Can anyone explain this? How can ALL the State of CO public defenders have a conflict of interest in this case?

"Since Morphew is in custody, the judge determined that he has the right to an attorney appointed by the state, but she said state public defenders have recused themselves because of a conflict of interest."

I’ve set the timer
on my clock;
wonder what he’ll
show up wearing,
hope he’s sweating bullets
whilst standing in the dock;
hopefully the Judge issues
ruling on bail,
hope it’s not reduced, and that BM can’t come up with or put up the cash;
and has to await trial
in county jail,
I hope trial begins quickly
as in fast;
ends with a Guilty verdict,
AKA conviction;
that BM receives *a very long sentence,
then gets sent off to the big house
AKA prison.

*As to a very long sentence:

LWOP sounds good, in fact
It sounds perfect to me,
bet Suzanne would be happy too
as likely would be able to rest most peacefully.

I believe in the original trial his neighbors were not afraid until the original AA was released.

They are an independent public agency. The equivalent of all attorneys working for the same law firm where a conflict of interest would be when their ability to represent a client is compromised by their duties to another client, a former client, a third person, or their own interests. For example, there may be a witness here who is represented by a public defender. JMO

For example, there may be a witness here who is represented by a public defender. JMO

IMO, David and Jane have positioned themselves to be appointed.

Which makes me wonder about a behind the scenes construct that predicated this current conflict of interest problem since Jane was/is Iris’s cohort on the civil suit.

They are obviously in communication.

Shades of the conflict of interest that got Judge Murphy to recuse himself from the first go-round with BM when Iris was BM’s lawyer. Which put Judge Lamas in charge. And who, it appeared, let Iris lead him hither and yon. IMO

BM was referred to the Office of the Alternate Defense Counsel (OADC). The OADC is a separate, state-created agency that provides legal services to indigent people in these specific situations (i.e., when the Public Defenders Office has a conflict).

As previously noted, both David Beller and his law firm have long ties to OADC per their website. It would be no surprise to me if DB brought any conflict to the attention of the Court-- just as IE did when she fashioned the recusal of Judge Murphy. JMO

*Status Conference Hearing (@ 1:30pm MT) - CO – Suzanne Renee Moorman Morphew (49) (missing May 10, 2020, did not return from bike ride (supposedly), Maysville, Chaffee County; CBI agents located human remains (dry bones found in a shallow grave (3 ft deep)) scattered (across a large swath of sagebrush-dotted prairie estimated to be around 75 yards) in a dry field of sagebrush & natural grasses (on east side of Saguache County) in the area of Moffat in Saguache County (which is 45 miles south of Salida) on State Hwy 17 & near mile marker 103 at County Road R on Friday, Sept. 22, 2023 during an unrelated investigation (CBI was searching for 55-year-old Edna Quintana who had gone missing in the region on May 3, 2023) . The El Paso County Coroner’s Office identified the remains as Suzanne Morphew (dental records & her cancer port) on Wednesday, Sept. 27, 2023. - *Barry Lee Morphew aka Lee Moore (53 @ time of crime/now 57 when arrested) indicted & charged (6/18/25) & rearrested (on 6/20/25 in Gilbert, AZ) with 1st degree murder after deliberation. Bond @ $3M CASH if he “fights” extradition. Extradition was waived on 6/20/25. Was extradited from Arizona to Colorado on 6/30/25. Alamosa County

7/1/25 Update: Morphew made his first appearance in the new murder case Tuesday in an Alamosa courtroom. Asks for public defender & since the public defender's office has reported they have a conflict, attorney David Bellar said that he & attorney Jane Byrialsen (both currently providing limited representation) would be available to be appointed. All Discovery has been given to Defense & Judge with the exception of one grand jury interview which they will have in a week. Next status hearing on 9/2/25 @ 1:30pm, after Morphew's defense counsel asked for 60 days to review the discovery in the case. Barry's lawyer anticipates he will be asking for a probable cause review & anticipates they will want to review the issue of bail.

Fine reputation??? At the very minimum, let's not forget that he committed Voter Fraud. Cast a ballot for Suzanne who was already dead in Trump' s name.
And let's not forget the terrible reputation BM had in Indiana after selling his trumped up 'goldmine' of a company to the father and son on false, fake info. I believe there was also an instance of assault on some guy.

Plus, the crooked as a fish hook stone wall he installed that he used as his cover story for the Mother's Day weekend murder. 🤬

BM's been a schemer and con man to some extent his whole life IMO. Another weak little man enabled and catered to by the women around him his entire life. Unfortunately, Suzanne made the choice not to do so anymore and paid the ultimate price for her 'betrayal'.
