I think the judge already knows what he is going to do. Michi looks like she knows, too
This makes me quite sad. I hope other Judges and attorneys in the State of CT watch this 'trial' and see how this habeas process plays out. I would say that I wished AG Tong watched this trial but sadly I don't think it would make any difference as he has been leading the charge to release any/all prisoners on any shred of doubt about anything. Need a break and will take inspiration from the Farber friends and family and simply walk away as justice for jennifer was simply an illusion imo in the minds of a handful of folks. Tragic.

Never did I think this would go anywhere but now- it's on the table for certain. I pray the judge will surprise us.

If she goes to re-trial would that mean that all of her interviews would be thrown out and not come up?

I always judge the strength of a reversal liklihood by the way the state behaves. The state did not seem confident from what I heard last week and today. It doesn't bode well imo. I believe if the judge reverses the conviction the interviews will not be allowed in a retrial. The state may not even choose to retry her if it comes to that. JMO

I still am stuck on the idea that I had thought that the convicted felon is supposed to have exhausted all means of appeal PRIOR TO filing Habeus suit. Does anyone know how this Court proceeding was approved prior to the appeal being heard and decided?

This state attorney is not very precise and efficient in his questioning. He objected a lot during Fitzerald's direct exam last week and got overruled many times. He annoyed the judge last week and may be annoying him again today.

JMO
FWIW I think this view assumes alot of facts not in evidence.

Judge doesn't plan to take the full 120 days before presenting his written answer.

Did the parties rest?
And the petitioner was so pleased with her 'ineffective counsel argument,' that she's not calling Mama T to support no habla Ingles facade?

She had to agree to waive her right to argue ineffective counsel in this case ever again. It was highly unusual to cite this argument for a single attorney, and especially one not representing her at trial when she was convicted.

Wow. Thank you for explaining that so succinctly. I'm sure it was explained before but I'm sure my eyes glazed over while reading it here. This made sense to me. I hate it but it made sense.

I wonder if cash had anything to do with it….ok, ok, I take it back. Nobody in the judicial system would be influenced in that way, right?

I don’t know where to start! I was introduced to “Websluth” when Jennifer Farber went missing. I have followed the case with a magnifying glass - my heart just broke with her being murdered. This habius “Trial” seems so one sided! There is so little coverage of today’s (and last week’s) event - what are we all missing? We all know that mt is guilty but this little EXPENSIVE show is going to get her off? NO!

I remember Jennifer’s children’s statements pleading for mt’s maximum sentencing - that didn’t happen!
What are we missing here?
What am I missing here?

I’m rambling but my heart aches for a family that sooooooo many individuals only took advantage of their wealth.

Well, I remember Jennifer begging the State for protection and THAT didn't happen, either. The state is clearly focused on protecting MT's "constitutional" rights and not the victim or her family. Sounds like MT's family is doing everything possible to get her out of jail and as soon as possible. If she "wins" this trial, she'll be released until the retrial (I'm assuming). I'm also assuming that the retrial will not be as speedy as this habeas and might even disappear considering what evidence the State is now allowed to present. The whole thing is so horribly wrong and I feel for Jennifer's children and dear friends and family. Let's hope I'm wrong and that this Judge is able to see the big picture for what it is. Bowman did not provide misguided and unconstitutional advice. He gave the best possible representation based on her untruths and did it with dignity and professionalism.

I am totally confused. Did the day end and people left after the break? Will there be anymore testimony as redirect wasn't completed. I wonder if Marissa Alter was in the Courtroom to explain how the day ended.

The petitioner said they have no more witnesses.

Does the State have witnesses? Is this like a mini trial? I'm confused. Judge talked about his written response.... but also Friday. So what's on Friday? Honestly! Is it over? Is there more? Shouldn't that be clear????

How in the world could MT get afforded a new trial over ineffective counsel when it was MT herself who chose to ignore her counselor?

AB would have been the most corrupt attorney in the State if he allowered his client knowingly to take LE on a field trip to a known location that JFd was not. He was not and he did not. He believed she was cooperating with the State in order to nail FD and help herself in the process. How in heaven's name could AB have protected himself from that????? He believed she had information that was helpful to the State and he believed she was taking them in good faith to that location.

"The prosecution later mentioned that Fitzpatrick never reviewed the notes of Bowman, Troconis' former attorney, during his representation of her.
When asked, Fitzpatrick said this was a task for the council to complete and that it was not part of any mandate for him to perform. "

"I wasn't cleaning Jennifer."

No one said she was. What possible question is that a reasonable answer to?

Except maybe a leaked truth?

I don't think of the Troconis clan wants to accept that Conspiracy to Murder IS Murder. I think MT stands on her conscience, such as she has one, that she didn't kill JFd. FD did. However she was instrumental in the conspiracy to make that happen and cover it up.

Legally, that's just as bad.

"I wasn't cleaning Jennifer."

Why would anyone be "cleaning Jennifer"?

Why did she need cleaning?

We know there was a knife.

We know there was blood.

We know there were trash bags.

We know FD's truck went offline for hours. We don't know how many bags he started with. But we can imagine which ones he'd be motivated to get rid of first. Grim, but a decent fisherman could probably reduce a 100# tuna to a handful of manageable parcels in rather short order. Weighted down in a well, water source, interred, encased, discarded, disappeared.

Two bloody ponchos.

They probably DID shower together.

After.

JMO
Exactly . Why wasn’t she cleaning Jennifer? Powerful statement the speaks volumes.

Above article explains it somewhat.

Yes, they just wanted the house and the money. Jennifer and the children didn't matter. I will never forget those images of the entire Troconis clan coming and having their big Easter meals at 4Jx and they seemed to revel in the grossness of the grandiosity of the entire house. The house and the Troconis family imo are both distasteful and greedy to boot. We haven't even gotten to the family testimony. I hope we don't have to go into the issues yet again of the father claiming to be a US doctor when his language skills precluded him from taking board tests in the US or the mother claiming to be a psychologist when she had NONE of the required training and certifications. This imo is an entire family of fraudulent people who have made claims about themselves and MT to the Press and because the media coverage of this case was so poor, that we never got an accurate picture of who precisely ALL of these people are. I am glad in a way that the MSM was so awful in this case as at least it got WS here to drop the requirement for direct MSM quotes as we all quickly learned that any of those quotes really were just planted statements by the attorneys and their PR representatives. Its been a total media sham and so seeing the Queen of the SHAM Ms. Shannon Miller mentioned today was simply the end of the bridge WAY TOO FAR!
I remember it well. They had dollar signs in their eyes. She was her knight in shining armor. Such fools were they. Stupid and greedy.

You are scaring me. Keep the faith. I’m not ready to give up. Hoping commonsense will prevail. It must.
