This state attorney is all over the place. He seems nervous. The expert is completely relaxed and that's not a good sign imo.
Wouldn't you be if the Judge is being openly hostile and derisive? I've not seen behaviour this openly hostile in CT from a Judge in awhile and the effect of the Judges behaviour is carrying over imo to MT attorney and Fitzpatrick. Fitzpatrick now thinks talking over the State is acceptable and the MT attorney thinks talking objections are ok as is cross talk.

Judge imo started this whole day on the wrong foot and its been downhill ever since and all done to the great detriment of this entire proceeding.

Sad to watch this all being allowed to happen.

Lawyers are used to having a hostile judge on their case. When you've been practicing for decades, you will encounter judges who just don't like you or are hostile to your case. I've heard lawyers talk about this in interviews. It shouldn't ruffle his feathers. I think he's not well-prepared. I don't think it's the judge. JMO

Issue of how lying impacts proffer and cooperation agreement.

Arguable lies is what Fitzpatrick calls the MT timeline about taking a shower with Dulos. Fitzpatrick says he cannot call something a lie and relies on the record.

I strongly disagree as I believe we are seeing unprofessional behavior from this particular Judge.

Judge is now arguing with the State about speculation of witness in the the asked question and the tone of Judge is now focusing criticism on the structure of the entire line of questioning from the State.

Boy, she had a heck of a day with mistemembering everything that happened.

Witness: No, police are in the business of investigating. State prosecutors are the ones who prosecute.
State: Is it fair to say if you said that you misspoke?
Witness: Yes

We don't have enough to cover that this was important to raise?? He obviously misspoke!!

State needs to stop bringing up Judge Randolph. He knows this judge is annoyed and doesn't want the implication that Randolph already decided this issue, hence rendering his opinion almost a forgone conclusion.

Confirm that MT did not ask for Translator during the interviews.

Judge Randolph said in his decision that MT was smart, she worked briefly for ESPN as a reporter in Argentina and Bowman said that MT would present well in his early meetings with her.

Fitzpatrick said he has never met or spoken with MT.

It is Michael Fitzpatrick....I've used both too...I guess I'm simply over this person and his entire approach to being an expert in this case as it uses the record when its convenient and then speculates on the words and actions of others when its convenient.

Judge Randolph comments about MT being quite clear in her testimony during the interviews and even correct Det Kimball in a few instances about her testimony.

Now discussing that Fitz person said the 2nd interview should never have happened in his opinion.

He is basing this only on 2 pieces of info police wanted.

State makes point that other reasons could have existed to continue the interview. Fitz person disagreed and said the 2nd interview should have been shut down by Bowman.
