Leonard Birdsong, a law professor, said pleading to something less than a felony is critical to her defense.

"Very often, when jurors hear you have a felony conviction, they are going to feel that perhaps you're lying about your story," Birdsong said.

Birdsong thinks a plea deal will be announced, and Casey Anthony will plead to something less than a felony.

"If she goes to the murder trial and takes the stand, the government, the state, will use that to impeach her testimony," Birdsong said.

ETA...The defense is looking to suppress her sexual activity, no? So I guess they won't claim she was a sex addict but I wouldn't put anything past this team.

Ah, but these are penalty phase experts.

During the trial, she's lily white.
During the penalty phase, she's a poor sex addict.

I can think of several addictions that Casey may have had. Shopping - impulse buying (with money not her own), her cell phone/texting (stealing money to pay her cell phone bill)... just to name a couple.

Exactly ~ I'd put her cell phone over a sex addiction any day, followed closely by her lies and stealing.

Just think, if she could have "held it together" a couple of more years, with the way that cell phone rates have come down, she could have gotton by with a $45 a month plan, no co-signers, no background check, no depost, pay as you go with unlimited anytime minutes and texts with "Straight Talk" through WalMart.

This says they intend to call the following "additional witnesses" at any penalty phase ....
Who are the original witnesses for penalty phase? Is that list still sealed?

As far as I know, HHJP hasn't yet ruled on Finnell's motion which was heard on Dec 20, so that list is still temporarily sealed.

My thoughts and what the heck do I know but it is the last day of the year so here goes:

They (Ann Finnell) did ask to have the penalty phase experts sealed and got it on a temp basis. So now, and I think she is just using a weird twist of words, she now has witnesses she also wants sealed to avoid "rampant online speculation". So this is her second request........for sealing that is.....

LOL - it works for me. Where's FaeFrost???

Well, guys I was really kidding. I did not mean all 20 somethings but it is not unusual for young people to want to get together for something other than roasting marshmellows. I would say it is normal behavior. Jumping from partner to partner is more like someone you were trying to scam caught on to you and not a sexual addiction....next partner, please. lol jmo

I think in Casey's case it was attempts at manipulation rather than an addiction. She used sex as a bargaining chip, not a daily/hourly need for satisfaction.


Which reminds me - the shrink that originally visited Casey in jail was a sex addiction guy. I don't see his name on Finnell's motion. What happened to that one?

HHJP reserved ruling on the Penalty Phase discovery, I have no clue why she is adding witnesses, as far as I understood AF was to name the mitigation expert:

Psychologist Stephen Gold visited the Inmate in jail on Aug 26, 2010 for 5 1/2 hours, and 2 hours the next day Aug 27th.
He specializes in research, treatment of and training in psychological trauma and trauma-related disorders, disassociation, hypnosis and sexual addiction-compulsivity, according to his website.

But would an addiction to sex be a "defense" for having murdered her two year old daughter?

However, it would not surprise me to see JB try that among many other ludricrous defenses.... if you can even call it that.
If Casey is found guilty, the defense would have a better shot of sparing her life if they simply beg for mercy.

I wonder if he is on the 'sealed' penalty phase witness list?

I was surprised to see the additional 3 names in the motion because the defense wanted ALL the witnesses names sealed. I thought about it and came up with a reason these three names were 'outed'. Ms. Finnell's main argument about keeping the witnesses a secret is because they will be 'hounded' by the media, etc. These three names were 'researched' as soon as they become known. Heck, I looked up info on them myself! I wonder if this was deliberate and now Ms. Finnell can point to the information about them that has been 'posted' as perfect examples of why she wants that list to stay sealed.

Maybe he's been invited into the case to investigate GA. We still don't know if KC's accusations of sexual abuse are true or not. Just say'n.
