Inheritances aren’t considered joint property though. In Colorado , all property acquired during the marriage , with the EXCEPTION of gifts or inheritances are considered joint property and are subject to division. It Doesn’t matter where her inheritance was held-if it was tied up in the down payment of the house or in a savings account - It is still hers. Unless it is proved that she’s dead. And I’m not sure how that gets proved.
IANAL. IMO, I think the only way inheritances can be protected is if they are set up in a Trust.

I'm JMOing this until I can get clarification tomorrow

  • I want to know if Lauren asked him about the guardianship and of course the bleach smell.
  • 1) A lot of sleuthers now believe the crime was committed on Saturday night. Has Lauren Scharf asked BM for an accounting or alibi of his Saturday evening/night activities and conversations? How about Friday?
  • 2) Did Morgan have her own hotel room and did it smell of bleach too or not?
  • 3) there have been a lot of accounts of BM shopping Saturday before Suzanne went missing. Has she asked where he went and what he bought?
  • What did BM do on Sunday, from the moment he left his house, to the moment he arrived back?
  • What do we know about the security cameras at the Morphew home? Were they working prior to and after Suzanne disappeared?
  • I want to know if Lauren has a sense of BM’s mental health? How’s he holding up? Missing wife and all? What’s he doing to keep it all together? Where is he in the grieving process? Is he still holding out hope? When did it become apparent to him that he would likely never see SM again? Does he have any regrets?
  • Lauren - Is there a list of all the diggy thingies that BM owns or has access to?
  • Did the previous owners of the Puma Path residence leave the black barrels in the garage behind when they moved out? (Road salt containers?)
  • Also, when BM said, “if this thing saved one life, it would be worth it to SM” paraphrasing here, but can you explain this?

Very true. I’ve said it before, but I’ll say it again, IF BM is innocent in disappearing SM, then he is guilty of being a bad husband IMO.

I know some will say - well, he’s a private person or maybe he’s too shy or uncomfortable to speak out, etc...

BM has been controlling the narrative from day one. The only times that BM speaks out is to defend any allegations against HIM. He puts out a 26 sec plea for his missing wife, but gives LS a thirty minute conversation to degrade his workers and accuse LE for everything else. :rolleyes:

I have tried many times to consider other possibilities, but each one falls flat for me. We are approaching 5 months now, and if BM’s alibi or stories matched up, LE would have cleared him by now. In fact, when BM announced he had been cleared, LE was very quick to respond to LS that he was not.

If anyone has other theories that would point away from BM, then I would certainly listen to those (as long as I don’t have to do mental gymnastics to get there) You don’t have to name anyone you may suspect, just hypothetical scenarios.

Yes, 3,4000 square feet would be considered large. A majority of people live in homes from 1500 - 2500 square feet.

It's the size of my daughter's condo - but bigger than my own house (almost double the size of my house).

Average house in America in 2015 was about 2700 sf. So not huge by any means - given that it cost over $1.5 million.

In Denver, in 2018 it was 2600 sf.

In my state property held joint with right of survivorship Goes to the survivor unless there is a valid written instruction otherwise - if married at the time of sale of joint property it’s distributed at closing unless - again- there is a separate legal written instruction. I’m waiting for the for sale sign to go up

Yep - I think we'll see that house up for sale (and no Suzanne in sight) within the next 6-10 months. He may be unwilling to press the matter of whether his Indiana guardianship will let him sell the house in Colorado at the current time, but I think there may be events that allow/force him to do it (and provide a legal mechanism).

Yep CO recognizes the IN guardianship from what I understand so he can convey that property with his IN Letters Of guardianship

And we don’t really have their bank statement showing the transaction source of this purchase of the home do we? At this point we only know what her brother knows regarding the inheritance - now what I would like to see is the check that distributed this inheritance (or wire transfer) - did it go to a joint account or a personal account for our gal ? Once those funds are co-mingled all bets are off IMO - again this is my state - CO? Who knows ? The thing is when you list and sell a propert and set up closing - who’s going to question the distribution of the proceeds? No one questioned what happened in the June 5 sale of the IN property which was the subject of the initial guardianship proceedings so I think if that property (CO) was listed and sold - he would get all of the money at this point- unless someone intervenes?

ITA and besides, I know you know what you're talking about. You actually do this for a living.

But I've always been told that co-mingling means...it's now community property. That's in California.

And you're also right that once co-mingled or invested in joint tenancy or any similar instrument, the property - going forward - is joint and no one is going to go back and disentangle it (unless there's a divorce with lawyers on one or both sides).

Now that the money is invested in a home owned jointly by both SM and BM, if she is gone - incapacitated? - he can do as he likes with it (if she has to be declared dead, that's a different matter, but if as some have surmised, he can use his Guardianship from Indiana...well...oof).

Lauren has spoken to one of the daughters. One of them is living with him. Lauren verified that he has moved into a condo, due to privacy issues. Morgan has answered every single question that Lauren asked-she has been very forthcoming.

I will be surprised if LE gives them BM's gps and phone pings, wouldn't that be them calling him a suspect?

I’d imagine LE will give them areas to search without giving them info like ‘this is BM’s phone ping from Saturday night’.

They’ll just say - ‘search here and here and then here’.

Lauren will be at the search each day, if her bosses allow. Lauren did ask Barry what his last words were to Suzanne, but he either chose not to tell her, or could not tell her. Lauren is still walking that fine line of hoping for more from Barry, so not revealing too much. Andy and Barry have communicated on some level since Andy first started going public. Lauren is close to confirming where the wall is-awaiting city documents, and will hopefully be able to reveal details including where, when, cost. Barry gets emotional, then changes it up. Asked Lauren is she believed in God.
