The jury found Nima Momeni guilty of 2nd degree murder.
You nailed it. Second degree murder.

Apparently they also found NM guilty of having a modifier to the charge - the use of a dangerous weapon, if I understood the reporter correctly. I assume that will also impact the sentencing.

Jurors found Nima Momeni guilty of 2nd degree murder

12:56 PM · Dec 17, 2024

Thank you so much, Arielilane. Such a relief. I guess I can see how it became second degree murder during deliberations (it's a compromise verdict).

In California, the sentence for second-degree murder is typically 15 years to life in prison (from FindLaw):
  • Minimum sentence: The minimum sentence is 15 years in prison.
  • Maximum sentence: The maximum sentence is life in prison.

  • Factors that may affect the sentence: The sentence can vary depending on several factors, including:
    • Prior criminal history: If the defendant has a previous murder conviction, they may be sentenced to life without parole.

    • Victim: If the victim was a peace officer, the minimum sentence is 25 years. If the defendant intended to kill the officer or inflict great bodily harm, they may be sentenced to life without parole.

      • Mitigating factors: Factors that may mitigate the sentence include the defendant's remorse, acceptance of responsibility, mental or physical illness or disability, lack of a criminal record, and past good deeds.

Yes, it will give him more time to serve. Sentencing date not set yet.

BREAKING - After seven days of deliberations, the verdict in the trial of Nima Momeni was read Tuesday morning, and the jury found him not guilty of first-degree murder in the April 2023 killing of Bob Lee, but guilty of second-degree murder.

DA just stated NM is eligible for 16 yrs to life.

NM's mom is speaking right now, says it was not a fair verdict.

After the verdict was read and they exited the courtroom, the brother of Bob Lee said that the jury reached the verdict of 2nd degree murder instead of 1st degree murder based on their decision that there was no intent to kill. Bob Lee's brother said that the family believes that there was, in fact, intent to kill, but they understand and accept the jury's verdict since the case was difficult to prove intent by the prosecution DUE TO THE PEOPLE IN NM's CIRCLE WHO WERE HELPING TO COVER UP the crime.

The Lee family is very gracious and grateful that NM is now being held accountable and grateful to the jury for their verdict of finding NM guilty of killing Bob Lee.

I don't remember ever hearing a defendant speak after he or she has been found guilty in court. Usually they are just led out of the court room, and they just have time to glance back at their family or other supporter.

Nima Momeni’s mom says her son will appeal today’s verdict. She spoke with him last night and said he is strong and gives her hope.

Of course they will appeal the verdict, NM's brother in law has deep pockets and they will continue to rely on him for money and it seems he is willing to continue to fund the Momeni family lifestyles - regardless of what really took place that night.

I corrected my initial post. It was NM's mother speaking.

Was Sam Z still in San Fran or already on plane to Florida? Bob Lee's brother has been so level headed in all his statements to the press. He is a class act!
PS @arielilane thank you for keeping us up to date!
I still wonder what happened to the items in his car? why they tried to get rid of/erase phone info? why Dr. D was never called to give info on brother-in-law's state of mind after he received call from KM? Anger, worry, confused. asking for medical advice etc???

Second degree the right verdict, there was no plot, no plan, was a heat of the moment killing, he deserves a long prison stretch though as a life got taken

But what about the fact that NM had a knife with him that was taken from his sister's kitchen? I would think that a jury would have had to consider the possibility of premeditation? And if they ruled that out, how did they make sense of NM having that knife with him, I wonder.

IIRC, it was reported that he was on zoom watching the verdict, he was back in Florida, not in the courtroom. It doesn't surprise me, he must have figured out that he lost the case, and didn't want to be around to see it and have to take questions from the media.

He knew he was going to have a confrontation/serious argument with the victim and took it along for self defence if attacked is my guess
