray - sitting behind me in court right now - whispers "that's not true”.

Prosecution continues argument to support the gag order saying that the Goncalves family are potential witnesses for trial more specifically at sentencing. The order is not overly vague.

Prosecution: The total prohibition of extrajudicial statements is the best way to ensure a fair and impartial case…

Defense: It seems like no matter what someone says or does, it’ll be twisted as an attack on my client, the safest thing is to not have ppl talk to media..Don’t want someone to send media into a frenzy and send this case to a firing squad.

JUDGE: will not decide today...he will review the briefings...and try to get decision out asap…

Five years later. Even if he's guilty, it doesn't mean that 5 years earlier, he was prowling for other victims.

Agreed. It just as likely could’ve been part of a class assignment or for extra credit points. Or maybe he just likes reading?
