Was the 8th the last day we have evidence of that Chase was in the McStay home (searching the address of TMobile/dental office EIP client)? Was he using Joey's truck to drive to the house (before he drove down and dumped it near the border that day)? Seems like he might be worried using his own once they were reported missing and neighbors might recall his truck having been parked there after the 4th.

The idea he was not investigated seems pretty laughable now.
Yes I've been thinking it's probable the prosecution won't be calling him, since they struggled to get his bank statement into evidence and he could have simply testified to the payments to get around that difficulty. Do you agree?

I'm trying to think why the defense wants them to have disappeared on the 5th.

Four backdated cheques were raised that day which they might be trying to say Joey did, but then there was another backdated cheque raised on the 8th! So are they going to say he admits doing that one?

Could it be because they know his alibi for the 4th has been blown by Cathy Jarvis? So they want Merritt missing from home and they will make an excuse for that, but the family was still alive? McGee went to town on the popcorn and eggs out for breakfast, the sleepwear, and the dogs put outside in morning routine.

Cathy Russon, who has been in court (isn't this week), said that the prosecution will not be, but the defense plans on it from what she has heard. FWIW

I haven't heard any theory from either side but I have noticed the prosecution made a point of asking the experts on this twice to confirm the hands were missing so I think they are bringing it to the jury's attention and they are building up to a theory that will be revealed!

I think when we say "hands", we mean the hand bones ;-) Like Tortoise said, that can't be from animal activity, or it's not logical.

Were Joey's hands missing as well Tortoise? I don't have time now to go look at testimony!

#McStay - Prosecutor Imes starts out today by asking the judge to allow them to use a picture that was previously excluded, showing Joseph McStay sitting at his desk with what looks like the same shorts on that were pulled out of the grave.

Prosecution wanted to show a photo of Joseph sitting at his computer wearing the shorts that are consistent with what he was found wearing. Here is a good explanation LOL

#McStay - Judge says he doesn't think showing a picture of Joseph wearing the same shorts as found in grave is necessary. He said unless they had a pic of him wearing those shorts on the 4th, clothing buried with him doesn't indicate he was taken from his house. Imes: Ok

Yes all the hands were missing.
Is it possible the hands were removed because there might be DNA under the fingernails from scratching the murderer during a struggle? And if so, where could they be?

I truly believe the paint found on Summer's bra and on the sledgehammer very well could be the smoking gun in this case as to the murder location. I see clearly why the state believes the murder scene was at the McStay home.

Paint can only get on something when its wet. There is no other possible location this specific wet paint would be found in.

It links the home as the location where they were murdered. Imo no other location but their home would have this same wet paint.

The state will probably have a paint expert that will testify the paint found in the grave is consistent in color and brand Summer had been using. I'm sure they have contacted the store where she purchased the paint she was using.

I have done a lot of painting over many years because I change the wall colors throughout our home about every 3 years. it's very common for the paint store to keep in their computer records what color, amount, and brand bought, including the type of paint bought such as acrylic latex interior paint in flat matte or semi gloss etc.

They keep this information in their system in case the customer has to come back to buy more paint. Then the store rep can quickly look up what brand and color they need to mix up. Some customers may forget exactly what they purchased but needs more for touch up areas or didnt buy enough paint at the time to complete their paint project.

Imo the wet paint Summer was using inside of her home at the very same time this all happened is the most compelling evidence showing they were murdered inside of that very home.

I'm sure some of the jurors have already notated the significance of this as well.

Interesting to note.... the prosecutor said something about the 'defense and the media' saying something about their theory. I wonder how often they check online to see what people think of their theory? LOL After yesterday.... their own witness seemed to say there should have been blood, yet, there is no blood right now..

Elva Fonseca testifying. She used to work for Merritt. This is the witness that was called early in the trial and the defense objected I think? She couldn't come back until today.
