I can't imagine CV leaving JJ alone sitting in the front seat of a RUNNING CAR. We all know what a handful little JJ was. That whole LVD story does not ring true. So what really happened? The State needs to call attention to what is a preposterous story. JMOO

I am confused by the timeline.
Lori claims she, Tylee, and JJ were there when Charles and Alex's confrontation started. Tylee brought out the baseball bat.
Lori claims she told Tylee to take JJ out to the car. Lori followed. She and Tylee were barefoot. While outside, Lori heard a gunshot.
Lori had Charles' phone, and therefore, the state can show where the phone traveled, meaning they can prove where and when Lori traveled with the phone the morning of the murder.
Detective Werner took the stand.
Werther says the device “clearly departed the scene well before the 911 call.” Either the shooting happened much later than we were told, or the device and the person bearing it, Ms. Vallow, left well before the 911 call was made" he says.
Hasn't it already been determined that Alex waited 47 minutes after he shot Charles to call 911? Is the state trying to prove Lori was not there at all when the gunshot went off?
OR is this just the state's way of proving to the jury that Alex waited a long time to call 911
Any help you can provide will be greatly appreciated.

Today's witness covered it. Iirc CV's phone and two of LVD's phones were basically in the same place, possibly the hotel where CV had been staying.

Interesting @Megnut … that gets me wondering….. if so, is it possible that LVD had gone by the hotel where CV had stayed? Did she know where that was? Was she trying to keep ‘tabs’ on his whereabouts….. and his timeline for AC? And I will acknowledge, I’ve not followed the latest closely….. and don’t know this case that well of late. MOO

LVD took CV's phone from him in the house then took it on her breakfast etc trek then back to the house where CY asked her for it and TR took it from the cup holder in CV's rented car and both LVD & TR gave CY the password.
So around noon either LVD or LE read Adam's 8am something messages to CV that he never answered.
I'm curious if LVD still had CV's phone at noon and was able to read his texts.
 
Lori has no problems getting slammed by the judge. She is getting testimony in and the jurors have heard it and you can’t unring the bell. The judge should have told them to disregard it but he didn’t. Also, what’s he gonna do, sanction her? Fine her? Lock her up? She has three life sentences in Idaho. This trial is a joke. I pray Brandon’s trial is much smother with real testimony. This one is so convoluted. The only way it came together was from some of the posts here at Websleuths (notably Megnut and Wnk)

Brandon has been a main concern for me all these years. He has apparently "forgiven" Melani P, but I have always felt she got away with M. So, I do hope Brandon's case goes smoothly. But I am sooooooooooooo hoping that she really slips up on it. moo

This may be the case of scheduling. State calling witnesses out of turn.

Or better said, the State has to show two things -- what they believed at the time and what they came to learn, moving LVD from victim/witness to conspirator to murder.

So far the State has been walking through what LVD said happened that day and today started turning into their investigation of her.

I heard that too and came away with the agent meaning if it's true what LVD said that she was in the house during the fight and outside when the shot went off then took off in CV's car that he found the 43 min discrepancy using CV's phone and store videos from when CV was shot and she lied.
Or LVD just had CV's phone with her from 7:50 something am when she wasn't at the house and wasn't there for any of the fight and shooting.
I have the Adam/ Det Moffat conversation on in the background and they're discussing CV's phone.
I'm still confused though.lol

Iirc CY told LVD it would be okay for her to drive the rental (after CY drove them back to the CS). This is when LVD wanted T's meds suddenly but LE was waiting on a warrant so no one could go in.

I need a white board.

The state has proven BRD that it was murder and not self-defense. The second shot proves this - and so does having Alex stay the night because of 'threats' but Lori answering the door while Alex stayed in bed - also keeping Charles in the house by not returning his phone - and being alone with Charles while Alex went back to his room to retrieve his gun - staging the bat on the wrong side of Charles - not calling 911 to save his life or doing CPR - and Alex giving himself a pathetic graze on the back of his head.

It's conspiracy because she got Alex there with his gun the night before when her actions proved she was not afraid of Charles.

She also sent Tylee outside because she didn't want her to witness the execution. She wasn't worried about JJ being alone in the car when she was running around with the phone before she woke up Tylee to put her plan in motion.

This was an obvious ambush. Obvious motive, and lie after lie after lie. Plus having an affair and marrying.

First, it was my understanding that LVD told Detective CY that Charles had taken JJ to the car with his backpack and left his phone inside the kitchen on the counter and that - after CV returned to retrieve his phone and Tylee had come out with bat and Charles had taken it from her - Lori had then urged Tylee to go out to the car with JJ. (That is, Tylee was not the one who originally took JJ to the car according to Lori.)

Timeline of Charles' phone from today's testimony:

CV’s phone arrives at Lori’s house at 7:31 and at 7:37 Charles is texting Lori’s brother Adam (based on Adam's testimony, this was to let him know that Alex is at the house and they together assume that “something is up.”)

Between 7:37 and 7:49, Charles’ phone is “in the area of” the rental house where Lori was living.

(My notes: So 12 minutes for all the following to happen: Charles gets out of his rental car, which he leaves running, knocks at door and comes inside into kitchen area, leaves his phone on counter, gets JJ and his backpack and Lori tells him that he will need to get JJ breakfast and that school gate doesn’t open until around 8:20, loads JJ and his backpack into the rental car, goes back into the home to retrieve his phone, has reported conflict involving Lori keeping his phone away from him, for Tylee to come out of her bedroom with bat, for CV to threaten Tylee with bat and to come after Lori backward swinging the bat, for Alex to grapple with CV and bat and become injured on back of his head, for Alex to go to his bedroom to retrieve his loaded gun – and, what is Charles doing, twiddling his thumbs while Alex goes back to the bedroom to get a gun? -- , for Tylee to go out to the car where she hears the shot, for Lori to join her there and ask that Tylee go inside for Lori’s purse, and for Lori to depart with JJ, and Tylee - and possibly JJ's dog - in the car).

At 7:50 Charles’ cellphone leaves the area of the house (Lori drives away in Charles’ rental car).

At 7:52, Alex calls Lori on her own phone.

At 7:54 Lori is on camera at Burger King drive up window, where she purchases Chicken Fries and a small Sprite for breakfast for JJ (and it looks like chicken nuggets for likely Tylee). Receipt time 7:56 am. Phone travels north from Burger King.

At 8:06 am, Alex calls Lori on her own phone.

At 8:16 am, Lori arrives at Walgreen’s on Cooper Rd.

At 8:17, Lori is seen on surveillance walking into Walgreen’s to purchase two pair of flip-flops (one for herself, one for Tylee). Transaction complete at 8:20 am. Phone heads south.

At 8:33, phone arrives at LIFE academy where JJ goes to school. (8:35 is when 911 call is placed by Alex – that is he waited until LVD was in a place where she can be seen by others, i.e. not at the home where CV was shot).

At 8:49, CV’s phone – traveling south - returns to the neighborhood, “in the area of” the home. Approx 8:48 police body cam video on and Lori’s arrival at scene is seen.

Various times indicating Lori was transported to the Chandler PD Family Advocacy Center (where she was interviewed) and then was transported back to the area of the home – arriving in the “noon hour” (where she, AC, and TR then left in the rental car because the house and Alex’s, Lori’s, and Tylee’s vehicles were all subject to search warrant).

Charles’, Alex’s, and Lori’s phones all in the area of Alex’s house between 1:42 and 2:07 pm. Lori called Det Ynclan’s phone at 2:07 pm.

At 2:18 pm, Lori was already calling Valley of the Sun Mortuary.

Charles’ iPhone returned to the area of the home between 2:43 and 3:11 so Lori could return that device to detectives, as requested.

Conclusion:
At the very least, we know that Alex was done shooting CV for the second time (or maybe I should say we know CV was down and immobilized) by 7:52 when he called Lori on her own phone. Alex called 911 at 8:33. So he waited at least 41 minutes to call 911 after CV had been shot.

Also, AC's call to 911 at 8:33 am coincides with LVD's arrival at JJ's school. To me, this indicates they had agreed - either as part of an original plan or in a plan they made in the calls after Lori left the home - that 911 would not be called until LVD was somewhere that other witnesses would see her, as they believed that would prove that she was NOT at the home when CV was shot.

ETA: Note that the 7:37 to 7:49 timeframe... when talking to Det CY and asked particulars about what was happening when, Lori described this as "all happening in seconds."

I could make up a version of events that would make more sense than the LVD version. I doubt LE believes her story either but there is no way to prove anything else since 4 or the 5 people that were there are now DEAD. All that remains alive is the lying story teller LVD. JMOO

This is big IMO and I missed it the first time -- they have movement of LVD's via cell towers and CV's by GPS. MOO I think she had his phone in airplane mode!

Correcting myself from earlier -- I thought LVD may have gone to CV's hotel but I heard it wrong, she went to AC's house where she stayed until she was called back to the crime scene.

And that's when T gave CY CV's cellphone.

I could make up a version of events that would make more sense than the LVD version. I doubt LE believes her story either but there is no way to prove anything else since 4 or the 5 people that were there are now DEAD. All that remains alive is the lying story teller LVD. JMOO
I agree with you. And if you suspend everything that LVD, Alex, or Tylee told detectives and you have no other witness evidence (neighbors' reports of seeing or hearing anything, surveillance of neighbors) - then the phone movement timeline is all you have and you have to ask yourself about the reasonableness of their description of all the events that occurred in the 12 minutes between when CV ended his text with Adam and when LVD departed in CV's car with CV's wallet and phone.

ETA: 12 minutes that LVD described as "it all happened in seconds."

Many of you probably heard this audio years ago.
I'm new to LVD and this is the first trial of hers I'm following.

Between what we heard from the tech guy today and how within days they had serious questions about LVD's actions and timeline.
Then within the same few days Adam gives Moffatt everything and more to open a homicide investigation.
IMO:

I have 2 questions I can't find the answers to

1. Did LE ever call LVD & AC back to be interviewed again or where they only interviewed that once?

2. Did Chandler LE sit on whatever info they had about the shooting and only begin to investigate it when TR & JJ were reported missing?

I think it's a little unclear about where they are after they return to Lori's rental home in "the noon hour" after being transported from Chandler PD (Family Advocacy Center) until all the phones were in the area of Alex's house from 1:42 to 2:07. "The noon hour" is imprecise.

DID they go to CV's hotel room, perhaps to get access to his laptop? Why was LVD asking today's final witness all the questions about whether the laptop was turned on when LE went to gather CV's possessions from the hotel room?

ETA: I see your time link has more detail than I managed to get in my notes while listening live, in particular to the noon hour.

I agree, I think the phone was taken after he was killed. I don't think we can rely on anything that wasn't on the bodycams or part of the medical examiner's testimony.

Not even, sadly, much of Tylee's statement. I think she lied for her mother, or believed what her mother told her happened when she wasn't in the room.

Lori sending her back into a house where Charles lay dying on the floor, THAT I believe. She sent her daughter back into a home where a violent confrontation was taking place and it meant nothing to her to do it. It was convenient. It saved her walking back in herself, and perhaps, it was to ensure Tylee saw what she saw. It's easier to kill someone if you think they know too much, and she made sure of it in Tylee's case.
