Defense Motion to Seal Penalty Phase Discovery Documents

Well shoot, JB and crew could put all our names on the penalty phase witness list too. Doesn't mean we will have something worthy to say does it ..... just saying .... just because their names are listed, doesn't mean they will testify favorably if they testify at all.

That's funny. And they put in a motion about not mentioning her sexual relationships and the witnesses, well, you know. :floorlaugh:

Hey Lambchop - they could be talking about the cooking, cleaning, shopping for treats with Amy's money, etc y'know!

I think JG is going to be the biggest help by placing all of ICA's issues on her parents. He knew that family dynamic well and he was reminded of it again as they threw him under the bus. He's going to be key IMO.

They've had KC's psyche duly investigated, and at the penalty phase remember it's just about giving that jury some way to understand how KC's head got so twisted that she would develop this huge penchant for lying, stealing, and murder, and how she was able to do all these things and still keep that fake front up for all her friends and lovers.

In penalty phase, JG will of course be gold for the defense because he is the one who can honestly say she ran the molestation claim by him years ago.

AR, TonE, AH, at penalty phase will indeed testify to KC's interactions with them and what those interactions indicate about her shady character--and the defense will attempt in every way possible to blame that shady character on someone else (duck, CA! flee, GA! giggle inappropriately, LA!).

If these names are on their penalty phase list that says an enormous amount about where their strategy is headed and indeed, how much they expect to end up in a penalty phase at all... :cow:

Question ... does a penalty phase witness need to give consent to be a witness for the defense? And do they confer with the defense attorneys about their testimony? What I mean is, in the case of the acquaintances listed so far as disclosed by the Orlando Sentinel, did they agree to be these witnesses for the defense during the penalty phase? Or did JB "🤬🤬🤬-u-me" they would be ....

God, that would make the rest of my life to see every witness that is supposed to testify on her behalf do the exact opposite. And the look that would be on Baez's face too...priceless! I know, only in my dreams, right?

Uh yeah, but he was thrown under the bus already. I highly doubt if the defense shows up at his door and asks him to testify on Casey's behalf that he would do it. If I were him, I'd tell them to go to hell and slam the door in their faces. No way is he EVER going to testify on Casey's behalf.

I would think the JAC sealed list is that of professional occupation witnesses who will be paid for their services by the JAC to testify on behalf of ICA.

As to the list from the Orlando Sentinel; I laugh at JB, who for some odd reason believes that Jesse, Richardo, Anthony R, Tony L or Amy would actually get up at the penalty phase and have some kind words about ICA. Who royally put the screws to each and every one of them during their times together. Not to mention the fact they will be testifying AGAINST her at her murder trial. CA would confess to Caylee's murder before these young people would give kind words about ICA.

Boggles the mind more than the carp he has so far produced.

I am speculating that they may wish to see her punished, like going to Prison, but they may not wish the Death Penalty on her..

These people are State Witnesses in her Murder trial..they are her peers, former friends, fiance, lovers who have been betrayed by Casey.
it seems who better in the end (penalty phase) to have, other than family, to save her from getting the Death Penalty.

I'm just wrecking my brain what Anthony R could offer in defense of her character. Didn't their relationship consist of AIM conversations and booty calls?

Yes..I am perplexed why he is on the list...other than he has expressed he doesn't want to see her get the Death Penalty.

I agree...he did say that the person she is now is not the person he fell in love with(or something like that)...he had compassion for her and IMO he probably still does...

For all the damage Casey, her family and the Defense have tried to do to Jesse he may very well be key in the Penalty Phase to keep her off death row.

This is the first time I've used a quote. I whole heartedly agree with this. At the penalty phase, AFTER conviction... Her old friends and lovers may feel justice has been served with LWOP, and not the DP.

Well, I might catch flack for my opinion here, but if I had a "friend" like ICA who I had known for a brief few years or less, and did what ICA is found guilty for committing murder of her daughter, I wouldn't have any hesitations in telling the defense team I could not in good conscience be a penalty witness for her. The 31 days alone, party harty and lying about it while smiling would be my reasoning.

Yes..I am perplexed why he is on the list...other than he has expressed he doesn't want to see her get the Death Penalty.

This must have escaped by me because I don't remember it.

Jesse is a better person than I am if this is the case.

I can see the family members begging for her life but all the people she had used and abused in a short few years and less shouldn't have the opportunity.

He also said she was a diabolical liar. It would be hard to get past that statement. First of all, knowing she was pregnant when she met him, she tried to pass it off at his child- then after Caylee was born she had his family baby-sitting while she 'worked' - until RG put his foot down and the 'Nanny' appeared, to save the day. I don't think they could risk having JG take the stand...

Honestly!

Her ex-friends are going to put themselves in the position of having their lives dissected and broadcast around the world for that piece of carp?

At best they're probably neutral about what happens to her. I doubt any of them is passionate enough about the subject to run a gauntlet for her cause.

If they are subpoenaed I think they have no choice but to appear. But having a hostile mitigation witness on the stand is not exactly desirable. PLUS a lot of them live out of town at this point. They already probably have to come once for trial. Bad enough. But agreeing to a second time to spare her sorry azz? I say no way.

What good is a hostile character witness? Really a terrible idea.

I think, ultimately, we won't see hide nor hair of them come penalty phase. Or if they are forced to come they won't be asked to sing her praises. It will be all about her relationship with her parents (boo hoo).

I just CAN'T IMAGINE after what they'll say during the case in chief (she's a liar and a thief) they'll be good character witnesses? The jury will laugh. It's too stupid.

If these are the only witnesses she has for character that's simply pathetic cubed. IMO.

I was trying to think who on the stand would convince me to spare Casey the needle. And I came up with three people.

The first two are Grandma Shirley and Grandpa (Alex? I can't remember his name). I mean, Grandma Shirley forgave Casey for stealing from her. Grandpa held Caylee one last time and might not want Casey dead because she was the one gave birth to Caylee. I know if I saw her elderly grandparents on the stand, I might have trouble giving her the needle. Her friends, no. Her ailing grandparents begging for her life? Ouch. I couldn't ignore that, and I don't think a jury could either. That's if they were willing to get up there and testify on her behalf in the penalty phase. Maybe that's who Baez was trying to protect? I would think if there's too much stress on them, they might not make it to trial.

The third powerful person would be Caylee's bio dad, if he was willing to testify on Casey's behalf. Of course, that's if he's alive. Caylee's father wanting to spare Casey's life might sway me. A man who never met his child, had that child kept from him her whole life, and his child was murdered by her own mother, getting up on the stand and begging for Casey not to be killed would be extremely persuasive to me and also a jury. Maybe Baez is trying to protect him too, if he's alive? Maybe he agreed to testify as long as he didn't get too much media attention for it? And I know HHJP said everyone is known to the case. It's possible the father is known, but hasn't been identified yet as Caylee's father, just maybe as a friend of Caseys? So that person would be known as a player in the case, just not Caylee's father. And maybe we won't be surprised by who it is. Just a thought.

I disagree. In lots of interview I watched of him he was saying things like "this isn't the Casey I knew" "she loved Caylee" and so on. I think he is gong to be a shocker. It seems to me he has more grudges against her parents than he ever did of her JMO.

You are possibly right. I just can't see him willing to get on the stand after everything his family has been through because of her. I mean, her parents called his dad the head of a Satanic cult! And it's not like she ever stood up for him this entire time either. I don't know. If he was willing to get on the stand and beg for Casey's life, that would definitely be powerful. I just don't know if he's willing to do that, though.

I agree with SP but grandpa IMO, health wise could never be called. IMO they are going to call her old school friends because theyhave said she was a good mom etc. They also called her a liar, but as far as her parenting skills most of them were in agreement that she loved Caylee. I agree if they could pull Caylee's father out of a hat that would be compelling.
