Defense Motion to Seal Penalty Phase Discovery Documents

My thoughts and what the heck do I know but it is the last day of the year so here goes:

They (Ann Finnell) did ask to have the penalty phase experts sealed and got it on a temp basis. So now, and I think she is just using a weird twist of words, she now has witnesses she also wants sealed to avoid "rampant online speculation". So this is her second request........for sealing that is.....

probably a better question to ask one of the Lawyers. I just assumed that this was AF identifying more planned penalty phase witnesses.

Psychologist Stephen Gold visited the Inmate in jail on Aug 26, 2010 for 5 1/2 hours, and 2 hours the next day Aug 27th.
He specializes in research, treatment of and training in psychological trauma and trauma-related disorders, disassociation, hypnosis and sexual addiction-compulsivity, according to his website.

TY. Any guess as to why he's not on the penalty phase expert list? Perhaps he came to a conclusion that was unacceptable to the defense?

We don't have the list of 50 or so penalty phase witnesses mentioned at the hearing, it's still under seal. It is quite possible he's still on it.

I wonder if he is on the 'sealed' penalty phase witness list?

I was surprised to see the additional 3 names in the motion because the defense wanted ALL the witnesses names sealed. I thought about it and came up with a reason these three names were 'outed'. Ms. Finnell's main argument about keeping the witnesses a secret is because they will be 'hounded' by the media, etc. These three names were 'researched' as soon as they become known. Heck, I looked up info on them myself! I wonder if this was deliberate and now Ms. Finnell can point to the information about them that has been 'posted' as perfect examples of why she wants that list to stay sealed.

Everyone manipulates everyone I guess. It's a world of manipulation.

Or because he doesn't want to dislcose any "report" authored by Gold in order to protect his "strategy".

There are already sealed docs regarding the one penalty phase and now they are asking to seal more docs that may be used during the one penalty phase, is this correct? So it's the second request to seal discovery to be used during the Penalty phase of the trial.

More hyperbole from Ms Finnell. I doubt she could come up with one name of any witness/expert/counsel that have actually been hounded by any media.

Very interesting that the Defense listed 3 more witnesses after asking to have all the witnesses for the penalty phase sealed.

Yes only one penalty phase, which comes after the guilt phase. The first list is sealed. This is their attempt to have more added on, the deadline to list the witnesses was 12/3 I believe, it was originally 11/30/2010 but I think HHJP gave an extension. Either way, the judge will have to decide.

'Cause I am thinking that the SA can bring up this guys past discipline records and the things he was reprimanded for will crucify his credibility BIG TIME, if I am correct...

Far be it from me to help Casey avoid the needle, but sheesh....Couldn't they come up with someone who doesn't have THAT to overcome???

Please take my incredulous post with a grain of salt because I have never had to prep for a penalty phase so I am not sure if the SA can bring up his past disciplinary record, but I would think so...

Krop was restricted in future custody evaluations...that's no small thing.

Not really the type you'd want giving "expert" opinion in a case like this, involving negligence, etc.

Well, I guess when you're [an unusual person] and your defense team is [an group of unusual persons], all you can find to defend you is more scum. It doesn't surprise me that they can't even penalty phase witness who don't have credibility to defend Casey, not in the least.

Now if some credible, upstanding person wanted to defend Casey, that would be shocking.
