IANAL. IMO, I think the only way inheritances can be protected is if they are set up in a Trust.Inheritances aren’t considered joint property though. In Colorado , all property acquired during the marriage , with the EXCEPTION of gifts or inheritances are considered joint property and are subject to division. It Doesn’t matter where her inheritance was held-if it was tied up in the down payment of the house or in a savings account - It is still hers. Unless it is proved that she’s dead. And I’m not sure how that gets proved.
