Three calls made when Erin was left alone by police​

Dr Rogers then asks Erin further questions about Phone B, which she handed to police on August 5.
The jury previously heard a SIM card ending in 835 was in Phone B.
Erin told the jury last week she not only wanted to switch from Phone A to Phone B because of the issues with the screen, but she also wanted to change her phone number after Simon accused her of poisoning his parents.
She says the SIM card ending in 783 was her “usual” phone number, until she set up Phone B with the SIM card ending in 835.
But Dr Rogers puts to Erin that she only made three calls on Phone B after August 2, which were all made when she was given privacy to call a lawyer.
Dr Rogers accuses Erin of handing Phone B to police because she knew there was no data on the device.
“I did it because they asked for my phone and I gave it to them,” she replies.

Also makes no sense to change phone numbers from Simon if he'll need to either pick up the kids from school once she's detained in the hospital or by police.

Erin becomes emotional as defence continues questioning​

Throughout several days of cross-examination, Ms Patterson's voice has remained level as she has given evidence.

A notable exception was when she recalled the kindness she had been shown from Heather Wilkinson over the years and how that had inspired her to invite her to the beef Wellington lunch.

Now, as she's asked about the need for her to pack her daughter's bag for a ballet rehearsal on the Monday after the lunch, Ms Patterson's voice cracks.

The prosecution has asserted this was never in fact required, but Ms Patterson reaffirms under re-examination that it was.

Mr Mandy then asks Ms Patterson about the sixth beef Wellington, which the prosecution has alleged was prepared by Ms Patterson in the hope that Simon would attend the lunch and she could poison him as well.

Ms Patterson tells the court there was a simpler reason for preparing the six Wellingtons, which was the number of individual eye fillets she had.
That makes no sense either- if you're making a 6th individual BW in case Simon shows up- why toss it out when it's expensive, when you are saving the other leftover portions- unless it's because you know it's poisoned and want to keep that from police/kids.
 
Has it ever been stated that manslaughter would be allowed as a lesser charge? I have seen it speculated upon here, but not sure there's been a definitive answer.
If so, at what point in the trial would that be offered to the jury? By the judge, I would presume?
The alternative, of guilty or not guilty (of three counts of murder and one count of attempted murder), is very absolute (i.e., yes or no, imprisoned or free), and would possibly leave criminal negligence fall through the cracks.

The court heard Patterson cancelled the appointment on 11 September 2023.

Rogers read a statement from the clinic yesterday that said the clinic has never offered gastric bypass surgery. Patterson agreed with this.

Earlier during cross-examination, Patterson said she was “puzzled” when told the clinic did not offer gastric bypass. She said she was also looking into liposuction.

So just because at one time they offered liposuction, that means little to nothing.

She was telling a huge lie to her in-laws and to Simon about her phoney cancer treatments, and then lied more in order to get some compassion and understanding, by claiming she had a bariatric surgery scheduled.

And when that was debunked she quickly changed her story again and claimed she meant liposuction.

And then we found out they don't do that in that clinic so she was lying about thAt too.

So just because they did do lipo's at one time it doesn't mean she was being truthful.

It was all still a big ugly lie by her to gain attention and sympathy and hide her true self.

Yup! And even I as a layperson understand that gastric bypass surgery is nothing like liposuction. Completely different procedures. The only thing in common is weight-loss.

I personally believe that they did offer it at the time of her appointment, but the whole story around cancer/bypasses/lipo is a whole bunch of BS.

Right, but she said she had an appointment for bariatric surgery all set up.

In reality, she never did anything but call and ask for a visit---but then called and cancelled. So all the BS about needing childcare while she received treatments for ovarian cancer still stand. :mad:

Exactlyyyyyy....the defence going through this again just emphasised her deception, if anything. She just admitted she had an appointment to determine what she might need, almost sounds like a very preliminary discussion.....nothing even close to a fully-fledged surgery or liposuction.
