JFB had the appeal briefed before the indictment was issued, she might as well spend a little more time on oral argument.
Besides, if she gave up on the case it would signal a change of heart - that she no longer believes Morphew to be the innocent victim of unconscionable abuse by the authorities.
I don't believe she expects to win at the Court of Appeals, because like Judge Domenico the Court is bound by Supreme Court precedent. IMO JFB can only hope for a grant of certiorari after an adverse decision in the 10th Circuit. She needs to keep alive the opportunity to persuade the SCOTUS to change its mind by completing this stage of the appeal.
JFB is a "true believer" in Morphew's innocence. All her thinking is driven off this basic assumption. It's the lens through which she examines the investigation and the prosecution. Any bad facts must be the result of unjust or incompetent acts by the authorities. For JFB, this mindset is necessary to serve effectively as a zealous advocate for her client. We see the same behavior in Eytan, and also in Ann Taylor who represented Bryan Kohberger. Many (not all) of the best defense lawyers have this mindset.
Only after exhausting all the avenues of advocacy for her client will JFB be able to take off the filter, look objectively at the remaining evidence to be presented at trial, and advise the client about possible outcomes.
Beller is a fine advocate, but he doesn't seem to need to think this way. IMO he will play the role of Nielsen to JFB's Eytan. He'll be the one to suss out a possible plea bargain.
Again, these are lawyers doing their jobs, not devils incarnate. I reserve all my anger for their client.
