To add another dynamic - if I were guilty of this, I certainly wouldn't be acting like I was. I would be out in front of every camera shedding every crocodile tear under the sun. Why would I be confident enough in my ability to get away with it that I purposely allow everyone to suspect me? Makes little sense.

Perhaps instead he is confident that he will ultimately be vindicated.

I'm confused, so a guilty person should act innocent and an innocent person should act guilty?

Yes... but what you hear on NG may or may not be true when it comes from anyone other than LE. IOW, those rumors started because of what Elaine said, and she was not clear in her answers. At the end of that interview, there is nothing definite, just that she believes it was inconsistent, and that she does not know if he was asked to take another poly. Before that, she thought he failed, and then she didn't know for sure.
Personally, I am not going to take anyone's word for it unless it comes straight from LE.
As far as him not refuting accusations, why should he? He knows they are not going to believe him anyway. He could tell him the sun rises in the east and sets in the west and they would call him a liar.
That rally was set up to harass and intimidate him... it was not to get answers. What made them think he would come out and talk to his ex-wife and son in a whole crowd of people? That's idiotic. If you want answers from someone you meet with them in person, without 25 other people looking on.
I can't imagine what they hoped to accomplish when they were standing out there in the cold holding signs in front of an empty house. Lot of good that did, since he wasn't even there.

The Rally has already done good because Mark spoke out and LE also spoke other which neither has done for weeks on end . That rally was very productive .

And maybe if mark acted more like a grieving father then people would be more receptive to him . All his is doing is playing a victim when his 13 year old son is god knows where . I don't see Elaine sitting at home and hiding away because she knows that wont help find her son who she loves and adores .

Maybe Mark understands the fact that this polygraph Facebook rumor is not in MSM so he didn't want to bring it up during his media phone interview. MOO.

Actually the polygraph issue came from Cory during a news interview. Then it came up again on FB, if it was considered a valid statement because it was on MSM first, it can't be considered rumor right?

Id love to know where Dylans last cell ping was!

That is one of telling clues - was it near durango or vallecito or somewhere else?

And Mark's cell phone records - calls/texts/pings

I also think the tape from Walmart would be full of evidence - what they purchased; enough food for the week (the questionable fishing pole??) - their interaction - what was Mark's condition (as discussed before/been drinking?) - was someone following them? So many questions.

I also am thinking Mark gave his initial story (so pitiful) that Dylan ran away - see, he took "all" his stuff, etc. Remember at the beginning Mark was always saying the investigation was a week behind - why did they wait so long to search the lake; I told them he took his fishing pole - why did they wait so long to search my house; I have given then access and been cooperative, etc.

Mark knows that Dylan was never at his house; his problem initially was his "ex-wife", not that his son was missing. Get rid of Dylan; get rid of "ex-wife"....and things got out of control quickly.

I was so hoping initially that Mark had taken Dylan somewhere else and I still want to believe that but it's been over 2 months.....and the actions/inactions of Mark lead me down the path to a difference answer....Mark knows where Dylan is....

MR did not met with ER & CR in the beginning, he met with CR and his oldest son.

So after meeting with CR , CR still feels several weeks later that MR is withholding some sort of key information. To me that is HUGE ! I
totally forgot about them meeting back then. I remembered an older
son but not CR. CR still wants answers, which means a sit down face
to face with his own biological flesh and blood parent did NOT give
him any type of comfort and left him feeling at least as suspicious.
Things that make you go hmmmm.

I still think the reason why he does not want to sit down with Elaine and have a face to face meeting is she was married to the man and will know if he is being evasive or lying to her .

This is a bit inaccurate and should be put in context. LE did search MR's house, with his consent before the search warrant search. So... they didn't wait 10 days. They responded to the situation, looked at the surrounding circumstances, did what they felt was needed at that point. Imo, they really thought they had a runaway on their hands in the beginning. And that makes sense. Dylan didn't want to go to his dad's, sent a scowly message to mom, couldn't go to his friends right away, was known to hitchhike by his friends. It wasn't until LE managed to gather more info and time went by, that LE determined this was more than a runaway case and went for warrants.

But by that time, LE had already searched MR's house. A consent search is legal and won't violate the 4th Amend. and LE knows that - so I would think that they did more than just a cursory search before the warrant. Of course I don't know and I doubt they are going to tell us, but they didn't wait 10 days and just a further note (not from your post) - MR did not demand a warrant, he gave consent.

It could have taken the full 10 days to convince a judge to sign the warrant. There has to be probable cause to get a warrant, and apparently they did not find anything incriminating enough to a judge to sign it.
LE has to present what they found to the DA and the DA puts the request in writing to the judge, who then decides whether a search warrant is applicable. And the request for a warrant has to list specific things they are looking for. If they found nothing in the first initial search that was suspicious or incriminating, then there was no probable cause to do the search, until more facts came out and it was clear that Dylan did not run away, and may have been abducted.
But even if he signed a consent form and allowed them to take certain items from the first search, a defense lawyer would fight to keep that from being admitted into evidence. LE prefers to have a warrant before they will remove anything from the home. It's SOP.

It was the interview about 2 to 3 weeks ago, after quite a few weeks
of nothing and ER and CR are sitting together on a couch. CR muttered
it almost under his breath. It was not an answer to a direct question
and once again, the highly skilled and perceptive reporter did NOT
say Oh hey CR what is that you just said? Would you like to
elaborate? Is there even such thing as journalism school anymore?
The lack of questions asked by any of the people reporting on this
case you could fill a book with !

No I don't know at all who his friends are and where they might live other than what I read on MSM.

If you can clarify with someone "IF" he had a friend in Vallecito, it would be helpful. My intent is NOT to "sleuth a minor(s)" - but merely to determine roughly where that individual(s) lived in relation to MR - since MR did state specifically that he went there first when he realized DR was missing. I only intend to try to figure out if that is another possibility and what is in that area (of the friend's place) - i.e. businesses, terrain, RSO's, etc.... TIA

Well honestly if MR is guilty of doing something with DR ,it would absolutely behoove him to point everyone in the direction of a runaway at first and let the trail go cold, right. Things like ( paraphrasing) 'his friends mean a lot to him, i wasn't concerned, i dont think he's even in the area now' all point to a probable runaway. By the time LE eliminates that option, any trail is cold, most evidence removed or ruined.
Do we know or has anyone looked previously into the trash situation? When and how often his trash is picked up and where does it go or does he burn it or is there city/ trash? I'm guessing no city trash since I just looked up any city service for Vallecito and the closest I got was a Vallecito Water co !

I looked into this early on. Not sure if LE did anything about searching trash although I know searchers in the first week were looking in trash bins. Evidence could have been in the landfill or recycle station by then.

I was asked a question a while back and I'm sorry for not remembering who asked it. I've been trying so hard to catch up and finally did.

There was an incident when my children were not returned intentionally and without permission or knowledge of where they were. Keep in mind that this was a long long time ago. At that time we didn't have cell phones or pages or any of that. MR did not return my calls or talk with me. After much discussion w/LE they did take it as more of a criminal vs civill matter but not much, they contacted MR and that was about it. MR was with the children the entire time.

Sorry for forgetting who asked this. I'll try to do better I promise.

I am going to totally speculate on the Nerf ball.

I have no idea if a Nerf ball would collect "greasy McDonald" fingerprints or DNA. I think it is a possibility though. If so maybe there will no fingerprints from Dylan on there & MR may have some 'splaning to do but if his fingerprints are on there would LE be able to date them? I don't think so but I wonder about maybe bacteria growth from eating a hamb. or fries something along those lines? I seriously doubt MR is going to move pass suspicion unless there is some kind of proof Dylan was there, although a 2nd poly would help if the lst one was inconclusive. Hopefully, the evidence that came back revealed something helpful to the case.

absolutely. I liken it to the stalker, NOT SAYING HE IS, remember how the stalking laws had to be changed and revised because those creeps would dance right on the edge of legal and illegal.

@TxLady, they were returned the next day. Again, that was after LE got involved.
