Defense Motion to Seal Penalty Phase Discovery Documents

:floorlaugh: Your nerves are frayed, have you been over in the motion denied for JJ's computer thread getting stressed out like me? :blowkiss:

Nerves are shot, patience is gone, I'm about drive home in Chicago rush hour traffic in some crazy snow after a miserably long week.

I am now banning myself for a few hours

Were these TES volunteers listed by defense as witnesses? If they were than I'm sure SA would want to interview them to see what they are going to testify to. Since we know there was pressure put on JJ to say no body was there when he searched, it will be interesting to see what they have to say. Not that we will ever know if they are just investigative interviews. jmo

That is what puzzles me, at this point.
These (10) NEW Defense witnesses are NOT on any Defense Witness List that we have seen, to date. We have not seen a Supplemental Witness List with these TES searcher names on it, but the Defense may have already given it to the State, and it is just not filed (yet) with the Clerk's office?
The State's Notice of Taking Depositions - calls them "depositions" -- not ivestigative interviews.

Wonder why we have not seen a Supplemental Defense Witness List for these (10) NEW Defense TES searcher witnesses??? Don't the people have to be on a witness list before the State takes a deposition from them?

ThinkTank, if HHJP has ordered their names "kept confidential" (don't want to say sealed and start another snowball rolling) they wouldn't appear on either witness list would they?

Maybe an update or addition will pop up with witnesses A - J on it next week.
Right now Baez is busy scrambling for defense reports to meet his deadlines.

Tick Tock Baez!

Any guesses as to when the list will be available for public consumption? There's no date in the motion for release. Or is it assumed not until the penalty phase...
It seems the Orlando Sentinel already has that list since they name witnesses in their article:

'The list of penalty phase witnesses provided today does identify Casey Anthony's close family members, including her parents and brother, many friends, ex-boyfriends and others already long associated with the case. Included on that list are familiar names such as Jesse Grund, Ricardo Morales Anthony Rusciano, Anthony Lazzaro and Amy Huizenga.'

I doubt the Sentinel will offer the list for download, they never do that AFAIK. Hopefully WFTV or WESH will pick it up soon.

But those names mentioned... I'm actually surprised to see Amy, Tony, Jesse and Ricardo. I'm betting they will be surprised as well

Wow thank you no name (great nic lol).

Well that clears something up for me. Those witnesses I bolded are not going to say anything nice about Casey. It's all about throwing Cindy under the bus. Guaranteed.

Even if they answer direct questions in the negative (like, no, I never saw Casey abuse Caylee) under cross examination they will have the opportunity to say really bad things about her.

SO this leads me to believe Finnell will call them for the express purpose of soliciting opinion about the way Cindy treated Casey. Where's my violin? I have to get the bow ready for playing... :)

THANK YOU MUZIKMAN for getting the Notice of Taking Depositions, with the (10) new Defense witnesses on them - TES searchers.
The Notice filed with the Clerk has full names and full addresses of these witnesses -- but MuzikMan and I do NOT include addresses when we post the witness list info.

State taking depositions on January 20, 2011 of:

1 - Rick Differt
2 - Timothy Fleming
3 - Ramona Maldonado
4 - Melinda White
5 - Toni Tedder
6 - Todd Webster
7 - Kevin Gallaway
8 - Lisa Gallaway
9 - Janice Smith
10- Robert Young

So, we know that these witnesses are not the ones that the Judge ordered JAC to keep confidential.

Thanks for that - haven't seen them but Nums24 is driving home exhausted - hope she isn't looking at her tweets or she will pull over to post - silly girl.

Well, it was the orlando sentinel that won that motion so I'll bet they had that press just sitting waiting to hit "print" LOL

Now those will be the penalty phase witnesses - I was just discussing the 10 TES witness JA will depose shortly - those names I don't believe we will see!

Oh it would have been so satisfying for nums to see this. Missed it by a hair!

I was wondering lately if the Defense had submitted their amended Witness List.

If these are the ones from the calling and home visit by PI Lyons the Defense had until, iirc, Dec 31, 2010 to submit the TES searcher witnesses...

So what date did the Defense submit the Amended List to the Court Clerk? Or did they?

We do not know (yet).
There is no entry on the Clerk's docket for "Supplemental Defense Witness List" (yet).
There must be one though ... because the State would not have scheduled depositions with these people if they were not already aware of the people on a Defense Witness List.

Are you telling me Baez has found 10 TES searchers prepared to say there was no water on Suburban, or is he saying he found 10 TES searchers who may have or can't remember whether or not they were there?

Hmm, but hiding their identity makes sense!

I can't believe they found 10 people, what a :croc:

Well didn't the Defense say they found over 100 new witnesses after the TES calling marathon?

IIRC, at a hearing Mason gave some high number and LDB stood up and refreshed his memory saying he told her 6-10.

I would think the JAC sealed list is that of professional occupation witnesses who will be paid for their services by the JAC to testify on behalf of ICA.

As to the list from the Orlando Sentinel; I laugh at JB, who for some odd reason believes that Jesse, Richardo, Anthony R, Tony L or Amy would actually get up at the penalty phase and have some kind words about ICA. Who royally put the screws to each and every one of them during their times together. Not to mention the fact they will be testifying AGAINST her at her murder trial. CA would confess to Caylee's murder before these young people would give kind words about ICA.

Boggles the mind more than the carp he has so far produced.

I'm just wrecking my brain what Anthony R could offer in defense of her character. Didn't their relationship consist of AIM conversations and booty calls?

That's funny. And they put in a motion about not mentioning her sexual relationships and the witnesses, well, you know. :floorlaugh:
