As a side note, I think the idea of "lacking ordinary care" being a criminal offense in France fits with what little I know about Napoleonic Code concepts.
The Napoleonic code seems to have the concept that one has the responsibility to contribute to a stable society, maybe by taking ordinary care. So..... if your ineptitide gets somebody hurt, its criminal?
For example, a Navy Shore Patrol Senior Petty Officer explained to me that he had to take creature comforts and do health and welfare checks on a Marine imprisoned in Tijuana. His offense was:
- Goes to a, well, illegal, but tolerated brothel. - Gets into a fight with a local. - Marine leaves.
- Mexican police come, local tries to stab one of the police. They shoot and kill the local.
The Mexican police then track down the Marine. He is put in jail for two years under the idea of:
- You needed to contribute to society by conducting yourself better (eptitude?) If you had not gotten into a fight, we would not of been called. The local would not of tried to stab one of us. We would not have need to shoot him- in this case, fatally. So, you are going to jail even though you were not even there.
