Impact of charges revealed in affidavit




OTTAWA-The wife of Col. Russell Williams says she has been devastated by charges against him in connection with two sex killings, two home invasions involving sexual assaults and 82 lingerie break-ins, including 34 in Orléans.

Mary Elizabeth Harriman, 52, has not spoken publicly since her husband’s arrest in February. For the first time, the impact of those charges on Harriman were revealed in an affidavit filed in a Belleville court.

“The revelation of these charges has been devastating to me,” Harriman said.

“As a result of the charges, my previously anticipated future and financial security had become jeopardized,” the affidavit said.

The affidavit is part of a $2-million lawsuit launched against Williams and his wife by one of his alleged victims on May 6.

In the statement of claim, the 21-year-old woman says she has suffered severe depression and addiction since the alleged attack. The statement of claim also says that the woman, called only Jane Doe, has had to develop psychological mechanisms in order to survive “the horrors of the assault.”

The statement of claim also alleges that Williams fraudulently transferred his Ottawa home to his wife to protect it from legal action. The transfer, according to documents obtained by the Citizen, was signed off by Williams on March 26.

In Harriman’s statement of defence filed last week, she said the home transfer was not “fraudulent” and there was nothing “untoward or suspicious about it.” Harriman says that she entered into a “domestic contract” with her husband to provide her with “financial security.”

Williams has not yet filed his statement of defence.

The case began when Williams was asked to come in for questioning in February after a roadside check for a unique design of snow tires matched the colonel’s truck.

In a lengthy interview at Ottawa police headquarters, Williams allegedly directed detectives to so-called trophies at his home at 473 Edison Ave. in Westboro, including photographic images and more than 500 pairs of women’s underwear taken in break-ins. Some of the evidence, according to a search warrant linked to the murders and sex assaults, included items such as photographs, thongs, bras, panties and baby blankets.

On Feb. 8, Williams allegedly led police to the body of Lloyd, who had last been seen Jan. 28.

Williams is also charged in two home-invasion sex assaults that happened within walking distance of his lakeside cottage in Tweed. In those cases, he is accused of breaking into the victims’ homes, tying them naked to chairs, blindfolding them, then sexually assaulting and photographing them.

I'm having a hard time following her logic too!
Because personal financial details are expected to arise in the course of the lawsuit, Harriman's lawyer Mary Jane Binks, has signalled that she will be seeking a sealing order on details that haven't yet come up in court.

"My reputation in the community is exemplary," says Harriman, an associate executive director of the Heart and Stroke Foundation of Canada.

"The publication of further particular details of my professional life, personal financial situation and legal affairs could have a significant negative impact upon me personally and professionally."

Does she fear her "exemplary reputation" would be tainted IF details of her professional life, financial situation and legal affairs are known? WHY? "Nothing to hide, nothing to fear" comes to mind.

It's probably a lawyer's legal gobbleydegook ... not much could be more negative than what has already transpired in her life?

Speaking of legal stuff, I believe I read that RW has not filed a Statement of Defence. A Defence must be filed within a very specific timeframe (can't remember what it is in Ontario .. 20 days??) .. otherwise the plaintiff would receive an Order for Default Judgment.

I wonder what's going on with RW's defence to the civil suit.

Under Ontario Rules of Civil Procedure

a Statement of Defence must be filed within 20 days of the date of service. RW was in jail, so there was no problem locating him for service. If a Statement of Defence is not filed, the defendant has the option of filing a Notice of Intent to Defend, but it only gives an extra 10 days in which to do so.

Then we have Section 19.01 regarding "Late Delivery of Defence" which states:

"A defendant may deliver a statement of defence at any time before being noted in default"

I don't see anything to indicate whether or not a defendant is notified of when default judgement may be rendered against them.

It then becomes a nauseating Bartholemew's Hat of subrules and revocations ... but I'm sure RW's legal team are well versed in the numerous interpretations as it relates to protecting their client's interest.

LOL .. So now that i'm at the end of this post, I realize it is pointless ;) and the whole thing could have been more succintly summarized with "It's all very fuzzy" :)

Colonel Williams Makes Court Appearance

Belleville’s Pinnacle Street courthouse will be abuzz later this morning as Colonel Russell Williams makes his first appearance since late April. The 47-year old former commander at CFB Trenton was charged in early February with the first degree murders of two local women and two home invasion sexual assaults in Tweed. and, just prior to his last court appearance seven weeks ago was charged with 82 break and enter charges in Tweed, Belleville and the Ottawa neighborhood where he lived with his wife..

.Col. Russell Williams, the former commander of CFB Trenton, is due in court today in eastern Ontario to face murder and assault charges.

He is charged with killing two women, sexually assaulting two others and with 82 break-and-enter charges, some of which reportedly involved lingerie.

Col. Williams was charged in February with first-degree murder in the death of Cpl. Marie-France Comeau.

The 37-year-old was a flight attendant at CFB Trenton and served aboard the same military VIP flights Col. Williams piloted for much of the 1990s.

He is also charged with the first-degree murder of Jessica Lloyd of Belleville.

The 27-year-old's body was found in Tweed, Ont., two weeks after she failed to show up at her job in nearby Napanee.

Forty-six of the charges involve break-ins in the eastern Ontario community where Col. Williams lived after taking command of the sprawling airbase in July 2009.

Another 34 charges fall under the jurisdiction of police in Ottawa, where Col. Williams lived with his wife
