~snip~

But Garcia said several times during court today, "I did not write that sentence, it is not in my handwriting."

~snip~

Cherie Sutherland was one of the lottery winners. She said six years ago she and Garcia were assistant youth soccer coaches together. She said initially she couldn't believe he could be guilty of such a crime. Sutherland said she's been in court several times and now has, "changed her opinion about his guilt."

After Garcia finished testifying the defense rested its case. Jurors are now listening to rebuttal witnesses. Closing arguments in the case are expected later this week.

Prosecutor Garen Horst questioned Garcia during the morning session and asked him if he had an explanation for how Wilson's DNA got on the door of his Toyota Camry.

"I don't know," Garcia responded.

Horst continued with rapid-fire questions about DNA evidence that could place Wilson inside Garcia's car.

"Do you have an explanation why your blood mixed with her DNA was found (in the Camry)?" Horst asked.

"I don't know," Garcia said.

An expert testified blood and other stains in Garcia's car belonged to 27-year-old Wilson, the woman Garcia is accused of murdering on or about Oct. 5, 2005.

~snip~

Court stands in recess until 8:30 a.m. Wednesday when the prosecution and defense will begin their closing arguments. The jury could have the case as early as Wednesday afternoon.

On the article that you posted, chico - is this:

Garcia said several times during court today, "I did not write that sentence, it is not in my handwriting."

that is regarding the note Garcia wrote to another imate, saying: Yes, I had sex, but she (Wilson) wanted to."

Now... my question is - did the DA LOOK at the handwriting of this?? Especially that last sentence? Did it say ANYTHING in another article, Chico - did you find that explained anywhere?? Just wondering! :p

I haven't found anything about the note other than what is in the links I've posted. I don't know if the defense made an issue of that (whether the handwriting matched or not) but I kinda think not or it seems the media woulda picked up on that.

I keep going over and over it in my mind but I think the state's case is solid. The only reasonable explanation for Christie's hair and dna to be in the car at all is that she was in that car at some point yet MG remains firm that she wasn't. If it were just a hair on the seat or something like that I could buy an argument of simple transference but not in the trunk, back seat and wedged in the door handle. I think its highly unreasonable to think that LE planted the evidence.... it's a usual defense tactic and nothing else imo.

And you would be correct. I believe Garcia's goose is cooked but I wish he would give up the location so Christie's family would be able to have a funeral and grieve amongst themselves. It isn't right that the criminals serve themselves to the end.

I'm watching this one too. There's so many when you go through the missing that have been gone for years never to be found.

The judge in the Mario Garcia murder case is reading instructions that the jurors must follow during their deliberations.

Judge Larry D. Gaddis began jury instructions this morning by reminding jurors that Garcia, 54, is facing two counts in this case. One felony count of murder and one felony count of possessing a deadly weapon. The weapon in question is a collapsible baton.

The jury in the Mario Garcia murder case began hearing closing arguments from the prosecutor Garen Horst this morning. He argued that there is plenty of circumstantial evidence that Christie Wilson is dead, even though her body has not been found.

"You have not been produced a body in this case. The law does not require that," Horst said.
~snip~
"We never tried to paint a picture of someone who is perfect," Horst said. "She had strengths. She had weaknesses. For whatever reason the defense is focusing on weaknesses."

Horst then walked the jury through the evidence he presented in the trial that he says shows Wilson is dead..

IMO, the most damning bits of evidence in this case are:

No scratches were seen on Garcia's face at the casino and he left after 1 am. He had scratches on his face the next morning at work. He could not have acquired the scratches the way he said that he did between 1 am and 9 am of that day.

He was the last person seen with Christie and she never made it back to her own car, which was left in the lot that night.

The DNA could not have gotten into his back seat/trunk by simple transference of a piece of hair.

The missing trunk carpet, which we know was in the car when it was sold to him as testified to by the car seller.

I think that this SHOULD be a slam dunk, if the jury understands the evidence. As in the Peterson trial, there are too many bits of evidence that have to be explained away. If each of them adds a little weight to the case, the cumulative weight of all of them is enough to erase REASONABLE doubt.

The jury in the Mario Garcia murder case is hearing closing arguments from defense attorney, Ron Peters, this afternoon. He began by saying the prosecution's case has been a show.

"It was a huge production. It was a show," Peters said. "This is not a show. This is reality this is a murder trial this is where decisions are made not like somebody attending a movie."

Peters repeated his contention that there was not enough evidence to convict Garcia and that investigators failed to pursue other leads. "My biggest worry in this case, and I'll be honest with you, is not the evidence. There's not the enough evidence. It was a rush to judgment from the beginning," Peters said.

I agree. Granted I am not on the jury but everything points to Garcia.I just wish he would give up her location so her folks could get some "closure". The thought of your child in the wilderness alone is more than any parent should have to endure.

And the sad thing is he probably never will... we can only hope and pray that she is brought home one day.

I don't know, but I trust that he will be found guilty. There are too many pieces of the puzzle that point directly at this guy.

The jury in the Mario Garcia murder trial will likely begin deliberating the case late this morning or early this afternoon. Defense attorney Ron Peters wrapped up his closing argument this morning. Prosecutor Garen Horst is delivering his rebuttal.

http://www.news10.net/display_story.aspx?storyid=21592

This article was just updated about half an hour ago....the jury should begin deliberations soon (and hopefully come back with a verdict real soon) Sending postive thoughts to Christie's family and friends during this stressful and down to the wire time.

eta I don't think CTV knows about this trial so its not likely they will cover the verdict...the best to hope for (imo) is some breaking news on the local stations and the websites. I will update Greta when the verdict is in...she did cover this at the beginning IIRC.

Hi Packer! I think he'll continue to deny....hell, I don't know, I didn't think he'd have the brass to take the stand and bs his way thru his little story. It's all circumstancial and without a body but to me the evidence is compelling. He had days to do whatever before he even was on LE's radar. It took them a few days to weeks to identify the players that night...it just wasn't a rush to judgement but the pieces certainly fell together quickly as evidence was gathered. I have jury stomach!

In closing arguments Wednesday the lead prosecutor told jurors that the evidence proves that Mario Garcia killed Christie Wilson, while the defense attorney claimed the evidence was "tainted."

Following jury instructions by Judge Larry D. Gaddis, the 10 men and two women of the jury along with four alternates heard a lengthy oration from prosecutor Garen Horst in which he outlined the people's case and focused on the contradictions between the defendant's testimony and the testimony of more than 80 witnesses.

"He killed her. This man (points to Garcia) should not get off," Horst said. "I respectfully ask you to hold him accountable and find him guilty of first degree murder."
