Why would Barry or anyone offer any evidence (directly or indirectly) as to any motive to harm Suzanne?Actually, I've seen no evidence demonstrating that Barry Morphew had any motive to harm Suzanne. All I've seen, heard & read is speculation & conjecture. I'll keep an
open mind, but I'd want to see sworn testimony, texts, emails, audio, video, life insurance policies, etc.
What Info Could LE Provide in IN Guardianship Procedure?
@lamlawindy posted this in the last thread: "The statutory language actually states that "Any person may apply for permission to participate in the proceeding," subject to the court's permission. IC § 29-3-5-1 (emphasis supplied)....
if police took part and, accordingly, are unlikely to do so. It would certainly be unorthodox for police to attempt to take part, but the ability to get a possible suspect to answer questions under oath doesn't occur very often...." bbm sbm
I wonder, at Sept hearing if LE might request permission to participate, and if so what LE might present (azz-uming BM has not been arrested in connection w SM' disappearance).
Any possibility sheriff or designee either would write, sign, file an affidavit or perhaps, testify at hearing --- since [date] CCSO has been investigating SM's absence as a suspicious disappearance (possibly a criminal matter) and has not cleared anyone of being a suspect???
^ does not disclose any definitive LE findings, not endanger the investigation.
^ any danger of BM (plausibly) claiming defamation of character?
Thoughts on ct's possible reaction to ^? TiA
As always I welcome comment, clarification, correction, esp'ly from our legal professionals.
BBM:
What's " 3-3o hours" supposed to mean, anyway?
Is he claiming to have had 3 separate 30-hour interviews with LE?
Was he trying to insinuate he'd logged 330 hours' worth of "testimony" with the FBI and CBI?
Or, (more likely), did he start to say he gave 3 hours of "testimony" and then decide he needed to make it sound more impressive, and inflate his figures (yet again) to 30, instead?
This "3-30 hours" is just another iteration of the "10 people" touching the bike.
Or having searched a "200-mile radius."
Or his buddy who knows more than anybody about this stuff having done "400 tours."
Or that offer of a 210k reward for info leading to SM"s safe return.
It's all a load of horsecrap.
All of it.
JMO.
Why would Barry offer any evidence (directly or indirectly) as to any motive to harm Suzanne?
If he is guilty he is going to do everything possible to cloak his guiltiness.
Good point Ill edit my post.I didn't say that he did offer any evidence. I was responding to @Herlock5 's rhetorical question, "Who other than BM had motive? Uh.. no one?" Barry may have had motive, but I've yet to see any actual evidence thereof from anybody, be it investigators, Barry himself, or anybody else.
Sheriff Spezze or his lead investigator would probably have to appear, testify, and be subject to cross-examination. Any exhibits would probably have to be provided to Barry Morphew's attorney days in advance. As @gitana1 noted -- and I agree -- Sheriff Spezze would "have to reveal his case" against Barry (if he has one) to take part in the hearing.
It's a risk: Sheriff Spezze's counsel would be able to call Barry as a witness under oath. The government cannot do that in a criminal case because of the 5th Amendment. Barry might reveal something while testifying that helps Sheriff Spezze's investigation. OTOH, Barry may just interpose the 5th Amendment, which may give the guardianship proceeding judge pause as to appointing him guardian.
Yup. That's what I'm saying. But it's just a feeling...Are you saying BM might have had disdain for CCSO before Suzanne even disappeared? Maybe even specifically for Spezze himself?
I agree seems personal, JMO.Yup. That's what I'm saying. But it's just a feeling...
Absence of evidence should not be construed as evidence of absence. I mean there is no body but we know she is deceased.I didn't say that he did offer any evidence. I was responding to @Herlock5 's rhetorical question, "Who other than BM had motive? Uh.. no one?" Barry may have had motive, but I've yet to see any actual evidence thereof from anybody, be it investigators, Barry himself, or anybody else.
Very interesting angle. Are you saying BM might have had disdain for CCSO before Suzanne even disappeared? Maybe even specifically for Spezze himself?
Why would you think BM would have disdain for a well respected man with a long successful career in law enforcement? Maybe because he wasn't able to impress him with his inflated sense of self importance?Yup. That's what I'm saying. But it's just a feeling...
Personal in one direction. MOO. If you're used to people buying into your stuff, running into someone who doesn't is going to knock you off dead center. We have no evidence of any interaction between the two before this case. With regards to this case, BM wants to sell the bike, and LE (at least by their actions), isn't buying it. Goes back a number of threads, but what ever the issue is with the bike, there was a huge mistake made with it, and LE discovered this almost immediately. IMO, BM doesn't have a clue as to what that mistake is. LE isn't wasting time on the bike, or any ancillary theories surrounding it. LE is not doing anything arbitrary, I don't think that's how professionals behave. The harder BM tries to steer them, the worse it's going to get for him. MOO.I agree seems personal, JMO.
It would also give credence to speculation that LE knew about the potential situation before the 5:46pm -911 call. Why would you think BM would have disdain for a well respected man with a long successful career in law enforcement? Maybe because he wasn't able to impress him with his inflated sense of self importance?
I couldn't imagine them mixing socially. BM has to be top dog in any group to feel comfortable.
And I gotta feeling BM plays loose with rules of decent society.
Maybe he really tried to be that God fearing husband, hoping it would pay off for him. But it looks like he's been in a midlife crisis since moving to Colorado. Old cop had a great post concerning this. I think he was bored with his life and breaking a few rules. Moo
I wanted to use it on a post yesterday and ended up deleting my post because I couldn't find it. We need to record these news clips! Thanks for remembering @PaulaDC!
I'm pretty sure it was News 4-- I can still see the reporter and son standing in the street (in my head) as close to the roadblock as they could get, and immediately felt bad for MB, the elderly homeowner when she became portrayed as the Mrs. Kravetz of the hood.
A resident living next door for more than 30 years, she reminded me of my grandmother. I'm sure she's lost sleep over this-- not because of her exposure but because she's truly worried that a mother and town resident vanished from her town, and is likely dead and hidden nearby. Video clip of MB interview below.

We can't see what we can't see. My gut feeling says whatever it is isn't something one talks about with others. Especially if you're worried about image. It's something one stews over. mooI didn't say that he did offer any evidence. I was responding to @Herlock5 's rhetorical question, "Who other than BM had motive? Uh.. no one?" Barry may have had motive, but I've yet to see any actual evidence thereof from anybody, be it investigators, Barry himself, or anybody else.
Or, a situation. They reacted very quickly on May 10th. IMO that's significantIt would also give credence to speculation that LE knew about the potential situation before the 5:46pm -911 call.
