It’s the fact that the general public can’t see it and getting filtered information from limited media without transcripts- and that then gets filtered through all the YT and podcasts …

It feels like a bad game of “telephone” at times when a typo or mistake hearing something results in speculation and rabbit holes… (man? Or van? For example)

No streaming, no transcripts and just a few reporters taking notes is more veiled than transparent than I’m used to seeing- moo
The door is open. Journalists have access - they are the public's eyes and ears. There are seats (though woefully limited) to the public as well. This is what open precedures entail.

I totally agree that the trial should be broadcast, but just because it isn't or that the gallery is small does not mean it is not transparent.

Oh evidence is kept from the public all the time- for good reasons- and I have no idea if everything in those videos falls into that category or not- perhaps it does and should be for the reasons you stated above- it just triggered my overall frustration with the case-

They let the media see violent autopsy pictures of the girls and that bugged me too - I’d prefer those hadn’t been shown to the media for their dignity- moo
Very good point. Tough decisions either way in both cases.

We don’t know if he threw away his phone.
We don’t know if the BG image was the person that uttered down the hill.

if only the defence had a witness who could clarify where his phone went ...

Interesting. If I understand this correctly this could be grounds for an appeal.

My question is even if judge Gull allowed the Odinist theory which seems like nonsense to me couldn't that be ineffective counsel and also grounds for appeal?

If so then no matter what there is grounds for appeal.

I have to be missing something because just by the 6th defense could guarantee an appeal in all trials if so inclined. But that is an ethics question.

i have often thought possibly an ineffective counsel appeal to be their core strategy.

I wonder why the D would choose to play these disturbing videos to the jury on the 1/2 day Saturday session, leaving them with lingering memories on their few precious hours of time off? Or they had nobody else available to take the stand after JG denied that third party motion?

I’m feeling great empathy for the jurors. I don’t think they realized what they were signing up for. JMO
Likely just following their timetable order to present their case in chief and luck of the draw that today is Saturday. They wanted to show the videos yesterday, but could not.

How would we know? The judge didn’t allow the hearing to be recorded or streamed. And Judge Gull’s order was so vague and without any reference to law, it gives no meaningful information. That’s the problem with a complete lack of transparency. From media reports, it sounds like they did bring evidence of 3rd party suspects, and some psych testimony, and a cult expert but it’s impossible to glean exactly what evidence was presented.

Someone said they read a transcript of the 3-day hearing. Does anyone know where that can be found?

I think they were going to use it to explain the sticks and the blood for Libby at the scene but I personally think they don’t need it. The psychosis is enough to defend against the confessions plus the testimony of people at the scene, lack of bullet testing results, and DNa will be enough. The lost testimony and general LE issues are evident. But we aren’t done yet for me to try and predict how a jury would respond.
Psychosis was diagnosed b a psychiatrist? I thought they did not have him evaluated.
Acting nutty is a time worn strategy to evade responsibility.

They wanted to do it yesterday and the judge wanted the videos edited before they were shown is what I took away.

Psychosis doesn't cause someone to be aware of a detail only the killer would know.
….and keep the ability to confess to murders in chronological order I might add.

I misunderstood. One bullet with zero in the magazine.

I’m sure he would have more than one total round in the gun. One in the chamber and some further number, probably 9, in the mag. The standard Sig 226 magazine holds 10, but since he likes the “one in the chamber” mode of carry he racks the slide before he ever heads out the door.

He might also drop the magazine out, add another round to top it off, and reinsert it. Now he has a total of 11, a full magazine and one in the chamber.

There are also 12, 13, and 15 round magazines available.

Yes covered by both prosecution and one of the defense witnesses yesterday who were psychiatrists. The dx of psychosis is what triggered the use of the Haldol from what I took away. I think perhaps we will learn more today as I believe the videos were to show his mental deterioration while in the prison system.

At the beginning of the trial JG announced media was allowed to review the exhibits for 15 minutes at the end of each day.

I wonder if that includes glimpses of these videos?

I thought that too, but if he was wearing the gloves to begin with, I'd think that he would have had to take at least one off, to get his finger around the trigger of his gun, so that may have been a little awkward or "fussy". I also wondered if he just had gloves in his jacket pocket. I know that I've left my gloves in jacket pockets just so that they're there next time I wore the jacket.
I suspect that he was more likely wearing latex gloves, but even if not, as an Army veteran (RA was National Guard), I can attest to the actual fact that we are quite capable of and able to fire weapons with gloves on. Wars don't just happen in temperate climates or favourable seasonal conditions.

IMO.
