Do these two utterances seem somewhat contradictory?

Jen Soto: "That is normal for her. She has ADHD. She is very forgetful. I always have to remind her."

Why yes, they do.

It has always struck me so odd that in almost every interview, JS makes a point to say that Maddie was so very forgetful that she often forgot her phone.

It's also struck me as odd that in all of the interviews that have been released, not a single LE has asked Maddie's friends if she frequently left her phone at home.

IANAL and I may be mistaken, but I think JS was granted immunity only for that one interview.

AFAIK she has not been granted full immunity for anything.

The three types of immunity that could be extended to a cooperating witness are use immunity, derivative use immunity, and transactional immunity. JS was offered "derivative use immunity" and not transactional or "full immunity."

Derivative Use Immunity: The better, more extensive immunity is called “derivative use immunity” because it prevents the government from using not only the witness’s direct statements and evidence against them, but it also protects the witness from any evidence derived through additional investigation based on the witness’s proffered information. It guards individuals from the “derivative use” of the information they share during a proffer session.

Of course, neither use immunity nor derivative use immunity prevents the government from using evidence against the witness that was derived from entirely independent sources and investigation. While the witness’s cooperation would be considered mitigating and perhaps reduce the length and nature of their ultimate sentence, they might still be prosecuted.


There are several scenarios in which the government could prosecute the witness even after they entered into the immunity agreement. For example, failing to tell the truth, exaggerate others’ guilt, and minimize their own inaccurately, the government can consider that untruthfulness a breach of the agreement, freeing it from the obligation to honor the immunity. I believe, that the two "parents" themselves made sure, that Maddie often didn't take her cell phone to school (for specific reasons) and convinced her, that she had ADHD and had therefore probably forgotten it "again". It was safer for the "parents" to monitor Maddie's communication, when she was at home. And probably they had valid reasons to control her communication (after a night with SS or similar). MOO

Setting MS up to appear ADHD like helping her “forget” her phone, homework, etc., and making sure she saw herself as scattered, inattentive, and forgetful (incompetent), might also reinforce the appropriate answers she needed to report to her therapist/doctor to make sure she received prescriptions for Concerta or similar, so SS would have his supply.

Poor kid, meds to sleep, meds to wake up, probably not given consistently, which messes with you too. That scattered , inattentiveness, passed off as adhd, instead of trauma. how sick is this guy??

Today would have been Maddie's 14th birthday had that monster not taken her life away from her almost a year ago today. She had so many interests and so much to offer the world as a kind, smart, human being. Unlike the person that took her future from her who is pretty much a worthless individual in my eyes. That saddens me that she is gone, and he's still here asking mommie and daddy for root beer barrels to pacify him.

I'm not saying that she doesnt have ADHD, I couldn't possibly know that Just saying there are many crossovers between ADHD and trauma.

so contradictory that he was acting and whining to his parent's like he was the child while his defence is working double time to keep him from being a "dead man walkin'."

For those in the area, there is a memorial service today.
Interesting that the article you posted doesn't mention family. Sure, I suppose you could say they are advocates, but I'd think it would specifically say "family" if they're planning on attending. I'm betting JS doesn't attend. I wish we could find out where she's been at for the past year, and what she's been up to.

Soto's friends and advocates will gather at 5 p.m.

They are saying this is new bodycam video of SS and JS (mostly SS). I'm sure those that have watched every video out there will know if it's really new or not. (I'm lookin' at you, @ttjo. lol)

It is definitely not being held by family. The organizer has been instrumental in keeping Maddie's name and story out there, as well as getting the love lock memorial and others together. I wish that at least a couple of Maddie's family would attend, but I sure don't expect it.

Back on June 17 post 865: we knew he told the cop " dont mind the donut" but I think we just heard audio not body cam. I also remember the cop telling him to cover up that gun. It may have just been audio tho, not video. I think its the first police interview of SS we heard.
The first time this video was posted was when it cut off after they answered the door and there was a girl sitting on the couch to the right when the cop arrived, she was edited ( cropped out) after a day or 2. I know I posted a pic of her, but I think it got deleted after she was cropped out ( privacy reasons Im sure

I meant family in attendance, not the event held by family. :)

Gotcha :) Thanks! I've been a little emotional today and wishing that I'd driven down there to attend, so my brain is elsewhere.
They will be live streaming it, though.
I've had to step away several times due to the ugliness and evil in Maddie's case, but she is never far from my mind and heart. We all have those victims who just stay with us. Maddie is mine.
