ALAMOSA — Barry Morphew, the Colorado man accused of killing his wife and leaving her body in a remote field in the San Luis Valley, will likely face trial next summer.

During a brief hearing in the case Monday, his attorney David Beller told 12th Judicial District Chief Court Judge Amanda Hopkins that his team continues to work through “a voluminous discovery” of evidence prosecutors plan to present at the trial and he hopes to be ready for Morphew to be arraigned and enter a plea by the middle of January.

Morphew walked into the courtroom Monday clad in jeans, a sport coat and an ankle monitor, after his supporters were able to post $300,000 to guarantee the $3 million in bail set by the judge when he was extradited from Arizona earlier this year. One of his two daughters — who have publicly maintained his innocence — sat behind him.

Prosecutors said they are still anticipating going to trial next summer, and the judge made it clear the Jan. 12 hearing will be the last time she approves a continuance.

That's about as closed a courtroom as one could have without closing it completely.

In Australia, our trials are similar. Usually only a Sketch of the defendent.
Then we wait, for further info, from those present, during breaks.
Nothing like the many open trials found in USA.
However, at verdict, and sentencing, more is shown, the Judge, BUT not the defendent's face: only a sketch.

The public was allowed to attend the hearing in person, like Tisha Leeway did. Leeway knew Suzanne and has been a voice fighting for justice for five years now.

Each year, Leeway calls on the community to send ornaments to decorate a tree in Salida in Suzanne’s honor.

Last year, her tree was almost falling down because we had so many, so we probably will have to get two trees this year, which is fine,” Leeway said. “I just feel like we need to support her and her family, and because Barry has a lot of support, obviously, because or else he wouldn’t be out on the streets.”

Leeway says ornaments can be sent to 40 Rex Circle, Salida, CO, 81201. The tree goes up the day after Thanksgiving.

I think what the good counselor meant is voluminous evidence of guilt...

Thank you for sharing this @osu. Judge said this was the final continuance on arraignment. BM has to enter a plea in January, else the judge will enter a NG plea for him.

Defense is just kicking the can down the road. I believe they will have 45 days after arraignment to file motions.

I will be shocked to see a trial before 2027.

When I saw the Fb pic (like Denver Gazette above) with his girls, I thought: One should withdraw from him his secret weapon, the girls, until he finally is convicted and all is done. He always indirectly is influencing others with his pretty (he would say "sexy") daughters, just as he most certainly did with the beautiful Suzanne throughout her life. MOO MOO

Thank you for this @Cindizzi. These trees are a great tribute to Suzanne, her memory, and a generous gesture by Ms. Leeway who has been organizing and putting this together for several years now. I’ve seen pictures of past years’ trees and they were absolutely beautiful and beautifully decorated. One of these years I’d love to travel cross country to see the tree in person if I can work it out. This year, I plan on making an ornament and will send probably early next week.

Many thanks and kudos to Suzanne’s friend TL for keeping Suzanne’s memory alive, attending court hearings, being a voice for Suzanne and fighting for justice for her.

Throughout following this case with much of the focus naturally being about Suzanne’s unfortunate murder, her creepy husband and his, er, ahem, ‘shenanigans’ for lack of a better word, is so very heavy on the heart. That said, it can be hard to draw anything positive from these tragic cases. Obviously there’s nothing good/positive about someone being murdered. But putting murder aside for a moment to express something pre Suzanne’s murder which is also part of the case and which stands out as positive for me, was learning about the many thoughtful, kind friends she had during her lifetime in both Indiana and Colorado and all the kind things they said about Suzanne was so heartwarming and makes me happy for her in that, at least she got to experience some positive caring friendship relationships in her (too short) lifetime.

I’ve often thought about how I wish I’d have met Suzanne, think we’d have gotten along fabulously.
I hope her soul and spirit somehow knows that along with her siblings and good friends, people she never met in her lifetime, thousands of strangers from all over the world, who came to care for her through following her (tragic) story, are also supporting and fighting hard for her deserved justice.

We will never give up dear SUZANNE.

Counsel say they need nearly six months to complete their review of the evidence. That's truly extraordinary - especially since Fisher-Byrialsen is intimately familiar with the vast majority of it through her work on Morphew's civil case.

Beller has a reputation as a negotiator extraordinaire. I wonder how he's actually using the time, whether the meetings over discovery include some casual conversations about the likelihood that key evidence will be excluded and the possibility an advantageous plea deal.

"Plead guilty as charged" is likely the only offer on the table. MOO.
