Ah ha! The dvr discussion! Prosecutor asks Baker if he ever asked Birdsong about how to scrub a dvr. Birdsong told Baker he (Baker) wasn’t smart enough to scrub a dvr; better to just take the dvr. Baker acts clueless, leading into a sidebar. Baker winks at someone (in the audience?? Hard to tell) then shakes his head, then slyly (imo) glances around.

(This testimony starts about 3:20 mark on Law & Crime. I don’t know how to attach it so this is my interpretation of what went on).

Wow! Baker just said he had put gps’s on Fabio’s Porsche and truck months before. Sounds like a lot of planning went into this. Dang.

I don't recall them finding any evidence on his phone for vehicle tracers, I was thinking it was just an excuse for Monica having given him all Fabio's locations. I could be wrong, though.

Robert Baker, one of the men who killed Fabio Sementilli, admitted to putting a GPS tracker on two of Fabio Sementilli’s cars. The prosecution was asking him questions on the stand when he dropped never before heard information about putting GPS trackers on the Sementilli’s Porsche and truck. Baker says that is how he knew where Fabio was going to be when he participated in the first murder attempt.
 
Just got back from grocery shopping, and luckily the trial was resumed on Court TV with Baker. He can't remember much, but knows he could've had 3 phones, but certainly not 4 phones. Here's some of what's going on in that courtroom that I'm able to catch.

Unfortunately, I never got the complete story on how this Birdsong person fits into the crime. Baker and I think Austin went to Las Vegas to stay at Birdsong's house. Monica just happened to be in that town with her husband Fabio. Please, if you know more and can fill me in on Birdsong, etc., don't hesitate.

He took Austin to the Sementilli home where Austin was shown around, then Baker and Monica went in a bedroom to have sex. State is pointing out that Baker had a plan in place for sure by then-- had already bought the knife, brought Austin to the Sementilli house, and now is trying to say he didn't have a firm plan to kill Fabio.

Loyalty of Christopher Austin and him keeping quiet was why Baker got him involved. (He was Baker's son's best friend? Called Baker Uncle? Looked up to Baker. He'd do whatever wanted, and cross asks if Baker took advantage of Austin.) This is part of the the cross. Baker said it was a useless attempt, but he had to try to put a fake alibi together.

Baker had a GPS trackers on Fabio's car. Months before, he put those on both the truck and the Porsche.

Why is he changing the story at this late date?! Now he says he was trying to get Fabio to come into the house so he cut the power off? What happened to coming in the sliding glass door, stationing Chris at the front door as a lookout, walking through to the kitchen, seeing Fabio on the patio and attacking him in his chair?

He just told that version, and then suddenly, with his dead-memory-cell brain remembers that when Fabio wouldn't come into the house he went into the garage, found the electric panel and cut the power to the house? How can he forget the only reason he turned the power off was to cut the wires to the security DVR box???

I so wish the judge hadn't interrupted all that to end the day, I wanted to see her tangle him up (again) in his own ever-evolving tale.

1742255343998.webp After Baker killed Fabio he went into the house and started stuffing some things and valuables into a pillowcase trying to make it look like a robbery. He tried to take some of the clothes that he got for Monica, and says he wasn't thinking doing that might make her realize he was the one who broke into the house. Just stuffed random stuff, wasn't thinking about it, just throwing things into a pillowcase.

He is doing a lot of “I can’t remember” today. That allows him room for getting things mixed up. He must have been advised over the weekend to take that approach because he didn’t do that last week.

Is there going to be a pause in the trial because of a conflict with the judge? I think I saw that somewhere.

I haven't seen anything about a conflict with the judge, this morning the judge said next Mon. - Thur. he has to teach a class so, even though we're getting to the finish line, only one day (Fri.) of court next week.

I thought Baker would be their last witness and we'd be finishing up this week, but I guess not.

Yes that is what I heard. It was a conflict of schedule for the judge.

Oh my, he 'doesn't remember' all the things that implicate Monica and he can't explain otherwise. At the end with the shutting off the power to get Fabio to come inside just came so far out of left field, the prosecutor probably can't wait for the morning to get back into that, she'll be loaded for bear. lol

Knowing this coming up why didn’t judge ask jurors if they would be willing to have longer court days to get through this faster

Is the GPS claim true, or is it a made-up story to explain how he knew of Fabio's whereabouts without Monica telling him? JMO.
 
Re the gps, didn’t Baker testify he had purchased one online, and someone he wouldn’t name, purchased a second one? I don’t recall Austin saying anything about the gps.

I’m trying to figure out how they actually got onto the back patio. I thought Baker stationed lookout Austin inside the front door, but Baker went to the patio from outside. Did they both go in through the front door? And how did they get in? Were the doors unlocked as Austin testified?

Why is Baker testifying Austin was not on the patio, but Austin said he was and held down the victim after using his knife as well?

I’m hoping somebody remembers what Baker said today. I was getting a bit confused.
 
I'm not buying the GPS thing, when he first mentioned it, the prosecutor seemed to be getting at that it wasn't on his phone extraction but asked something about how he viewed it and he said it could be on the phone or computer (I think) and she never got back to asking which phone he had it on. Later, when it came up again, he said it was on the burner phone, which I don't think he had when he said he put the tracker on Fabio's truck.

He seems to be trying to 'save' Chris as well as Monica, even though he said he was shown Chris' proffer transcript and knew Chris admitted to helping kill Fabio. Why he keeps on about Chris only being the lookout is beyond me.

I was confused when Chris was testifying about which door they went in, he said Baker told him either Monica left keys for him or left the door open, and I thought he meant the front door, as I didn't recall him mentioning they went around the back of the house to gain entry in the sliding glass door.

But it seems like the state believes they did go in the sliding glass door around back, through that room, into the living area, and then into the kitchen where you can see through the patio doors out to the patio where Fabio was sitting.
