GUILTY Australia - Terence Darrell Kelly, charged w/ abduction of 4 y.o., WA, 16 Oct 2021 #2

so Tk isn't coming up on any of the usual legal websites...as in I can't find sentencing remarks or any sign of him going through court.
I thought he had either been to jail or at least been before a court.
The only time this happens usually is with unreported judgments, where there has been a family law or child abuse case.
I'm really not insinuating anything , its just weird that theres nothing .

I know very little about the legal side, is it possible that they might hide any of this info as they don’t want you seeing it before the trial? They’ve hidden a heap of SM and not just FB.

Yes, it's possible.

But I would have expected local news reports about it, perhaps in the local newspaper archives. Is there a local paper for Carnavon?

MSM won't be repeating it, because of sub judice rules (he is being tried for this crime, and previous record is normally inadmissible) and so of course it shouldn't be posted here either

@Trmtrm2 said: its hard to imagine why a woman would want to be involved in the grooming of a missing child,

@Officer Dibble replied: Women do abduct/steal children and babies. JMO

I quoted a post, which quoted a post. I pointed out that Women can in fact be involved in events that I mentioned. Look it up!

If there was a Woman involved, how do you know that they weren't romantically involved? Blood also runs thicker than water, so who is to say it wasn't a close relative? Again, If there was a Woman involved.

If you read my first paragraph, I said I wasn't suggesting it was the case, but, in a highly unusual case, nothing would surprise me.

Where did you obtain your 0.001% stat from? Link please.

What are the probabilities of a child being abducted from a tent in the middle of the night with her Parents close by, particularly in Australia? Fairly low I would imagine. Lower than 0.001%? IDK, you may be able to find those stats too.

What are the probabilities of this abducted child being found alive 18 days later? You have an abducted child, from a tent with Parents nearby, then found alive 18 days later!

Are the probabilities of that happening less or greater than 0.001%. Again, IDK, I dont have the stats, nor am I prepared to pick a number.

I do know that this whole case is highly unusual.

Just to finish off, this case is full of the rarest of rare possibilities. More than a few people thought that with the initial disappearance of C, that "the most probable and simple solution" is that the Parents were involved. That wild speculation was not true either!

<modsnip>

These are the probabilities listed in order for the abduction.

1. The parents.
2. A close relative or close friend of the family.
3. Somebody who was stalking the child
4. A crime of opportunity (sexual motive).
5. A crime of opportunity (non-sexual motive).

It was very clear very early that #1 and #2 were not possible. The parents were very honest and the police would have known whether a close family member or known friend was involved.

We still don't know whether it was #3, #4, or #5 (or all three).

If there was a romantic interest in TK's life, she would have been the first port of call after TK. For this reason, I don't believe there is one.

Abductors and murderers hardly ever have an accomplice unless it's organised crime for a financial motive (this includes sexual trafficking). There so far has been no evidence of a financial motive so I would find it highly unlikely that there was somebody else involved.

It's not weird. Many cases are not published.

She was also awake when with her family, at 1.30am asking for water on the morning of her abduction. It's possible that at the time of her rescue, she was awakened by the police battering and busting their way into the house - and then into the room where she was locked.

LE stated she was in a lit room, playing with toys. IMO she showed remarkable composure in that situation, not a cry heard on the LE audio and she stated her name quite confidently when asked. She’s either one tough cookie or had become somewhat detached during her ordeal. Maybe both.

Initially neighbors only referred to TK as the person who "stays" at the house and for about 6 months/not long . So is it someone else he knows or kin who has been allocated the house and he stays there . The person maybe comes and goes/travels /in other places for what ever reason.

The next door neighbour who said TK helped him by looking after his house when he was away stated he’d been there for 2 years. I don’t have a link to substantiate that but it was discussed in previous threads. Is it possible he’s been out of custody for 6 months?

Not sure about WA but in Victoria it's looking like you can keep your housing commission home when in jail if you pay $15 a week

I know nothing about Housing in WA, but that would make sense as the costs associated with re-housing someone following a brief custodial sentence would surely be much greater than charging a small fee to keep the tenancy going IMO.

I’ve read so much that says PW passed away in 2020 & I wonder if this is her reference from the Gov Gazette: https://www.legislation.wa.gov.au/l...2020_179.pdf/$FILE/Gg2020_179.pdf?OpenElement

Walker, Penelope Ann, late of Unit 3, 10 Crossland Street, South Carnarvon, who died on 24 May 2020 (DE33110939 EM110)

In an interview with photographer Nik Duncan ( I think in 2019) he states she lived next to the Pioneer Cemetery : Penelope shares her story — Nic Duncan

Google Maps.

so TK - has been without her for less than 18 mths. And doesn’t live in that same house.

all MOO ...

That Crossland Street address is within 500m of where CS lives. Perhaps he's been watching her for a while...

Given the BBC article that states LE is continuing to investigate, combined with the Daily Mail citing unnamed sources that a woman brushed her hair, members are allowed to speculate based on what is in MSM.

Admin Note: The DM article is "Exclusive" and as they are known to pay for information, they sometimes have new information that may end up being factual. It's up to individual members how much weight they wish to place on the information, and only time will tell if the speculation is warranted.

In New South Wales, Prisoners Aid is able to store a small amount of your belongings if you are going to prison.

> How to look after your furniture and household goods
If you’re going to be away for a long time and have nowhere to store your belongings, it might be better to sell your furniture. Otherwise, think about where you are going to store it – and if it is going to be safe there.

Make a list of what you own and who is storing it. Prisoners Aid NSW can store a small amount of goods for prisoners; they can be contacted to discuss this on 0412 430 214 or at [email protected].

The rules regarding Government Housing in New South Wales:-

> What will you do about your house?
  • Department of Housing – To avoid debt or losing your house, tell the Department of Housing what is happening and ask what options you have – 24-hr/7-day phone 1800 422 322.
You may be able to pay reduced rent for a short time, or be priority listed when you are released from prison.

If you don’t manage to do this before you go into custody, contact the Prisoners Legal Service from the prison phone (free call from the CADL list which should be on the wall next to the phone) and ask them to help you.

  • Community housing – If you are going into prison, you can apply to retain the tenancy for up to six months. However, if Communities and Justice (the new name for Family and Community Services) is reasonably satisfied that the imprisonment will be in excess of six months, they can ask you to relinquish the tenancy immediately. Communities and Justice will consider each case on its merits.

However, if the reason for imprisonment is related to a breach of the tenancy agreement, Communities and Justice will take action to terminate the tenancy. If you have not been released from prison at the end of six months, they will consider an application for recognition as a tenant from a remaining household member, or terminate the tenancy.

This time Det-Sen Sgt Blaine suited up in forensic gear and entered the accused kidnapper’s home for the first time since he and his colleagues forced entry into the home to bundle CS to safety.

He and another detective put on blue protective suits, which covered their heads, and were also wearing masks and booties as they were escorted inside by forensic officers.
After emerging about 25 minutes later, Det-Sen Sgt Blaine said he could not comment when asked about the reason for the visit.

At the same time, forensic officers were examining a silver Mazda SUV in the driveway. The car, which does not have number plates and is covered in cobwebs, now has stickers marking evidence on its doors.

Officers were photographing and testing the interior of the car, which was believed to have been inherited from his grandmother, has remained in the driveway since his arrest. It is understood Mr Kelly was in another car when he was arrested nearby last week.

It is understood a forensic chemical has been sprayed inside the house, with a forensic officer emerging wearing a gas mask at one point on Tuesday.

A forensic tent that had been on the driveway over the past few days was packed away but it is believed forensics will return.

How the investigation is ramping up

One of the reasons could be that the sentence was a mandatory one. For example. Drunk driving over a certain limit of alcohol ingestion, right there on the roadside you lose your licence, ...... or.. driving without a licence, and being caught at it more than once, and it's a mandatory prison sentence, sometimes 3 months, sometimes 6 months, depends on factors unrelated to this matter.

These sentences do not go into Case Law, because they already are case law and are not a matter of negotiation or parley. ... and are not subject to appeal or mitigation or ongoing dispute , or hearing or defending. They are what they are. You go before the magistrate, with your overnight bag packed and ready.

So that may explain why 'no record' exists. It exists, alright, but it is not subjected to a personal record, in the sense that other matters are. It can be used, ( and almost always is ) in the area of previous form , though, if it becomes related to a current crime, or as a matter of capability of compliancy with ordinary laws. Then it becomes a bit of an issue, especially if a pattern of this aspect of social provocation is shown.

Maybe, but that wouldn't account for the presence of a female (if indeed those reports are accurate) as the video released of her discovery shows it was by a team of male police officer, who were described in MSM as all being fathers themselves
By 'rescue situation' I don't just mean the breaking in and up to 'My name is C'. She might have been talking about a female nurse at the hospital. Or there could be a gap in which she was checked over and tidied up before the scene where she was carried out of the house in the face of the media. In the gap, other officers and paramedicals coming and going.

  • #393
True, and I certainly don't think CS would mix up where she saw the female, during her captivity, or while being rescued!
I don't see why not. When you try to explain a traumatic event some things are very clear and then some things--like the order in which things happened--you realize yourself don't make sense. However, perhaps she didn't mix it up, they wouldn't have been grilling her, she just mentioned it as part of what she remembered, and somebody decided to make a story of it as if it definitely pertained to her captivity.

The house CS family lived/lives in, was purchased by them in April 2021 (7 months ago).

There are conflicting reports in the direct main stream media about how long the accused has lived in the duplex where CS was found. Whether he sometimes stayed overnight in other locations and/or how much time (if any, and when) he might have spent in jail for other offences is still unknown.

So the accused may or may not have been living within 500m, of where CS family lived, at the same time that they both lived within 500m of each other.

Not suggesting that it happened in this case, the way things have panned out from the start though, it's a highly unusual case, so nothing would surprise me now.

So, it's not just your opinion, but a fact. Women have murdered pregnant Mothers to be, so they could then remove the baby from the womb to pass off as their own.

Women have assisted in abducting others so that their sadistic partner can have their way with them.

Although history shows that it is mostly men who commit terrible crimes against children and Females in general, Women have also been known to commit or be a participant in heinous crimes.

Yes its fact but just covering my backside with JMO.

I still wonder if the unidentified women at the TAB and brushing hair could infact be a man who is a cross dresser, I mean a man who is a very good cross dresser, when dressed as a man looks like a man but when dressed as a woman looks completely different looks and sounds like a woman, i don't mean dressed in drag i mean dressed as the girl next door very regular looking, maby that's why the women is unidentifiable, as all her identification would be in a man's name, also a small town of 4000-5000 sounding like everyone knows each other this may be a person he has met online maby even from Perth who would share interests with TK, the fact he was at the TAB with unidentifiable women and CS clames a woman brushed her hair I think its very likely there was another who came into this and may even be the instigator as TK hasn't done anything of this level that we know of and going to the TAB was probably the mistake that will lead to the other person (they must of been feeling confident at that point) as I feel TK may protect the other persons identity if this person is now his special friend and has a connection with similar interests hopefully the TAB will be their undoing

How many towns are there in a 75 kn radius to the blow homes camping spot? The odds he came from such close proximity to C’s home can’t be coincidence. I guess one reason could be he was stalking/following her/the family. I can think of other reasons also.
I’m not convinced he did all this alone.
MOO

Well, I guess I see toddlers as a bit smarter than some others do lol. It is just my opinion :) Also, there were no females as part of the rescue group and CS seemed pretty 'with it' as they left. At this point, it isn't a surety that CS even said there was a female who came to the home anyways.

JMO...maybe TK had a child (maybe estranged?), and that's how he got a 2 bed residence? MOO.
I grew up in housing commission. It is very unlikely he would be moved from his residence unless the house is condemned. We had a 3 bedroom house with 2 mum dad and 2 kids. When we grew up and parents separated, dad stayed in the 3 bed alone for at least 8 years before termites forced him out and the house was liquidated.
