So, given the dates listed in the AR, why was the 12th/13th such a catastrophic date? So catastrophic as to cause Rebecca to throw herself off the balcony? They didn't definitely determine he was brain dead until 2 to 3 days later. Shouldn't there still have been a little hope at that point?

Those women's clothes in the guest house are looking more and more suspicious.

They did not 'pronounce' him as brain dead for two more days or so. But I think they knew it earlier than that. That was a horrific injury, not the kind that a small child can usually come back from. and if he was brain dead two days later, he was most likely brain dead already. imoo

Thank you, I stand corrected. The ME autopsy states he did say Ocean. I just wonder why that was not mentioned in the LE PC, as that is a BIG piece of information. Also, very important that it states that Max was in the kitchen when Rebecca went to the bathroom. Not at the top of the stair, unsupervised.

At this point, I am taking everything that was initially told to the ME with a bag of salt.

The following initial information was obtained from San Diego Coronado Police Officer Erhard------Officer's Report Narrative:

...She (Rebecca) heard Max say the dog's name "Ocean".

( i still don't know she would heard him say anything, since she found him "unresponsive on the floor.." to begin with..)

U am amazed if he did talk. It would seem to me that with an injury that does not allow breathing, that he could have spoken.

It states Rebecca could not remember if she turned Max over or not. I can not imagine the terror and fear she felt, finding Max as she did. But again, he was in the kitchen, when she went to the bathroom. I hope this ends discussion of her being negligent.

His autopsy report would have been written after Rebecca's death. Just saying.

What we were told that the voice mail message informed RN that Max's condition worsened. I don't see anything in the autopsy report itself that would explain why it would be known he took a turn for the worse on the evening of 7.12 or very early morning on 7.13.

Whoever said this is like a bad mystery novel, but you keep reading until you see how it ends, was spot on imho.

How could LE and the ME miss so many things in their investigation, after 7 weeks?

Could it be that as he was tripping over Ocean that he yelled it then? That is, if he tripped over the dog.

When was it determined that MS had been lacking oxygen for 25-30 mins?

So, then something as important as Max speaking following the accident, should have been something that LE was aware of, since they reported to the ME. Yet no mention of this, what so ever, in the PC.:waitasec:

It took 25 minutes for ems to restart Max's heart.

With head trauma patients can be lucid and talk first before deteriorating.

Yes, but his was not just head trauma, but a severe spinal cord injury, at the neck. And initially he was found 'unresponsive' with no pulse. So how did he talk?

What do you think about this 'voice mail message'? Was it ever left? Was it a good night message? Or do you think it was what JS said it was?

But supposedly, the only 2 witnesses were in different bathrooms at the time, and RN heard the crash, which made her run to look. So she would not have heard him scream Ocean, supposedly anyway.

I think that the doctors KNEW from the start that little Max was brain dead. Of course they are going to do a series of tests and scans and such just in case of a miracle. But, imo, by Tuesday evening they were pretty certain that Max was not coming back. JS is a very pragmatic and strong type personality. I can easily see him pulling aside the trauma specialist and asking to be told the truth. imoo I do not think any particular thing happened on that evening, it was more likely what didn't happen. Probably the tests and scans showed what the doctors had feared all along. And JS was apprised of the bleak situation. If the spinal cord was beyond repair, and the brain was not firing, then he would be told that.

She says he was in the kitchen. But she also said there were no other people in the home, yet her family attorney now claims the 2 older siblings were there. And that Max was planing when he fell.

So I am not sure that everything she initially told the ME was the truth. For example, that nobody else was home, and that her little sister was in the bathroom. If both of those things are true, then the family attorney is not telling the truth.

Saying that Max was in the kitchen and she and her niece were both in the bathroom makes it seem like there was no negligence. yet the Z family attorney claims it was a planking accident, which puts him in a dangerous game at the top of the stairs, and implies there was a witness. So how can her story be accurate given what her family attorney now claims?

Maybe as a safeguard so his client didn't have to in case this wasnt an accident and suicide.

IMO

I wonder how RN's dog has been treated since getting picked up.

What positive reports? I did not see any. I must have missed those. Everything that I saw said that he was severely injured and in very critical condition. It took 25 minutes to restart his heart.

ETA: from the first page of the autopsy report, in the summary it said " Child with severe head trauma...CONDITION DID NOT IMPROVE...died on 7/16/11.

According to the report his condition did not ever improve.
