Judge proposes that he can fix the order if it is indeed overly broad order by clarifying "Who this order touches, what people can say/can’t say..."

Judge is going to grant the defense request to take judicial notice of the media coverage of the case and take testimony today on the issue of the gag order, saying the media attorney would have the opportunity to come back if need to for reconsideration

Looking forward to joining @EVargasTV this evening at 6pm EST to discuss the hearings concerning the #Idaho4 case. I expect the Gag order to be upheld through trial, although the judge may take his time to rule. I also expect him to allow streaming at trial, but on a delayed release like he did for the other hearings he has had. We shall see...



#bryankohberger's Media Expert will testify on BK's behalf. Expert witnesses typically cost between $250 and $750/Hour. A 58 page report can cost up to and exceed $50,000. The expert must research, write, support, and pour through social media and main stream media reports to back their position. It's a lot of money to fight merely a Gag order. Recall too, The Defense hired a crime scene Expert on day 1. I believe this Judge would have supported the Gag order based on the same arguments that convinced the Magistrate. Interesting the Pros isn't calling an expert...there is a reason.


I find it interesting that BK's Defense was afforded an up to $50K media expert to help fight the gag order when the State agreed on the gag order remaining in place in their Motion's Response.

Judge Judge said that LOCAL reporters are doing a good job explaining the process and being balanced and fair regardless of the gag order. “It would be nice to see more of that rather than the sensationalizing we are seeing in national media."

Judge was talking about sequestering a jury, and couldn't pronounce it. Olson had to correct him. Anyways, he said a change of venue and sequestration would be very expensive. "This is why I don't like the term gag order." he said. "No one is gagging about it."

Wendy Olson says the Idaho and Washington reporters that are part of the coalition have an outstanding rep: “They want their reporters to obtain accurate information," she said. They want the information to be truthful

Judge Judge asks: "let's say I lifted this order right now, what would that allow the press to do that they can't do already?"

Judge Judge admits that he hasn't been following media coverage extremely closely, hopes to see more coverage on the process of the trial and less sensationalizing. Credits local outlets for fair and balanced coverage of the legal proceedings.

Judge: What are you after that media doesn’t already have? Media Attny: it would allow a party 2respond to a question like defense did 2day when explain' why #Kohberger stood silent @ plea…& better info avail to reporters..plus nothing stops attnys from not answering a question

Judge would like to see more balanced, complete analysis on the coverage of a case like this - including why some processes are the way that they are, as opposed to more sensationalist pieces he's seen nationally. He gave local journalists praise for balanced reporting.

While I agree on the gag order somewhat (maybe a modified version?),I do think there should be coverage allowed during the trial.

We need transparency and accuracy desperately, this 'trial by tweet' from the media is what has gotten the misinformation and rumors spreading in the first place.

Her company provides data to corporations and organizations, non-profits and for-profits, to show what is being written and communicated about them and the projects they are working on. Those companies then use that data to show return-on-investment and craft new messages.

But we don't really know what the report cost do we? I find many of Coffindaffer's pronouncements iffy and that's where the $50K claim comes from. She could be right but she's been wrong when commenting on lots of aspects of other cases.

I wonder too if the data from that report might be used to argue for other things like a change of venue?
