Somebody just like me is going to be sitting on that jury. I never said "PF dropped the baby off anywhere;" I said I don't believe she was there.

JMO
Then someone like you definitely is NOT going to be sitting on that jury, because DA May is going to excuse anyone who isn't willing to listen to the evidence in the case.

Saying you believe certain things did or did not happen without any evidence whatsoever to support that stated belief, is not forming an opinion based on fact.

How did she get there? We know where PF was and when.

What is the basis of this?
It's all in the preliminary hearing. Sean Frazee told LE that Patrick arrived for Thanksgiving dinner after he arrived at 2:30 pm. There is no security video showing PF returning to the condo with the baby. There is security video showing PF there at 3:36 pm. No mention that baby would be with him. I think if LE had solid evidence PF murdered KB while the baby was present, they would have slapped a charge of child endangerment on him.

10:19 a.m.
Frazee’s lawyer asked Adams about his interviews with Frazee’s brother, Sean Frazee. Adams said Sean Frazee arrived at Thanksgiving with his family around 2:30 p.m. and Patrick arrived later. Sean said he didn’t notice anything out of the ordinary. The defense claims Sean was a member of law enforcement and would have noticed suspicious behavior.

9:43 a.m.
A still frame from the surveillance camera showed Frazee, Berreth as well as the flowers that she picked up from the Safeway store in front of her door around 1 p.m. on Nov. 22. When asked if he was aware of another video showing Frazee there at 3:36 p.m., Adams said yes.

The DA can't excuse everybody. My opinion IS based on the evidence that was presented at the preliminary hearing and I've repeatedly posted the link. You really think I'm the only one who formed opinions based on what has been reported by the media?

So in the 7 minutes between when he left Walmart with the baby and arrived at Kelsey’s house, the baby went where exactly?

This man is facing charges that would put him away for life. I think “child endangerment charges,” would be frivolous.

Besides that, if the baby was in her playpen, then she wouldn’t have been in danger.

Or atleast that one could prove.

Sam is awesome, no doubt, but mistakes can happen. Either the AA is incorrect OR either Slater misspoke OR Sam misreported. I'm sure it will be cleared up at trial. I choose to believe it happened in the living room and if I'm wrong I'll eat crow. I don't like the taste of hats :p:D
You're not going to be the one eating crow. :)

That was one of the tweets that was later corrected. I'm pretty sure the correction is in the media thread and I'll look for it when I get a chance. MOO

Patrick Frazee tied sweater around Kelsey Berreth's face, beat her to death with bat, Idaho nurse told police
When they learned that the main attack had happened in the living room, investigators tore up the wood floor and found traces of what they believe to be Berreth’s blood all over the room, Slater said.

Here you go. No hats or crow for you. :)

When did an arrest affidavit become evidence? I'm under the impression is merely served as probable cause. If I'm in error, please provide a link.

Sam was in the courtroom. If you don't want to believe the testimony that's up to you. I don't believe Slater misspoke or it was misreported because Sam wasn't the only reporter in the classroom. I wasn't there.

Does anyone remember off hand why SF pleaded the 5th? What was it they wanted to question her about? TG day or the day of the bonfire, the 24th?

The bonfire, what PF told her about KB, why Baby K was there, without KB. The relationship between KK, PF, and KB.

SF has been taking the fifth for every hearing. It will be interesting what impact this will have during PF's trial.

PF's "plan" is to make KB out to be an abusive, alcoholic woman, who had mental illness and abused Baby K. Sick. I think that they will also attempt an affirmative approach, that KK was jealous of KB,

Patrick Frazee's allegations that Kelsey Berreth was abusive to be allowed in court

“Sells said prosecutors had wanted Sheila Frazee to testify about when her son arrived at Thanksgiving dinner the day Berreth disappeared, the wellbeing of his child, and a steel rod that may have been recovered.

She was also expected to testify about what was referred to as a “burning incident” at Frazee’s home, according to Sells.”

SF didn't take the fifth at the Preliminary Hearing. Her attorney advised she would do so if required to testify and the Judge decided her testimony wasn't needed at the prelim. As for other hearings, I'm not aware so please provide a link. Thanks.

1:33 p.m.

Judge Sells says he thinks the evidence the state seeks from Sheila can be presented from other witnesses. She is still sequestered, so she is not allowed in the courtroom.

1:32 p.m.

The state wants to ask Sheila about the phone call on Nov. 22 from Patrick, witnessing the burn, and more. Judge reviewed the case law citations. He says this is not the time & place for Sheila’s testimony.

Right. The judge decided her testimony wasn't needed at the prelim. I look forward to it at trial.

Oh, it's ALL problematic for Ma F.

DA May called her to testify, and her attorney pleaded the 5th on her behalf.

Of course, a person can only plead the 5th to avoid self-incrimination.

If you ain't guilty of any crimes, you don't need to plead the 5th.

So there's that.

Can you please answer my question as to where the baby went in that 7 minute time period, and show the evidence you believe proves that K was at Sheila’s house at this time?

The baby being present is mentioned in the arrest affidavit.

In light of first degree murder charges, piling on charges like “child endangerment,” is completely frivolous.

The charges themselves are not, as you seem to be implying I believe. Just here.

BBM You're in error.

It was misreported and then corrected; one of several. Most of the reporters tweeted that they were having trouble hearing. Here is the correction:

Live blog: Patrick Frazee appears in court for preliminary hearing

9 a.m.

The prosecution has filed three additional charges against Patrick Frazee, including tampering with a deceased human body and crime of violence, which is a sentence enhancer.

The documents regarding those new charges have not yet been made public by Colorado Courts.

Tuesday’s court appearance is a preliminary hearing, which means the prosecution will attempt to show the judge that there is enough evidence for the case to go to trial.

The prosecution tried to call Patrick Frazee's mother Sheila Frazee as its first witness, however, her attorney argued that she should not be compelled to testify, citing her Fifth Amendment rights.

The judge ruled in favor of Sheila Frazee and she will not testify at this point, though he has asked that she leave the courtroom.
